SALT LAKE CITY — The family of Josh Powell is appealing to the Utah Supreme Court in a multi-million dollar battle over the estate of missing mom Susan Cox Powell.

In a notice filed with the state’s top court and obtained by FOX 13, Josh Powell’s mother, Terrica, and sister, Alina, say they are appealing a judge’s ruling that gave control of Susan Cox Powell’s affairs to her father, Chuck Cox.

The estate battle centers around $2 million in insurance money. The Powell family was challenging decisions Cox made when he assumed control of Susan’s financial affairs after her disappearance in 2009 and Josh Powell’s death in 2012.

Cox effectively cut out the Powells from collecting any of that money. In his ruling, Judge L.A. Dever sided with Cox.

In July, the judge raised questions about whether Susan Cox Powell was still alive, as no one had declared her legally dead. She vanished from her West Valley City home in 2009 and has never been found.

The family of Josh Powell is asking a judge to declare that Susan Powell was dead before May of last year.

Terrica and Alina Powell — Josh Powell’s mother and sister, respectively — filed a complaint Friday in 3rd District Court against Chuck Cox, Susan Powell’s father and conservator of her estate.

In that complaint, the Powells argue that Cox amended the trust in May 2013, and listed himself as the sole beneficiary of the trust that Josh and Susan Powell set up in February 2009.

The Powell’s attorney, Joshua Lee, said in a prepared statement Friday that Cox should not have been able to amend the trust, and it should have become irrevocable upon Susan Powell’s death — which he said likely occurred before May 2013.

In the original trust, Josh and Susan Powell had agreed that their assets and life insurance awards would be split evenly between their two families, Lee said in the court complaint.

"It should be emphasized that, like the Cox family, Terrica and Alina are also victims of the tragic events surrounding the Josh and Susan Powell family," Lee said in the prepared statement. "[They] seek only to protect the integrity of their legal rights and restore the trust’s original intent, as established by Josh and Susan themselves."

Terrica and Alina Powell are asking that a judge declare that Susan Powell’s death occurred before May 2013, and that Cox’s amendment to the trust is void.

In September, 3rd District Judge L.A. Dever prevented Josh Powell’s family from collecting any more money on his estate, saying they waited too long to challenge changes to his legal trust. The ruling will prevent the Powells from collecting assets in Josh and Susan Powell’s trust when Susan is declared dead, which will likely be in December — five years after her disappearance.

Susan Powell, 28, was last seen Dec. 6, 2009, at her West Valley City home. Her husband Josh was the only person of interest when he killed their two sons and then himself Feb. 5, 2012, at a home in Graham, Wash.

Utah law allows for a person to be declared dead five years after anyone last saw signs of them.

Steve Powell - the father-in-law of Susan Powell, the Utah mother-of-two missing since 2009 - has been arrested in Washington state on reinstated charges of possessing child pornography.

Powell, a person of interest in Susan’s disappearance, was only released in March from the Washington state prison after serving 30 months in a voyeurism case.

He had been convicted of 14 counts of voyeurism in May 2012 for taking surreptitious photos of two young neighbor girls in the bathroom of their home in Puyallup, Washington.

Powell, 64, was also charged in 2012 with possession of child pornography, but a judge dismissed that charge, because the images did not constitute 'sexually explicit conduct.'

That decision has now been overturned by Washington Court of Appeals.

'Mr. Powell so grossly violated the privacy of his neighbors and his actions were so creepy we thought it was important, as a matter of principle and as a matter of accountability, to pursue these charges,' said prosecutor Mark Lindquist.

Lindquist said that be only being convicted on voyeurism charges implies that Powell only watched.

'He did more than watch, he recorded it, and he should be held fully accountable,' he said.

Lindquist said that the charge is a Class C felony and that Powell now faces up to five years in prison if convicted.

Powell was arrested on Monday morning, is due to appear in court on Tuesday afternoon.

He is the father of Josh Powell, who killed himself and his two sons - 7-year-old Charlie and 5-year-old Braden - in 2012 after attacking them with a hatchet and blowing up their home. 

Josh is suspected to have killed his wife, although family members have voiced their belief that Steven was complicit in her presumed death.

Thousands of images of Susan Powell were seized from the home that Steve Powell was sharing with his son in 2011 by police serving a search warrant.

The images - some sexually suggestive - showed the missing Utah mother walking in public and sitting in her car - apparently unaware that someone was taking her picture.

Other images seized during that search included those of the bathing young girls that were used to convict him of voyeurism charges in 2012.

Other photos showed a variety of women, apparently unaware that a camera was focused on them, as they walked along sidewalks, in the park or the mall.

Steve Powell has never been charged with any crimes related to images of Susan Powell, but the files show she was often the focus of his lens.

Some of the images zoomed close to Susan Powell's crotch or her backside, including a set of photos taken through blinds as she's bending over and doing laundry.

None of the pictures, which were found on a disc in Steve Powell's bedroom, show her naked.

The folder dedicated to Susan Powell contains nearly 4,500 images.

In journals made public by authorities, Powell describes himself as a 'voyeur' and Susan as an 'exhibitionist.'

He talked about using a mirror to spy on her under the bathroom door, and he wrote about taking sexual pleasure in looking at images of Susan Powell that he kept on his computer.

Powell wrote in his journals about taking lots of video of Susan during a trip to Silver Falls in 2009, and a folder of images from the trip shows only photos of her backside as she's walking.

In one entry, dated a few months before Susan Powell’s disappearance, Steve Powell wrote that he had just woken up 'from a most pleasant dream about Susan.'

He described a sexually charged dream in which Susan asked him, 'Do you think I would make a good wife for you?'
Anne Bremner, an attorney who represents Susan Powell's parents, said the images support the family's assertion that Steve Powell had a concerning attraction for his daughter-in-law.

'When you look at those pictures, it's clearly surreptitious. It's clearly obsessive,' Bremner said.
The family believes Steve Powell knows something about Susan Powell's disappearance, and authorities have described him as uncooperative.

Susan Powell, who was last seen at her West Valley City, Utah, home on Dec. 6, 2009, has never been found.

Records have shown that Utah investigators handling the case focused their attention primarily on her husband.

Report recommends jail time for Steven Powell

TACOMA, Wash. - A state corrections officer has recommended that the father-in-law of missing Utah woman Susan Powell serve 60 days in jail for failing to get court-ordered sexual deviancy treatment.

The officer says Steven Powell continues to put the community at risk by failing to comply with court orders. He filed a report last week in Pierce County Superior Court.

A hearing has been set for Nov. 21.

Steven Powell was convicted of voyeurism in 2012 and served 30 months in prison for shooting photos and video of young neighbor girls using the bathroom.

Last month, Pierce County prosecutors reinstated a child pornography charge against Powell that had been dismissed during a 2012 trial.

He is the father of Josh Powell, who killed his two sons and himself in February 2012 while under investigation for the disappearance of his wife Susan Powell in Utah.

A message left with Powell's lawyer was not immediately returned Wednesday.

Now that he is a convicted sex offender, Steven Powell is required to undergo treatment by a psychiatrist. But Powell won't cooperate and has refused to give doctors the information they need to conduct the therapy mandated by the courts.

“He’s refusing to complete his psycho-sexual evaluation,” said Pierce County Prosecuting Attorney Mark Lindquist. “Specifically, he will not discuss his sexual history.”

Powell was convicted in 2012 on 14 counts of voyeurism for repeatedly videotaping two neighbor girls, ages eight and ten from his bedroom window as they used the bathroom in their South Hill home.

The 64-year-old Powell is the father of Joshua Powell, a suspect in the disappearance of his wife, Susan, who killed himself and his two sons in a fiery explosion at his home in Graham in February, 2012.

On Friday Pierce County Superior Court Judge Ronald Culpepper sentenced Powell to 40 days in jail for violating required sex offender treatment telling him he must complete the psycho-sexual evaluation or face more jail time. “If he fails to do that we’ll be back before the court again,” said Lindquist.

Powell is in the Pierce County Jail awaiting trial on child pornography charges dismissed by Culpepper during his trial in 2012.  Those charges were reinstated by the Washington State Appeals Court earlier this year.
