Kaine Horman responded to Terri Horman's withdrawal of parenting time Friday afternoon, in court papers filed by his attorney, Laura Rackner.

Terri had been seeking to share parenting time with the couple's daughter, Kiara.

Rackner hammered away at Terri, citing the fifth amendment: "Mother (Terri) hasn't even taken the stand and she has not yet invoked her right against self-incrimination. Instead, Mother's civil attorney advised the court that Mother intends to invoke privilege against self-incrimination and that mother will not testify at all in support of her motion."

At the crux of the argument is the chance that Terri could perhaps implicate herself in the disappearance of the missing boy Kyron Horman, Kaine's child from his previous marriage to Desiree Young.

Kyron went missing June 4, and Terri Horman is the last person believed to have seen the boy alive.

"Father (Kaine) believes mother has information concerning Kyron's whereabouts," Rackner writes. "While mother may choose not to participate in any meaningful way in these proceedings, her silence speaks volumes."

Yesterday Kaine Horman’s attorney filed Petitioner’s Response Regarding Respondent’s Motion for Dismissal in the custody/divorce proceedings between Terri Horman (respondent) and Kaine Horman (petitioner). There are some interesting points to bring out in this document. The first thing that Laura Rackner, family law attorney for Kaine Horman, points out, is that Terri Horman’s voluminous motion for dismissal is an attempt for her and her lawyer (criminal lawyer Houze that is) to afford her the opportunity to informal testify without taking the stand, taking an oath, and being subjected to cross-examination that, in the words of previous filings, most likely will incriminate her. Rackner points this out by noting that a party is not required to explain why they are requesting dismissal, they just request it and be done with it. But Terri and her attorneys didn’t do that. They filed a motion for a dismissal that included a five-page “declaration” of why she was doing so.

The two hours in which Terri Horman cannot account for on June 4 are critical, but the failed polygraphs and changing story as well as the desire for secrecy showed the police who it was that caused Kyron's demise.

Suspicion came almost immediately as Kaine questioned his wife, Terri, as Terri changed her story. Lying causes internal stress, for a variety of reasons, but the most obvious is that it is difficult to keep track of lies sincde they do not come from memory. Once a lie has been repeated often enough, it can now come from memory, though it is not "experiential" memory. This includes dreams, books, stories, TV shows, etc, in which a person can give recall, but not from personal experience.

The level of intelligence of the subject is also a factor. The greater the memory, the less likely details will be confused.

PORTLAND, Ore. -- Multnomah County sheriff's deputies said they returned to Sauvie Island to look for any clues in the disappearance of Kyron Horman disappearance, but wouldn't comment on exact search locations or why things seem to be focused around the water.




This is the first time since mid-October that search crews were on the island. Dive teams took to the water Saturday.

"We just feel really sad that he's still missing," said Linda Richardson, who lives on Sauvie Island.

Pastor Russell Richardson prayed for Kyron Horman's family during an early community Thanksgiving dinner.

"Our concern, of course, is for the family and for those doing the searching," said Pastor Richardson.

Eight law enforcement agencies and fire departments helped in Saturday's search and Multnomah County Sheriff's investigators say more searchers will be out on Sauvie Island Sunday.

They didn't say if a new lead prompted them to search the island again, or if it was just a follow-up to other recent searches.

"Our prayers are with the family of course. In fact we pray for them every week," said Richardson.

Kyron disappeared from Skyline School in Northwest Portland on June 5.

PORTLAND - The search for Kyron Horman resumed Saturday.
More than four dozen searchers were diving into bodies of water on Sauvie Island, the first time they had been back on the island in about a month.
Officials told KGW that the operation had been planned for several weeks but that they had had to wait for resources to become available from other agencies.

PORTLAND, Ore. -- Scouring the murky bottom of the Multnomah Channel is a tedious and time consuming task, but high-tech equipment is making the job easier for searchers.

Investigators from several agencies are out on the water this weekend. They tell FOX 12 visibility is poor to bad for divers.

"You're looking at maybe one-foot of visibility at the most, so it's diving by brail" says Deputy Doug Olsen with the Clackamas County Sheriff's Office.

When divers do get into the water, they aren't simply jumping in and looking around. Sophisticated sonar equipment is used beforehand to pinpoint exact locations where they should look first.

"Basically, we're just taking the sonar images off the bottom. We can adjust it for different widths depending on where we are," says Multnomah County Deputy Brett Lort.

The sonar scans about 100-feet off each side of the boat.

"We're just looking for images that are going to be outside of the ordinary. Things that aren't large logs and trees. Then we mark those spots and have the divers try to find those spots later," Lort says.

Investigators have not said what, if anything, they have found during this weekend's search. All do agree, however, they will help out again whenever they are needed.

"I couldn't imagine what the family's going through and just to be able to think about my children missing for that long...I want to bring closure," says Olsen.

E-mails and text messages expressing hatred for an 8-year-old Oregon boy missing since June suggest the boy’s stepmother “could have hurt him in the worst possible way,” the child’s tearful biological mother said Monday.

Before police shared the messages with her on Friday, Desiree Young would only say that she believed her ex-husband’s wife, Terri Horman, was withholding information about the disappearance of Young’s son, Kyron Horman, who would now be age 8. But during an exclusive interview Monday, Young told TODAY’s Meredith Vieira she is convinced more than ever that Terri Horman was involved and holds the key to solving the mystery.

“It’s very clear from Terri’s horrible words that she had a severe hatred for Kyron,” Young, choked with emotion, said.
Police have not officially named Terri Horman a suspect in the case, and she has not been charged. So far, police have found no trace of Kyron, who was last seen at a school science fair that Terri Horman drove him to on June 4. He was reported missing when he failed to return home that afternoon on the school bus.

United front?
Young’s interview on TODAY Monday was her first appearance on the show without her ex-husband, Kaine Horman. She is angry that Kaine apparently knew about the messages obtained by police, but never told her about them.

Young is also angry because she says her ex-husband never told her that Terri, whom he is in the process of divorcing, allegedly got drunk and passed out on the couch several nights a week.

Kaine Horman made those charges in court papers filed in connection with the divorce. Terri Horman’s lawyer responded in filings that the allegations are “vicious” and calculated to “poison” the public against Terri.

Even before she learned of the alleged alcohol abuse, Young did not have a high opinion of Terri Horman, whom she described as a “pathological” liar.

“She blamed a lot of the marital problems between Kaine and herself on Kyron; it was a huge point of contention in their marriage,” Young told Vieira. “She had expressed in great detail her hatred of Kyron.

“I now believe, without a shadow of a doubt, that not only she is capable of hurting Kyron, it is clear that she could have hurt him in the worst possible way.”

Asked why Kaine Horman was not at her side Monday as he has been for other media appearances since their son disappeared, Young said she is “disappointed” with her ex-husband’s “choices” and his decision to withhold information from her about Kyron’s relationship with Terri Horman.

“We are still a united front in the goal that we want Kyron home. We want answers. That hasn’t changed,” Young said. “I personally have learned of information lately that has disappointed me in Kaine’s choices in his behavior. I just can’t stand by and support the choices he is making.”

Holding onto hope
Young said she tried to get custody of Kyron about a year before he disappeared, but was unsuccessful. She told Vieira she did not know at the time that Terri Horman had been charged with drunken driving in 2005 or that Kaine was concerned about the effect his second wife’s drinking and behavior were having on Kyron and the Hormans’ toddler, Kiara.

“Kyron told me on many occasions he wanted to come live me. Terri personally wanted me to take Kyron,” Young said.

“Do you still hold out hope that your son is alive?” Vieira asked.

“I will until the day I die,” Young said.

On Sunday, police and divers searched the waters surrounding Sauvie Island, a small island near the Horman home, for potential clues to Kyron’s fate. It was the first time that searchers had been back on the island for about a month. A spokesperson for the local sheriff’s office told the media that the search, which turned up nothing, was not the result of any new tips or information.

Kaine Horman told reporters today that he never thought that his son Kyron was in danger around his estranged wife in the months before he disappeared.

Horman, who held a news conference at the Wall of Hope in front of Tualatin Valley Fire & Rescue station this morning, was questioned about statements made by Kyron's mother Desiree Young about emails she was shown by investigators on Friday.

Kyron Horman disappeared in early June. He was reportedly last seen at Skyline School in rural Northwest Multnomah County by his stepmother, Terri Moulton Horman. A police investigation has focused on Terri Horman in the weeks after the boy went missing.

Young, interviewed on the Today Show this morning, said the emails revealed "a severe hatred of Kyron."

In the news conference, Kaine didn't address that issue directly, but he did talk about accusations in his court files that Terri Horman had a drinking problem.

He said it wasn't until recently, after conversations with friends and family and talking to people who know about alcoholism, that he said he realized she was an alcoholic.

He said she exhibited odd behavior but he didn't know what it meant.

"I had no idea what the problem was," he said. "All of a sudden it comes right into focus."

He said "I think the alcoholism was the tip of the iceberg."

Horman said his 2-year-old daughter Kiara asks about Kyron all the time, but never asks about her mother.

Here is another apparent custody issue that imo caused the disappearance of Kyron. Why didn't dad just let the little boy go back to his mother? His new wife didn't like the child, they argued over him, mom wanted him, so why would you even want your child living somewhere he/she isn't wanted?. The kids come first folks.

In an interview with CBS Early Friday, Kaine Horman expanded on his comments from earlier this week about the case involving his missing son, Kyron Horman.

Desiree Young criticized Kaine earlier this week, saying he withheld information from her in the weeks and months prior to Kyron's disappearance.

"I personally have learned of information lately that has disappointed me in Kaine's choices in his behavior, and I can't just stand by and support the choices he's making," she told The Today Show.

Kaine was asked Friday morning if the comments surprised him.

"I wouldn't say they surprised me," he said. "This has been going on for so long, we're all just emotionally strung out."

Kaine mentioned he was handing out fliers at local businesses to keep Kyron's name alive recently, and he was amazed when people said: 'Oh, I thought he was home already.'

It's this sentiment that Kaine said, "Reaffirms that we have to keep getting it (Kyron's name) out there."

I hate to say it, but I don't know why Kaine is surprised people thought Kyron was home safe. The way they have gone about trying to keep Kyron's name out there, is precisely why a lot of people thought he had been found safe. All the articles with headlines about having birthday parties for him, joining him up for the school soccer team etc is the reason why. That was crazy and it's come back to bite them.

'Breakfast with Santa' keeps Kyron at forefront

When Terry and Patti Burns hosted a special "Breakfast with Santa" on Nov. 28 at their Loch Lolly Christmas Forest, the man in the big red suit wasn't the only star. Folks enjoyed the forest's many attractions, including a roaring fire pit, a resident gaggle of geese, and two visiting reindeer, Rudolph and Dasher. But the day's main draw was a boy who wasn't even there, Kyron Horman.


The event raised funds for the ongoing publicity efforts supporting the search for the 8-year-old boy who disappeared June 4 from Skyline Elementary School. In addition to breakfast, volunteers from the Bring Kyron Home organization sold items imprinted with his face and vital statistics. They also shared comfort with well-wishers, most of whom knew the boy only through the news. Like the visitors and their hosts at Loch Lolly, the women behind Bring Kryon Home didn't know each other or the Horman family before last summer. Cindi Massei, who manages the group's "awareness items" -- T-shirts, wrist bands and pendants, said she'd never been involved in anything like this. Previously, she'd worked with animal rescue groups, but something about Kyron's disappearance made her want to help in any way she could.

"It's surprising how personal it becomes," she said. As volunteers assisted visitors creating holiday ornaments using Kyron's photo, Massei said, "I'm in it for the long run. Events like this gives me even more hope that we will bring Kyron home."

Carol McCall Knowlton, another volunteer with the group, says events like Breakfast with Santa at Loch Lolly Christmas Forest aren't measured by the money they raise. "We consider our work a success if just one person learns that the search for Kyron has not ended," she said. "We will bring him home."

When Terry and Patti Burns hosted a special "Breakfast with Santa" on Nov. 28 at their Loch Lolly Christmas Forest, the man in the big red suit wasn't the only star. Folks enjoyed the forest's many attractions, including a roaring fire pit, a resident gaggle of geese, and two visiting reindeer, Rudolph and Dasher. But the day's main draw was a boy who wasn't even there, Kyron Horman.


The event raised funds for the ongoing publicity efforts supporting the search for the 8-year-old boy who disappeared June 4 from Skyline Elementary School. In addition to breakfast, volunteers from the Bring Kyron Home organization sold items imprinted with his face and vital statistics. They also shared comfort with well-wishers, most of whom knew the boy only through the news. Like the visitors and their hosts at Loch Lolly, the women behind Bring Kryon Home didn't know each other or the Horman family before last summer. Cindi Massei, who manages the group's "awareness items" -- T-shirts, wrist bands and pendants, said she'd never been involved in anything like this. Previously, she'd worked with animal rescue groups, but something about Kyron's disappearance made her want to help in any way she could.

"It's surprising how personal it becomes," she said. As volunteers assisted visitors creating holiday ornaments using Kyron's photo, Massei said, "I'm in it for the long run. Events like this gives me even more hope that we will bring Kyron home."

Carol McCall Knowlton, another volunteer with the group, says events like Breakfast with Santa at Loch Lolly Christmas Forest aren't measured by the money they raise. "We consider our work a success if just one person learns that the search for Kyron has not ended," she said. "We will bring him home."

It really upsets me that this is the ONLY new news.... how long are they going to keep doing this?!

I am afraid that until someone talks, we won't know until a body is found. someone needs to come forward (terri or whoever helped her) IMO

Kyron Horman Update: 6 Months Later, Parents Issue Plea for Help in Finding Missing Son


PORTLAND, Ore. (CBS/KOIN) Kaine Horman and Desiree Young, the parents of missing boy Kyron Horman, issued a plea Thursday nearly six months after Kyron went missing. PICTURES: Kyron Horman Missing, New Photos "We recognize that it has now been 6 months since Kyron went missing and we are still deeply saddened that he is not home with us," Kaine and Desiree said according to CBS affiliate KOIN. "We feel the investigation continues to move forward in a positive manner and is progressing toward finding out what happened to Kyron." Kyron disappeared after a science fair at his Portland school on June 4. Investigators have focused on Kyron's stepmother, Terri Moulton Horman, but have not arrested her or called her a suspect in the disappearance. She and the boy's father have since divorced. "We all still remain focused and relentless in the pursuit of bringing Kyron home. We would like to stress to everyone that Kyron has not yet been found and we need everyone's help," Kyron's parents concluded. Anyone with information about the case is asked to contact the Tip Line at 503-261-2847.

Sheriff forges ahead in Kyron Horman probe

The Oregon sheriff leading the search for Kyron Horman says he believes the case of the missing 7-year-old will be solved.Multnomah County Sheriff Dan Staton said in an interview with The (Portland) Oregonian that his goal was to create a break in the case before Feb. 1 when he is scheduled to brief county commissioners on the progress his task force has been making."They are a lot further along," Staton said in the interview published Sunday. "They've gradually been able to eliminate people who they can say are absolutely not involved. Ex-Sheriff’s Office Official Blasts His Former Employer On Kyron Horman Investigation

Bruce McCain, who served in the Multnomah County Sheriff’s Office for 26 years, takes a hard look at his old shop in a lengthy post today on KPAM talker Victoria Taft’s blog.In questioning the way MCSO has investigated Kyron Horman’s disappearance from Skyline Elementary on June 4, McCain, a lawyer who often shares his opinions on public safety issues with media interviewers, will no doubt offend not only some old colleagues but the devoted followers of the tragic Horman saga.McCain, who retired from the sheriff’s office as a captain, criticizes the amount of overtime some MCSO employees have earned. But his real beef is that MCSO treated Horman’s disappearance as a “search and rescue” case rather than a criminal investigation. He writes,
So why did the Sheriff’s Office respond to Kyron’s disappearance by launching a massive Search & Rescue (SAR) effort and not considering this a crime? The answer lies in the nature and history of the Multnomah County Sheriff’s Office. Today MCSO is primarily a corrections agency with typically 80% of its budget going to run the county jail system. The law enforcement component of MCSO is a relatively small component of the agency responsible for patrol and investigative services for the unincorporated areas of the county, primarily Corbett, Sauvie Island and some parts of the West Hill (sic).
McCain then delivers perhaps his strongest point:
The Portland Police Bureau (PPB) is Oregon’s largest police department with 95 budgeted detectives. At PPB, the position of detective is actually a promotional position from police officer as opposed to a rotational assignment as in many smaller agencies. Portland’s 95 detectives are more than MCSO’s total number of law enforcement sergeants and deputy sheriffs combined and dwarf’s MCSO’s detective unit of six deputies. Yet Portland’s vastly more experienced detectives have been conspicuously absent from the Kyron Horman case as MCSO tried to solve this case mostly without Portland’s help, despite the recent announcement of the cost-shifting Task Force.

This is exactly what I've been saying. I can't understand why they have refused to treat this as a possible homicide. That they haven't is no doubt the reason they don't have any 'suspects' and there have been no arrests.

The task force responsible for finding 8-year-old Kyron Horman is asking people in the Skyline School community to cross-check a list for them.

It's trying to confirm exactly who was at the school when Kyron disappeared.

So far investigators have identified 490 people who were at the Northwest Portland school between 8 a.m. and noon June 4 the day Kyron disappeared.

The school sent a letter home, along with the names of those identified. It is asking people to notify the task force if they think someone's missing from the list or wasn't there and shouldn't be on it.Below is the letter sent to members of the Skyline community. The list of names has been left off out of respect for the privacy of those people.

Below you will find a message from the Kyron Horman Investigation Task Force. As part of our ongoing effort to cooperate with law enforcement in this matter, we are forwarding it to you and asking for your cooperation.Regards,

Members of the Skyline School Community:

One of the many tasks that law enforcement has undertaken in the course of the investigation of the disappearance of Kyron Horman has been to try and determine as definitely as possible the identity of every individual who was on the Skyline School campus at any time between 8:00 am and noon on June 4, 2010. This has proved a more complex endeavor than one might think. Many sources of information have been consulted.

To date, law enforcement has identified 490 people who were present. In order to ensure, as far as is humanly possible, that this is a complete and accurate list, one of the remaining steps we feel is necessary is to share that list with you, the members of the Skyline Community, and ask you to examine it and inform us of:

1. ANY INDIVIDUAL (to include a minor child), other than a Skyline Student, who you have reason to believe was on the campus between 8-12 on June 4 but is not on this list; and
2. ANY INDIVIDUAL who is on the list but who you have reason to believe was not on campus during that time.

We realize that this entails some diminution of the privacy of those on the list. To that end we have removed the names of the Skyline students on our list. Additionally, other minor children are simply referred to as “minor child of ____” and not personally named. To others, we ask your understanding that this is a necessary step in an important criminal investigation and, in any event, would probably occur ultimately through media coverage of court proceedings.

You may respond to this inquiry in one of two ways:
a. Call the Multnomah County Sheriff’s Office tipline at (503) 261-2847 and leave a voice mail with the following information
1. Your name
2. That you are calling in response to the “Skyline School project”
3. A contact number where you can be reached
4. Information regarding any individual who should be on or off the list below
b. Send an e-mail to Skyline.Flyer@mcso.us and include the same information listed in items 1-4, above.

Your prompt response to this inquiry will assist law enforcement greatly in completing one of our many tasks. Thank you in advance for taking the time to review this list and respond.

Walgreens wrapping gifts to benefit Kyron Horman

MEDFORD, Ore. -- Getting your present topped off with a bow could help the Kyron Horman Foundation.
An employee at Walgreens is wrapping up gifts to try to help the family.
Sarah Miller works at Walgreens but she's working the Kyron wrapping booth on her days off. And thanks to Desiree Young's help, she's also selling Missing Kyron t-shirts, pins, bumper stickers and bracelets with all proceeds benefiting the search for Kyron.
Some shoppers picked up the merchandise Monday, while some just donated money.
Miller said she doesn't even know the family, she was just touched by the story and wanted to help.
"It was one of those things where I started following it on the news and I never realized how much money it was taking them to search for him and if I can do something little to help, especially around Christmas time, it's a really good time to help," Miller said.
They're just getting started, but so far they've collected more than $100.
Both Walgreens in Medford are participating in the fundraiser.If you would like to help out, they'll be wrapping and selling again next Sunday and Monday from 10 a.m. to 1 p.m
