Teen admits to killing brother's girlfriend

A Manitoba teen has admitted to killing his brother’s 14-year-old girlfriend by shoving a knife through the roof of her mouth and into her brain as she slept in their home.

The unprovoked attack occurred in December 2009 in Little Grand Rapids, a remote reserve about 300 kilometres northeast of Winnipeg. Details only emerged publicly for the first time Monday when the accused killer — who was just 12 at the time - appeared at the Manitoba Youth Centre in Winnipeg and pleaded guilty to second-degree murder.

Justice officials have now ordered a forensic assessment to determine whether he is suffering from any mental health issues. The boy has no prior criminal record and has been in custody for the past 14 months without bail. A sentencing date is expected later this spring. He faces a maximum youth sentence of four years in custody and three years of community supervision.

The teen victim can’t be named under a provision of the Youth Criminal Justice Act because her killer is also a youth. She was found dead with no visible signs of trauma and RCMP initially didn’t know they were dealing with a homicide, court was told.

It was only when the accused admitted the crime to his brother and other community residents that the scope of the investigation changed.

"He told his older brother he never liked her (the victim) and that now he’s free," a justice source told the Free Press. Police learned the boy had taken a knife and caused massive internal damage.

"Apparently it’s a common way used to kill animals, and he must have seen it done on the reserve before," said the source. "The cause of death was found to be consistent with his explanation."

Court heard the boy's brother and his 14-year-old girlfriend had been drinking "home brew" and had passed out in his room when the boy grabbed a knife from the kitchen.

"He went into the bedroom ... and he then placed the knife in the mouth of the victim and pushed down," Crown attorney Debbie Buors told court.

The boy ran off and told a number of "community members" what he had done, Buors said.


. . . . .Judge Sid Lerner reviewed the charges with the boy to make sure he was admitting to the crime as described by the Crown.

"That's just what I did," the boy said.

Given the boy's age, prosecutors cannot seek an adult sentence. Under the Youth Criminal Justice act, the maximum sentence for second-degree murder is seven years.

Buors said the Crown is considering a sentence under the intensive rehabilitation section of the YCJA that would allow for a longer period in custody.

Lerner ordered the preparation of a pre-sentence report and forensic report.

The boy remains in custody. A sentencing date has not been set.

Oxford House, home to about 1,900 people, is about 950 km northeast of Winnipeg.

The incident has shocked the isolated community of about 4,000 people.

"A lot of people are very, very angry but more so than that, they're very, very hurt," said CBC News reporter Sheila North-Wilson, who spoke with several residents.

"They say she was a very sweet girl. She loved to laugh. She loved to hang out with her friends, like any teenager would, and she loved to sing.

"She had aspirations of singing [and] would enter singing competitions and she would win most of them."

Boy, 12, jailed for killing brother's girlfriend
November 10, 2011

An Oxford House, Man., boy who murdered his brother's girlfriend when he was just 12 years old has been sentenced to seven years custody and community supervision.

The boy, now 14 years old, pleaded guilty last February to second-degree murder. His sentence is the maximum allowed under the Youth Criminal Justice Act.

The boy stabbed the 14-year-old girl in the mouth as she slept at his home on Dec. 28, 2009.

"For whatever reason, for whatever animosity he had toward (the victim), he placed a knife in her mouth and pressed down," Crown attorney Debbie Buors told a Thompson, Man., court Thursday.

An autopsy determined the girl died as the result of choking on her blood.

Court previously heard the victim and her boyfriend had been drinking "home brew" and passed out in his room.

"There is no indication she ever gained consciousness or fought back," Buors said. "She just simply succumbed to her injuries."

After the killing, the boy told his brother he was now "free" of the victim, Buors said.

Buors urged Judge Brian Colli to sentence the teen to the maximum term of four years in custody, with no credit for the nearly two years he has already served.

"He needs as much time (in custody) as the courts can work with him," Buors said. "Four years is not enough."

Colli ordered the boy serve an additional three years in custody, with the balance of the sentence served under community supervision.

"The boy showed "a hardness that I found shocking ... but he has softened up (in custody)," Colli said.

According to a pre-sentence report, the boy started drinking and smoking marijuana when he was nine years old.

The victim's parents described their daughter as a talented singer who made "everyone feel special."

"She was and always will be the light of my life," the girl's mother wrote in a victim impact statement.

The boy's mother sobbed in court and blamed herself for the killing.

"We loved her too," she said. "Maybe if I had been there instead of drinking somewhere else ... I wish every day I could be there for them."

Colli said substance abuse is a "crippling condition" in Oxford House and urged adults in the community to give up drink and drugs.

"As long as there is substance abuse ... there will be crime, anger and hatred in the community," he said. "It's the gift that keeps giving."

Oxford House, home to about 1,900 people, is 950 km northeast of Winnipeg.
