A long-term substitute teacher in the Niagara Falls school system is
accused of raping a 14-year-old student whom he was tutoring, police
said Friday.John T. Summerson, 24, of 76th Street, faces felony
charges of second-degree rape and endangering the welfare of a child,
said Niagara Falls police Capt. William M. Thomson, chief of detectives.
Summerson has been removed from his job with the district."It's
our understanding he has been suspended from his job as a substitute
teacher at the Niagara Street Elementary School," Thomson said. "He does
private tutoring work on the side, which was how he met the victim.
"There have been no allegations that Summerson molested any other students, police said.
Summerson is accused of having consensual sex with the 14-year-old girl after
tutoring her for several months. Under state law, any sex with a
14-year-old is illegal, Thomson said.The alleged rape came to the
attention of police after patrol officers were called to quell a
disturbance at a Tim Hortons restaurant late on the night of May 2.Officers
arrived at the restaurant -- on Niagara Falls Boulevard near Military
Road -- and found Summerson on the floor, with the girl's father on top
of him."This guy raped my daughter!" officers quoted the father as telling police.The
incident led to intense questioning of Summerson, the girl's father and
the girl -- who also was in the restaurant that night -- and Summerson
was arrested early the next morning, Thomson said.While Summerson
was assigned on a regular basis as a substitute teacher at Niagara
Street Elementary School, the victim attends another Niagara Falls
school, police said.Technically, it would be incorrect to say
that Summerson was "suspended" or "terminated" from his job, said Angelo
Massaro, attorney for the school system."We would just say that,
as a result of this incident, he is no longer assigned to the school,"
Massaro told The Buffalo News. "His services are no longer required ...
With a substitute teacher, you just don't call them anymore to come in
and teach."The alleged rape took place away from school property and
was not during school hours, Massaro and police said.Massaro
added that the tutoring job was by private arrangement between
Summerson and the girl's family and "was not school-sponsored tutoring.""We've
never had complaints about [Summerson's] conduct before," Massaro said.
"It's an unfortunate incident. We have to await the outcome of the case
without prejudging it in any way."Massaro said he believes Summerson has
worked as a substitute for the district for at least a year.Repeated
efforts to reach Summerson's attorney, James J. Faso Jr., were
unsuccessful Friday. An employee in Faso's office said he was busy in
court on another case.Summerson was released on $2,500 bail after arraignment
and is due back in City Court for a preliminary hearing June 7.Police said they
filed no charges against the alleged victim's father in connection with the
altercation at Tim Hortons.Guidance counselors from the Niagara Falls schools are assisting the girl, Massaro said.
