Fairbanks toddler dies of injuries from alleged beating
Mother's boyfriend arrested; DA to decide on upgrading charges.
April 20th, 2012 10:52 PM
FAIRBANKS -- A 2-year-old Fairbanks boy died two days after he was thrown by his mother's boyfriend and knocked unconscious for wetting the bed,
authorities said.
he child was taken to Fairbanks Memorial Hospital on Tuesday, then placed in a pediatric intensive care unit in Anchorage, where he died Thursday, the Fairbanks Daily News-Miner reported.
Carl Delbert David Jr. was arraigned earlier Thursday on a first-degree felony assault charge and remained in Fairbanks Correctional Center on a no-bail hold. He did not enter a plea.
A decision on whether to upgrade the charges after the boy's death will be made by the district attorney's office.
A criminal complaint said David threw his girlfriend's child onto a bed, where the boy bounced and hit his head on the floor. David, 24, also is accused of stepping on the boy's groin, authorities said. An autopsy is planned.
The boy sustained a fractured skull, broken neck and internal injuries, according to authorities, who said he was knocked unconscious. David told police he then stepped on the boy's groin area because he was angry that the boy had urinated in the bed, according to the complaint. The boy was not wearing a diaper,
authorities said.
The boy remained unconscious for about an hour but David said he did not call 911 or seek help even though he knew the child was not breathing right, authorities said.
David said he held the boy until his mother returned to their apartment and put the toddler in a baby stroller and pushed him to nearby Fairbanks Memorial Hospital, authorities said.
Emergency room workers notified police about the case.
A preliminary hearing for David has been set for April 27.

Another POS boyfriend. Another POS mother.
She knew this man was abusive to her baby yet she still left him alone with her precious baby.
Why do these women keep dragging scum into their beds and allowing their children to be beaten, tortured and eventually murdered?
Big deal, she took the dying baby to the hospital. WTH didn't she call 911?
He didn't step on the baby's groin. The internal injuries indicate he stomped on his groin.
He should be beaten within an inch of his life then sent to prison.

FAIRBANKS - A man accused of fatally assaulting his girlfriend’s
2-year-old boy has been charged with first-degree murder, according to
the Alaska Court System Website.
Carl Delbert David Jr., 24, was
previously charged with first-degree assault for allegedly throwing the
boy on the bed and stepping on him last week because the boy urinated in
his bed.
The charge was upgraded to first-degree murder Friday
afternoon. In Alaska, juries use a different legal definition of
first-degree murder for adult victims and for child victims under 16
years old. To convict David of first-degree murder, a jury would have to
find he fatally injured the boy in two separate acts of “criminal
negligence.”
The boy suffered a fractured skull with internal
brain bleeding, a broken neck and other injuries, according to the
criminal complaint against David. The boy died April 19 at Providence
Hospital in Anchorage
David is being held at Fairbanks Correctional Center without bail.
David
is accused of throwing the boy onto a child’s bed and the boy bounced
off the bed and hit his head on the floor, according to a criminal
complaint filed in court.
The toddler was flown to Providence
Medical Center in Anchorage where he remained in critical condition
before he died, according to charging documents.
The boy was
knocked unconscious when his head hit the floor. David told Alaska State
Troopers he then stepped on the boy’s genitals and groin area with the
heel of his foot because he was mad the boy had wet the bed.
The
boy remained unconscious for approximately one hour, but David told
troopers he did not call 911 or seek any help even though he knew the
boy was not breathing right. Instead, David said he held the boy until
his mother returned to their 15th Avenue apartment and pushed him to
nearby Fairbanks Memorial Hospital in a baby stroller.
Fairbanks police were notified by emergency room personnel and interviewed the boy’s mother at the hospital.
The
woman told police she returned home from running errands to find her
unconscious son with David, who told her that he had become upset at the
boy for trying to clean up the “poop” from another child and had thrown
the boy on a bed. He reportedly said the boy bounced off the bed and
hit his head.
Police went to the apartment and took David into custody.
In
an interview with police, David said he was home alone with the boy and
that the boy wet the bed while taking a nap. David told police he
became upset because the boy had already ruined several pairs of
underwear. The boy was not wearing a diaper, according to police.
David
said he slapped the boy several times on the face while the boy was
seated on a small potty chair before stripping his clothes off and
putting him in the bath tub to clean him off. He told police he grabbed
the boy by the chest to remove him from the tub and then grabbed the boy
by the right arm and right leg and threw him on the bed. The boy
bounced off the bed and hit his head on the floor, David told police.
The
boy was on his left side, unconscious, when David said he pushed him on
his back with his foot. He reportedly admitted to then stepping on the
boy’s genitals and groin with the heel of his foot.
At some
point, David realized the boy was unconscious and not breathing
correctly, so he held him until the boy’s mother returned home.
Detectives
showed David photos of the boy’s injuries that were taken at the
hospital and David admitted to causing the injuries depicted in the
photos, police wrote in the complaint. David admitted he had been
excessive in his discipline of the boy.
David has convictions for
criminal mischief, criminal trespass and disorderly conduct on his
record. A preliminary hearing for David was set for April 27.
