Mistrial declared in Arias case

William Pitts, 12 News 10:24 a.m. MST
March 5, 2015

For the second time, a jury has been unable to decide whether convicted murderer Jodi Arias will be executed or spend the rest of her life in prison.

The sentencing for Arias will take place April 13th at 8:30 a.m. in Superior Court.

The jury told Judge Sherry Stephens members were unable to resolve an impasse, and the sentencing decision now passes to the judge. By law, it's now up to Stephens to decide whether Arias will face life in prison with or without the possibility of parole after 25 years.

The second jury in the high-profile case was selected to decide on Arias' penalty after a first jury convicted her of the murder of Travis Alexander but failed to reach a decision on the penalty. The jury got the case shortly before noon on Wednesday, Feb. 25.

Outside Superior Court, an emotional Tanisha Sorensen, the sister of Travis Alexander, told reporters, "The real justice will be in the afterlife when Jodi burns in hell."

Crying and sobbing could be heard after the judge announced her decision from the bench.

The jury was composed of eight women and four men. The jury deliberated for about 26.5 hours over five days by our count. 12 News has a crew on the scene at the courthouse; follow @12news on Twitter for what they're seeing.

The sentencing retrial began about four months ago after the jury in Arias' first trial failed to agree on the penalty. This second panel got the case shortly before noon on Wednesday, Feb. 25, after closing arguments wrapped up.

Arias, 34, was previously convicted of first-degree murder in the killing of her boyfriend, Travis Alexander. Alexander was stabbed 27 times, his throat was slashed and he was shot once in the head. His decomposing body was found days later in the shower of his Mesa home.

The first jury was unable to reach a decision regarding punishment and a second jury was impaneled to decide if Arias should receive the death penalty.

In the first days, Alexander's family gave tearful victim impact statements before the jury.

"He wanted a loving wife and a bunch of children," Alexander's sister Tanisha Sorenson told the jury. "Travis doesn't get to have that wife. He doesn't get to have those children."

Alexander's brother Stephan Alexander told the jury he has recurring nightmares of Travis's death.

"At night when I lay down, all I can think about is my brother's murder," Stephan said. "Stab after stab. Him grabbing the blade of the knife trying to fight for his life."

Defense attorneys called numerous psychologists to testify that Arias was mentally ill. They maintain she has borderline personality disorder and post-traumatic stress disorder as a result of what they called her abusive relationship with Alexander.

"This relationship came to a very tragic end, on June 4, 2008," defense attorney Kirk Nurmi told the retrial jury in opening statements. "More than anything, the tale of this relationship is a tale of infinite sadness."

Prosecutors countered by accusing Arias of fabricating that abuse for her own gain. Martinez pointed to Arias's diaries, which make no mention of any abuse. Martinez painted Arias as an obsessive lover who planned Alexander's murder and attempted to cover her tracks with a false alibi.

During opening statements, prosecutor Juan Martinez showed the jury graphic autopsy and crime scene photos of Alexander's body.

"Oh she loved him so much," Martinez said, "[that she] took his body, dragged it down a hallway, and stuffed it into the shower. That's the love that she had for this individual."

The Arias trial has been going on since 2013 and county officials have refused to say how much it has cost taxpayers. A few months into the trial, the Maricopa County Attorney's Office estimated the cost at $2.5 million.

Saddened by the Jury's Inability to Reach an Appropriate Decision on the Death Penalty, Travis Alexander's siblings have released the following statement through a spokesman:

Travis Alexander's surviving brothers and sisters; Gary Alexander, Dennis "Greg" Alexander, Tanisha Sorenson, Samantha Alexander, Hillary Wilcox, Steven Alexander, and Allie Iglesias are saddened by the jury's inability to reach a decision on the death penalty. However, they understand the difficulty of the decision, and have nothing but respect for the jury's time. They appreciate Deputy County Attorney Juan Martinez and Detective Steve Flores for their hard work and professionalism in this case. The siblings also appreciate the outpouring of support they have received from the public. Without the public's support, it would have been impossible for the family to attend trial over the past many years while the case worked its way through the justice system.

The siblings request that their privacy be respected. They will not be making any further statements or participate in any interviews at this time.

“Jodi Arias has been in our jail for seven years. A comprehensive report of the history of her behaviors and activities while in our custody is in progress. Upon reviewing the report it notes that she craves media attention and continues to seek out ways to attract that attention. I will not allow her to play that game and will deny any media interviews with her. Arias is a convicted killer, and her 15 minutes of fame are over.”

Jurors in Jodi Arias Case Were 11-1 for Death Penalty

PHOENIX — Mar 5, 2015, 10:44 PM ET
By JACQUES BILLEAUD and TERRY TANG, Associated Press

It took just one juror to spare the life of convicted murderer Jodi Arias on Thursday — and the woman had to survive an attempt by her colleagues to boot her from the jury before she could do it.

In the end, the jury voted 11-1 in favor of death — not enough to send Arias to death row in the case that became a global sensation with its tawdry revelations about her sexual relationship with the victim and that she had slit his throat so deeply that he was nearly decapitated.

The deadlock took the death penalty off the table and left a judge to decide whether to sentence Arias to life in prison or to life with the possibility of release after 25 years. That decision is expected at an April 13 hearing.

Arias was convicted in 2013 of killing her lover, Travis Alexander, but that jury also deadlocked on her punishment, prompting the sentencing retrial that began in October.

The holdout juror did not speak to the media on Thursday. But other jurors said they thought Arias lacked remorse and that her attorneys had presented an inaccurate portrait Alexander.

The jurors did not elaborate but during the trial, defense lawyers said Alexander had used Arias to quench his sexual urges, called her demeaning names and told her she was soulless.

Most of the jurors said they believed the holdout was biased and opposed to giving the death penalty. The other jurors asked the judge on Tuesday if the woman could be replaced with an alternate, but the request was denied and jury was told to keep deliberating.

One male juror said Thursday that he became angry when the holdout indicated the death penalty would be a form of revenge. Jurors also note that the woman had acknowledged seeing a cable TV movie about the Arias case.

Jurors apologized to the Alexander family for the deadlock and said they felt Arias was trying to manipulate the jury.

None of the jurors would give their names. The identities of jurors are kept secret in Arizona.

The jury deliberated for about 26 hours over five days. They said they started with about half of the members voting for the death penalty, eventually reached the 11-1 vote then got stuck.

They described having knots in their stomachs and problems sleeping at night during the trial.

Arias will begin serving her sentence in a 12-by-7 foot cell in a maximum-security unit at the Perryville prison for women, west of downtown Phoenix.

If officials deem her behavior is good over time, she could be moved to a medium security unit.

Nearly $3 million of taxpayer money was spent during both trials. Arias' court-appointed attorneys billed the state for $2.7 million. Prosecutors say they spent more than $132,000 on expert witnesses, transcripts, travel expense and other costs, though that figure doesn't include the salary of the prosecutor.

Prosecutors said they don't regret trying again to send Arias to death row.

"Regret is a place in the past I can't afford to live in," Maricopa County Attorney Bill Montgomery said.

Alexander's family members wept when the judge announced the deadlock. His brothers and sisters said in a statement that they "are saddened by the jury's inability to reach a decision on the death penalty, however, we understand the difficulty of the decision, and have nothing but respect for the jury's time."

Defense attorney Kirk Nurmi said the killing was a tragedy and "no verdict ultimately could repair that sadness."

Prosecutors say Arias killed Alexander as revenge because he wanted to date other women and was planning a trip to Mexico with his latest love interest.

Authorities said Arias shot him in the head and stabbed and slashed him nearly 30 times then left his body in his shower at his suburban Phoenix home, where friends found him about five days later.

During closing arguments in the penalty retrial, prosecutor Juan Martinez repeatedly showed jurors gruesome crime scene photos of the victim's slit throat.

The images were a counterpoint to the happy photos of Arias that her attorney displayed in arguing there was more to her life than her actions in the killing.

Nurmi told jurors that Arias deserved a second chance because she was the victim of verbal and physical abuse throughout her life.

Arias initially courted the spotlight after her arrest, granting interviews to "48 Hours" and "Inside Edition."

She testified for 18 days at her first trial, describing her abusive childhood, cheating boyfriends, relationship with Alexander and her contention that he was physically abusive.

Authorities provide security for juror in Jodi Arias case
Authorities were providing security Friday for the sole juror who voted to spare the life of convicted murderer Jodi Arias.

AP
11:10 a.m. EST March 7, 2015

PHOENIX (AP) — Authorities were providing security Friday for the sole juror who voted to spare the life of convicted murderer Jodi Arias.

No threats had been reported against any of the 12 jurors, authorities said. However, the lone holdout on the death penalty had requested the security after her name was posted on social media.

Prosecutors also said they're examining whether the holdout disclosed that her husband had been prosecuted by the same county attorney who headed the case against Arias.

The 2013 trial of Arias became a global sensation with its revelations about her sexual relationship with the victim and that she had slit his throat so deeply that he was nearly decapitated.

She was convicted of murder but that jury deadlocked on her punishment.

Prosecutors say Arias killed Travis Alexander as revenge because he wanted to date other women and was planning a trip to Mexico with his latest love interest.

The name of the holdout juror in the sentencing retrial was leaked through a Twitter account that also posted sympathetic comments about Arias' victim. The juror could not be reached for comment.

Meanwhile, a pro-Arias website published names of 11 people it said were the jurors who voted to sentence Arias to death for the 2008 killing.

A mistrial was declared Thursday and a judge will sentence Arias on April 13 to life in prison or life with the possibility of parole after 25 years.

Arizona law prohibits the public release of juror names. It's unknown how the identities were leaked, but information appeared online after jurors who favored the death penalty expressed frustrations over the holdout.

Juror Emily Cova said she was relieved to hear that authorities were looking into the leak.

"I was a little nervous last night. But I'm feeling better now," said Cova, who agreed to be named.

Aaron Nash, a spokesman for the clerk of Maricopa County Superior Court, said no member of the clerk's staff reported being approached by anyone seeking the names of jurors.

"The office's primary concerns are the safety and privacy of these individuals who responded to this difficult and lengthy call to public service," Nash said in a statement.

Most of the jurors discussed their deliberations with the media on Thursday. However, the holdout hasn't publicly commented.

Her phone wasn't in service. She didn't return emails seeking comment. And no one answered the door when a reporter knocked on the door to her home Friday.

Officials at Maricopa County Superior Court didn't immediately return messages seeking comment.

Arias will remain in the Estrella Jail in west Phoenix as she testifies in a civil case. Further information on the matter wasn't immediately available.

Once her testimony is complete, Arias will be sent to prison.

She'll begin her sentence in a 12-by-7 foot cell in a maximum-security unit at the Perryville prison for women, located 30 miles west of downtown Phoenix. If prison officials deem her behavior good over time, she could be moved to a medium security unit.

So, if she held back information, I don't think that will change Arias' fate at all.   If anything, won't the juror just be charged for perjury or contempt of court?   I feel for those eleven jurors who made a tough decision representing the state.

That one juror could think that all those stabbings, one shooting, and a slit throat nearly decapitating a man was good for life in prison makes me think she didn't fully understand the horror of the case or maybe she actually did have a vendetta against the prosecutor.

I read somewhere that Jodi wanted to hug that one juror.   Sounds like something someone should arrange for Jodi.   Just let the one condition of the hug provide her with a knife and gun.   Let's see how eager that one juror is to hug her with those items in the room!!!   Maybe not so much.... Mad

Jodi's "I WANT the death penalty" cry was just a bluff.

All, IMHO.
