Hawai’i Police Department detectives are investigating the
circumstances surrounding the death of a 5-year-old girl identified as
Javieanna Win.
Sunday afternoon (September 6) at 3:06 p.m., Fire/Rescue personnel
were summoned to an apartment at 120 Pu’ueo Street in the Wainaku area
of Hilo to a report of a young child found, by a caregiver,
unresponsive in a filled bathtub within the family’s apartment. Medics
took the victim to Hilo Medical Center, where she was pronounced dead
at 4:28 p.m.
Injuries on the child appeared suspicious. Adding to the highly
suspicious circumstances was a report police received less than an hour
prior to the reported drowning. At 2:24 p.m. police received a call
from a concerned citizen who reported witnessing a man grab a little
girl by the hair and slam her against a cement wall on the corner of
Shipman Street and Kamehameha Avenue.
The ensuing investigation lead to
the arrest of 30-year-old Anthony Serges Poulin, Javieanna Win’s
caregiver and caller of the reported drowning. He was arrested for
abuse of a family/household member but has not been charged. He remains
in police custody at the Hilo cellblock as detectives continue their
investigation.
The investigation into the child’s death is currently classified as
a coroner’s inquest. An autopsy is scheduled for Tuesday morning to
determine the exact cause of death.

A Big Island man has been charged in the sex assault and drowning of a 5-year-old girl.
Anthony S. Poulin, 30, was scheduled to be arraigned today in South Hilo District Court.
Poulin was being held in the police cellblock in Hilo in lieu of $1 million bail.
Poulin, who is disabled and uses a cane to walk, was charged with second-degree
murder, two counts of first-degree sexual assault and one count of
abuse of a family/household member.
He was supposed to have been taking care of his girlfriend's daughter,
Javienna Win, while his girlfriend was working, police said.
Poulin had lived at an apartment complex in Hilo with the woman and girl for at least several months, police said.
Police Capt. Randall Medeiros said Poulin is accused of drowning the girl in the apartment's bathtub Sunday. Medeiros said an autopsy found Win died of asphyxiation due to forceful submersion.
Poulinhad no criminal record other than a conviction for violating a
temporary restraining order held by another girlfriend, Medeiros said.

entire time.Numerous family members and neighbors of Win, a
first-grader at Chiefess Kapiolani Elementary School, were at the

In reviewing surveillance videos from
September 6, detectives observed a
small sports-utility vehicle turning
right from Shipman Street onto Kamehameha
Avenue. Detectives believe the occupants
of the SUV may have seen little Javieanne
Win near the building on the Hamakua
side of Shipman Street.
Detectives say they also observed
a male walking from Shipman Street
on the sidewalk toward Waianuenue
Avenue. Detectives believe the man
may have seen Win or the suspect,
Anthony Poulin, while walking down
Shipman Street.
The surveillance videos of Kamehameha
Avenue between Shipman Street and
Waianuenue Avenue were taken at 2:13
p.m. on September 6.
Detectives believe the SUV is a Toyota
RAV 4 with surf racks. It appears
to be red or maroon.
The pedestrian is described as a Caucasian
male wearing a light T-shirt and a
backpack with black straps.

Hearing set for Hilo man accused of murdering girl

A hearing has been set to determine if a man accused of raping and
killing his live-in girlfriend's 5-year-old daughter during the Labor
Day holiday weekend is fit to stand trial.
Hilo Circuit Judge Glenn Hara has ordered 30-year-old Anthony Serges Poulin to appear Feb. 19 at 10 a.m.
A psychiatrist and two psychologists have filed written reports with the
court finding Poulin fit to proceed. The hearing on those reports was
requested by Poulin's court-appointed attorney, Stanton Oshiro.
Poulin is accused of sexually assaulting and then drowning Javieanne Win in
the bathtub of a Wainaku apartment on Sept. 5. Win, a first-grader at
Chiefess Kapiolani Elementary School, was in Poulin's care while her
mother, Jennifer Abiley, was at work.
Poulin has pleaded not guilty to charges of second-degree murder,
abuse of a family/household member and two counts of first-degree
sexual assault. He remains in custody in Hawaii Community Correctional Center,
unable to post $1 million bail.

Hilo Circuit Judge Glenn Hara has ordered 30-year-old Anthony Serges Poulin to appear Feb. 19 at 10 a.m.
A psychiatrist and two psychologists have filed written reports with the
court finding Poulin fit to proceed. The hearing on those reports was
requested by Poulin's court-appointed attorney, Stanton Oshiro.
Poulin is accused of sexually assaulting and then drowning Javieanne Win in
the bathtub of a Wainaku apartment on Sept. 5. Win, a first-grader at
Chiefess Kapiolani Elementary School, was in Poulin's care while her
mother, Jennifer Abiley, was at work.
Poulin has pleaded not guilty to charges of second-degree murder,
abuse of a family/household member and two counts of first-degree
sexual assault. He remains in custody in Hawaii Community Correctional Center,
unable to post $1 million bail.

A man accused of raping and killing his girlfriend's 5-year-old daughter has been found fit to stand trial.
Hilo Circuit Judge Glenn Hara on Thursday set a trial date of Aug. 9 for Anthony Serges Poulin. The 30-year-old Poulin is charged with second-degree murder, two counts of first-degree sex assault, and abuse of a family/household member for the brutal slaying of Javieanne Win on Labor Day weekend.
The body of Win, a first-grader at Chiefess Kapiolani Elementary School, was found Sept. 5 in the bathtub of the Wainaku apartment Poulin shared with Win's mother, Jennifer Abiley. An autopsy found the girl had been sexually assaulted and drowned.
About a dozen of Win's family members, including Abiley, were in court as a psychiatrist and two psychologists testified that Poulin has the capacity to understand court proceedings and to assist in his own trial.
"This is a gentleman who has an associate's degree with an average IQ," Dennis Donovan, a state Department of Health psychologist, said in response to a question by Poulin's court-appointed attorney, Stanton Oshiro. "... My sense is that he was willing to look at any options that you laid out as to what's best for him."
Donovan said he believes Poulin "could handle the stress of a trial."
Poulin, who's in custody in lieu of $1 million bail, was transferred from Hawai'i Community Correctional Center to O'ahu Community Correctional Center after going on a hunger strike. According to Oshiro, Poulin has been assaulted twice in the O'ahu jail and has since complained of "significant memory loss."
Another psychologist, Walter Jaeckle, said that he was initially concerned about Poulin's hunger strike, but discounted his allegations of diminished recall.
"Complaints are often exaggerated and magnified, and there's a long history of attempting to get reimbursement for things like that. Seems to be a bit of a pattern."
The prosecution didn't question any of the three mental health professionals.
"They all said that he would be able to understand the nature of charges in the proceedings against him, he's able to assist in his own defense, and he's able to communicate with his defense counsel," Deputy Prosecutor Kanani Laubach told the judge.
Oshiro argued that circumstances warrant a second round of examinations.
"Events have occurred that call into question the validity of the original conclusions relative to the issue of fitness to proceed, ... specifically, his ability to recall and relate specific information to counsel, and, if and when this matter proceeds to trial, and if Mr. Poulin chooses to testify, to a jury," he said.
Laubach and Oshiro both estimated the trial would take about six weeks.

Thirty-one year old Anthony Poulin, who is accused of raping and drowning his girlfriend’s 5-year-old daughter, tells the “Hawaii Tribune-Herald” that he didn’t commit the crime. In a letter to the Hilo newspaper, Poulin called himself “an innocent man who lost his daughter & have never done any of the things I am charged with.” Poulin faces charges of murder, sexual abuse, and abuse of a family household member in the September 6th, 2009 death of Javieanne Win. Poulin’s trial has been delayed because the prosecutor in the case is on maternity leave.

The Hawaii Tribune-Herald reported today that 32-year-old Anthony Poulin pleaded guilty to second-degree murder in the death of Javieanne Winn.
In exchange for the plea, prosecutors dropped two counts of first-degree sexual assault and a domestic abuse charge. Poulin was accused of raping and killing the first-grader in September 2009.
In court, Poulin said he was accepting the plea deal but he doesn't believe he's guilty. He wrote a letter to the newspaper saying he saw someone unfamiliar in front of the apartment before he found the girl floating face down in the tub.
He is expected to be sentenced Nov. 1.

There's still a chance Anthony Poulin will be back on the streets someday. The life sentence comes with the possibility of parole.
But Circuit Judge Glenn Hara did order Poulin to serve a mandatory minimum of 15 years because his victim was under the age of eight.
Fully shackled and wearing an orange prison jumpsuit, the convicted child killer did not make any new statements at sentencing. He earlier pleaded guilty to second-degree murder in the death of his girlfriend's five-year-old daughter, Javieanne Win.
