CADENCE GARDNER - 4 Months - Xenia (SE of Dayton) OH
The Greene County Coroner has identified the child who was found unresponsive inside a Xenia
Township home on Wednesday night.
The child was identified as 4-month-old Cadence Gardner.
The coroner and the GreeneCounty sheriff's office are not saying much about the child's death as
they are still collecting evidence.
Two calls were made from the house on East Spring Valley-Paintersville Road. One of them was from
the child's mother and the other was from the child's grandmother.
The child's mother cried as she told dispatchers that she feared her baby suffocated in her sleep.
The infant's grandmother said the child was not breathing and had foam coming from
her mouth an blood coming from her nose.
Dispatchers helped the grandmother perform CPR.
The infant was rushed to Greene Memorial Hospital, but
did not survive. Detectives spend hours at the home taking pictures and collecting evidence.
Officers are only saying that the child's death was unexpected and unexplained.
After an autopsy, investigators they have not been able
to determine how the child died. Officials are waiting on the results of toxicology tests.

Infant death ruled accidental, no decision on charges
XENIA — The death of a 4-month-old Caesarcreek Twp. girl was ruled accidental, according to the Greene County Coroner’s Office.
Cadence Gardner died due to asphyxia, said Claude Lyons, an office administrator at the coroner’s office. Lyons said Gardner’s bedding was up over her head on a day that was hotter than 90 degrees and it was hot in the house.
Gardner was pronounced dead June 2 at Greene Memorial Hospital after being transported from a home on Spring Valley-Paintersville Road.
Police sought and obtained a search warrant in their investigation which showed that police had reason to believe that endangering children and/or permitting child abuse may have occurred.
Greene County Prosecutor Stephen K. Haller said no decision had been made regarding criminal charges as of Wednesday, July 28.

Thanks for the update WOA! We appreciate the assistance.
Based on the last line of the article, it would seem that as of 45 days ago there was still some consideration of negligence charges.
I would like to leave this topic here for the time being until we can determine if there has been any resolution by Mr. Haller.

A month before Merriweather’s death, 4-month-old Cadence Gardner of Caesarcreek Twp. in Greene County died from asphyxia when covers were over her head on a 90-degree day and the house was hot.
The coroner ruled the Gardner death accidental and that case was not prosecuted because Haller told detectives there was “no criminal culpability as it relates to the caretaker.”
