MINDEN — The Nebraska Court of Appeals has denied an appeal request
from one of the men sentenced in the Landon Payne abuse case.

The court held up the sentence of Charles Turnell, 39,
who received 19 to 20 years in prison after being convicted of felony
attempted child abuse resulting in serious bodily injury in September.

The other two involved in the case – Sharon Turnell, 38,
and Dustin Scoville, 24 – have also appealed, but their sentences have
not been reviewed by the court.

Sharon Turnell and Scoville each were convicted of felony
attempted child abuse resulting in Landon Payne's death and sentenced
to 49 to 50 years in prison.

Payne, 4, died Dec. 22, 2009, from severe blunt force
trauma to the head after being transported to Good Samaritan Hospital in Kearney.

Scoville and the Turnells claimed Payne received his wounds when he fell from a bunk bed.

It was later revealed Payne suffered long-term abuse while living in the Turnell household.
