Monday started as the week ended. With no testimony. Dr. William Rodriguez would not be testifying (and it would take until Saturday for us to learn why) and Mr. Richard Eikelenboom would be unable to take the stand on Monday because, once again, the defense had met with an expert witness, asked them to formulate an opinion on a new subject, had not informed the State and the necessity for a second deposition by the State was in order.

On Tuesday we picked up where we left off on Monday with the State bringing up yet more discovery violations concerning Mr. Eikelenboom because in the deposition that had been conducted on Monday it was revealed he had opinions on new issues that the defense had not informed the State about. (Eikelenboom formulated this new opinions on Saturday while at lunch with Jose Baez.) The Judge agreed to formulate an instruction to be read to the jury that informed them of the discovery violation and that they could use that information in forming their opinions as to the credibility of the witness’s testimony.
