Casey Anthony: Jose Baez blasts probation order as flawed

In an exclusive interview with “Today” this morning, Jose Baez said a judge’s order was flawed in demanding that Casey Anthony start probation for check fraud.

“The order says that I was in court on Monday,” Baez told NBC’s Matt Lauer. “I wasn’t even in the state. Neither was my client. So the whole thing is very confusing. We’re certainly trying our best to clarify it. And we want to take the proper legal steps to do so.”

Anthony’s attorneys filed a motion late Tuesday for an emergency hearing to quash Judge Stan Strickland’s amended order that Anthony must begin probation for check fraud. She is under a deadline to report in today.

Defense attorney Cheney Mason has said that Anthony won’t return to Florida today. Baez said the defense team is seeking a hearing immediately on the issue.

“The last thing we want to do is put Casey in harm’s way,” Baez said.

Baez said the defense team is fighting for Anthony’s safety after she was acquitted July 5 of first-degree murder in the death of her daughter, Caylee. Baez said Anthony’s safety would be put in jeopardy if she returns to Florida.

“We’ve very concerned,” Baez said. “Orange County should also be concerned if they’re going to require her to come back. That’s going to require additional security.”

Baez declined to detail discussions with Anthony about the probation issue. “She is aware of the situation,” he simply said. He also said Anthony had completed the terms of probation for check fraud and that Judge Strickland had had 60 days to correct his order but failed to do so.

Of the probation controversy, Baez said: “It’s a bad situation. This thing is over and done. For some reason, things seem to keep coming up for no apparent reason … other than let’s just keep this thing going, let’s just keep this madness going.”
