Cause of death of 7-month-old revealed, bail set for dad

UPDATE: Court documents show that the 7-month-old baby allegedly killed by his father yesterday died from severe abusive head trauma, described as a non-accidental injury.
Bail for Lee Ross Barbone was set at 1 million dollars on Tuesday at the initial hearing. Barbone is charged with first degree murder in the death of his son, Richard Barbone.
POCATELLO — Richard Lee Barbone was born about 16 weeks premature last fall, spending the first four months of his life in a Salt Lake City hospital, fighting to survive.
On Monday, Lee Ross Barbone, his father, was charged with first-degree murder, accused of killing the infant child.
Richard was reportedly unresponsive when he was brought to Portneuf Medical Center at 7:20 a.m., police said in a news release. Barbone was arrested a short time later.
Police will be furnishing further details today.
Barbone, his girlfriend and the infant had lived together in the Sunny Creek Courts trailer park until recently. Court documents show the girlfriend moved out in early April.
Neighbors in the trailer park, Lori Field and Heather Orth, said they saw the three together at the trailer late last week.
They said the girlfriend swore to them she would never bring Barbone back.

Murder Suspect in Court; Victim's Mother Has Outburst

The Pocatello man facing first degree murder charges in the death of his 7-month-old son made another brief appearance in court Wednesday morning.

Lee Ross Barbone, 19, had a preliminary hearing scheduled for Wednesday, but the proceedings ended shortly after they began. Barbone's defense attorney asked Judge David Evans for a two week continuance because he needs more time to prepare his client.

Judge Evans granted that extension and a preliminary hearing in magistrate court was set for August 24th.

Also in the courtroom Wednesday morning was the mother of the 7-month-old infant that Barbone is charged with killing. While shuffling out of the proceedings, the mother burst out using several expletives to accuse Barbone of killing her baby.

Court records indicate that the19-year-old father admitted to hitting the child back in May when the infant would not go to sleep. An autopsy of the 7-month-old showed that he died as a result of multiple head injuries.

Police reports indicate Barbone took the child to Portneuf Medical Center where he was unresponsive and efforts to save him were unsuccessful.

Barbone remains in custody with a $1 million bond. He is facing first degree murder charges because the child was under the age of 12.

Attorney: Plea reached in death of infant

POCATELLO, Idaho (AP) — Attorneys say a Pocatello man charged with first-degree murder in the beating death of his infant son has reached a plea agreement with prosecutors.

Defense attorney David Martinez told 6th District Magistrate David Evans on Wednesday that his client, Lee Ross Barbone, was prepared to plead guilty at a future court date. Martinez said that in exchange for Barbone's plea, prosecutors have agreed to recommend that he be sentenced to between 10 years and life in prison.

Court records say 7-month-old Richard Lee Barbone died of abusive head trauma in May. The 19-year-old Barbone was arrested on May 16.

POCATELLO, Idaho (AP) — A Pocatello man charged with first-degree murder in the beating death of his 7-month-old son has pleaded not guilty in 6th District Court.

Lee Ross Barbone was arrested in May after police said he brought his baby, Richard Valentino Barbone, to a local emergency room. According to court documents, the child wasn't breathing and an autopsy determined the child died from severe abusive head trauma.

The Idaho State Journal (http://bit.ly/nnqo0h ) reports that Barbone entered the plea before Judge Robert Naftz on Tuesday. His next court date is set for Oct. 3, when he is expected to either bring a plea agreement to the court or have a trial date set.

POCATELLO -- A 19-year-old Pocatello man has been sentenced to at least 10 years in prison for the death of his 7-month-old son.
Lee Ross Barbone was sentenced Wednesday to 10 years to life in prison for the death of his son, Richard, in May. An autopsy found the baby died of abusive head trauma.
Barbone pleaded guilty to first-degree murder last month.
Barbone told the judge he was intoxicated and did not intend to hurt the baby, but he took responsibility for what he did.
