KBI denies AMBER alert; Still seeks assistance in locating missing baby

The Kansas Bureau of Investigation is asking for help to find 1- year- old Lana Bailey. Her mother, Kaylie, was identified as one of the bodies found in a rural Ottawa barn.

The 18- month- old toddler is 2 feet tall weighs 30 lbs with light brown hair and blue eyes. She was last seen on May 1st in Olathe on her way to rural Franklin county with her mother in a black 2007 Toyota 4 door Corolla bearing Kansas Tag 618DAA, with a tag on front saying ‘Shawna’s toy’ and duct tape on passenger side mirror.

If you have any information on the location of Lana Bailey or have seen the vehicle, please call 911 or the KBI at 1-800-KS-CRIME.

The KBI has denied a full AMBER alert for Lana.

They said in a media release that it was not issued because the pictures of the child have already been widely circulated and using the Emergency Alert System would not enhance coverage.

This sucks. The public generally ignores missing child alerts and responds rapidly to Amber Alerts.

Also, when a baby is this young they need to tell us how old she is. She could be 13 months or 23 months, a huge difference.

Controversy erupts over no Amber Alert for slain woman's missing child

OTTAWA COUNTY, KS (KCTV) - The Franklin County Sheriff's Office and Kansas Bureau of Investigations are blaming each other as to why no Amber Alert has been issued for the daughter of a murdered woman.

The Kansas Bureau of Investigation has rejected Franklin County's request for an Amber Alert to be issued for 18-month-old Lana-Leigh Bailey.

An agency spokesman said KBI would have issued one on Monday during those crucial hours after the three bodies were found, but said it's too late to do so now.

Franklin County Sheriff Jeff Richards contends that the case did not meet the Amber Alert criteria on Monday, but should now. He said he is doing everything he can to get KBI to issue an Amber Alert.

The two agencies also disagree over whether a man is in custody in connection with the slaying of Lana-Leigh's mother and two other men. In a news release, KBI said a suspect is in custody while Richards repeatedly said a person of interest is being questioned but no one is in custody in connection with the slaying.

Those found dead this week are Kaylie Bailey, 21, her boyfriend, Andrew Stout, 30, and his roommate, Steven Eugene White, 31.

Kaylie Bailey and her daughter were last seen on May 1 when they were en route to Stout's farm. He was supposed to watch the child while Kaylie Bailey went on to work, but she never showed up. Her father filed a missing person's report for his daughter and granddaughter on Sunday with Olathe police.

Because the mother's status was unknown, Olathe police did not issue an Amber Alert.

Lana-Leigh is 2' tall and weighs about 30 pounds. She has light brown hair and blue eyes. The toddler and her mother were last seen en route to the farmhouse in a Corolla, which has Kansas license plate 618DAA with a tag on front saying "Shawna's toy" and duct tape on passenger side mirror.

Friends of Stout said authorities came to Stout's farmhouse on Sunday, but didn't do a detailed search and failed to find the bodies.

Three friends had gone to his farmhouse on Monday to feed the missing man's pets. That's when they smelled a horrible odor and began to explore. In a shed, they discovered a body, which the friends told KCTV5 they recognized as that of Kaylie Bailey. One woman described in vivid details seeing the person's face and eyes.

More than 40 detectives converged on the property and eventually found the two men's bodies over the course of Monday night and Tuesday morning. A search did not turn up Kaylie Bailey's daughter.

Even though the friends said they recognized Kaylie Bailey's body, Richards said that wasn't enough to say that it was her. He said that authorities could not say that was positively Kaylie Bailey until an autopsy and other tests were completed, which occurred sometime Wednesday before 1 p.m.

Richards repeatedly insisted Wednesday that Lana-Leigh's disappearance did not qualify as an Amber Alert until her mother's remains were identified.

But Kyle G. Smith, assistant attorney general for KBI, disagreed. He maintains that KBI would have issued an Amber Alert on Monday if asked.

"If we had received that request on Monday, yes, we would have absolutely done an Amber Alert," Smith said.

But it's too late now for an Amber Alert to be effective, he said.

"It's for immediate alerts, those crucial first hours after a child has been kidnapped," Smith said. "It just did not seem to fit the criteria."

KBI has asked for help from the public and the media in locating Lana-Leigh.

The Franklin County Sheriff's Office faxed over a request for an Amber Alert at 3:43 p.m. Richards did not explain why this wasn't done sooner since Kaylie Bailey's family was told about her death by 1 p.m. Thursday.

KBI issued a request for assistance at 3:57 p.m.

The following statement was issued by KBI:


"A full AMBER alert was not issued primarily for two reasons:

"• The media had been actively following the case for several days now and the information, including pictures of the missing child, have been widely circulated.

"• Utilizing the Emergency Alert System (EAS) at this point to interrupt broadcasts by the media would not enhance coverage and be an improper taking of private property given the delayed request.

"Other than not utilizing the EAS system to interrupt broadcasts, all aspects of an AMBER alert are being utilized."

One difference is if an Amber Alert is issued then news outlets run a crawl and the child's picture on their screens, the alert is placed on highway signs and it's shared across the country.

KCTV5 is running the crawl as if an Amber Alert had been issued in an effort to do everything possible to get the information out and Lana home to her family.

She's a cutie. I hope they find her alive and save. Since she was not found at the scene with the others this is a good sign that someone took her and she's alive. I hope they look for a custody issue. This is most likely what has happened. They seemed to have released the person of interest. William

A baby girl who hasn't been seen for more than a week and whose mother was found slain with two men on a Kansas farm is presumed dead, officials said Thursday.
The body of 18-month-old Lana Leigh has not been found, and investigators are still searching the farm and other locations for it.

Officials also announced an arrest in the case Thursday: Kyle Flack, 27, who was taken into custody and booked on suspicion of first-degree murder. Formal charges will follow, officials said.

The bodies of Kaylie Bailey, 21, Andrew Stout, 30, and Steven White, 31, were discovered at the farm in Ottawa, eastern Kansas, on Monday – touching off an intensive search for Lana and the alleged murderer.
Bailey and Lana, of Olathe, Kansas, were both last seen at the farm on May 1. Family members told KSHB.com that she had planned to leave Lana with Stout while she worked a nightshift job. Friends of Bailey's have said she and Stout had a relationship, The Associated Press reported .They were reported missing on Friday by her family after Bailey failed to show up for work.

"She loves holding things up to her heart and saying 'I', she loves clapping her hands," Lana's aunt Shawna Pettijohn told KSHB.com. "She'll make you work hard for a smile, but it is always worth it."

Kaylie Bailey's grandmother, Wilma Pettijohn, told the AP in a telephone interview Wednesday that Kaylie and Lana lived with her and her husband, Andy, in Olathe.

"Everything in the house reminds us of her," Wilma Pettijohn said. "It's just a lot of pain between here and OK."

A body recovered amid an intensive search is believed to be that of a missing 18-month-old girl whose mother was found dead along with two men on a Kansas farm days ago, authorities said Sunday.

Franklin County Sheriff Jeff Richards said in a statement that remains recovered in eastern Kansas on Saturday are believed to those of Lana Leigh Bailey, a child authorities previously reported as presumed dead.

The statement did not provide any details of where the body was discovered or how the infant had died. But his statement said a crime scene unit was called to the area 'to process this new crime scene.'

'It is not the outcome we'd hoped for but we knew we couldn't stop searching until Lana was home,' the statement said.

Richards told The AP by telephone early on Sunday that he would not have any further details beyond the statement. The Franklin County sheriff's office said its next scheduled statement on the investigation would be Sunday afternoon.

On Saturday, search crews had deployed using boats and sonar equipment in search of the child. Earlier authorities had said investigators were scouring ponds and other waterways in the area looking for the body of Lana Leigh Bailey.

Franklin County Attorney Stephen Hunting said Friday that a firearm was used against the victims at the farm, but didn't elaborate on whether that meant they were fatally shot.

Richards said earlier that the extensive investigation of what he called a 'horrific crime' had taken a toll and that members of the investigative team have required medical attention after searching in difficult areas. Others sought counsel from a chaplain.

Crying or Very sad How horrible! Pure evil. Flack just sits there looking bored with whole proceeding. This is yet another tragedy that would not have happened had this murderer still been in prison for shooting a man FIVE TIMES in an attempt to kill him. When they start charging the courts with 'accessory after the fact' when something like this occurs maybe the rules will change. This man should not have been released from jail after his prior failed murder attempt. This is an outrage.

"It is with great sadness that I report a body found in Osage County, Kansas, is believed to be the remains of 18-month-old Lana Bailey," Richards said in a statement he emailed to The Associated Press.

He said the body was found by an Osage County sheriff's deputy who was scouring an area for items that could be connected to the deaths reported at the farmhouse May 6 in nearby Franklin County. The evidence collected Saturday when the body was found led investigators to believe it was the infant's body, his statement said.
"We hope that a forensic examination will make a final identification," Richards added.

Richards told The AP by telephone that he would not have additional information beyond his statement early Sunday.

Judge orders Kyle Flack to stand trial in four Ottawa shotgun murders

A Franklin County judge on Wednesday ordered Kyle Flack to stand trial for the shotgun killings of four people, including an 18-month-old girl, at a farmhouse outside Ottawa last spring.

After a day and a half of preliminary hearing testimony, District Judge Thomas Sachse found probable cause existed to try Flack, 28, on charges of capital murder, first-degree murder and illegal possession of a firearm.

Flack’s arraignment is scheduled for April 22. If prosecutors intend to seek a death sentence for the capital charge, they have until seven days after arraignment to file notice. Franklin County Attorney Stephen Hunting said Wednesday that decision has not been made.

Forensic pathologist Erik Mitchell testified Wednesday that shotgun blasts killed Andrew Stout, 30; Steven White, 31; Kaylie Bailey, 21, of Olathe; and Bailey’s 18-month-old daughter, Lana Bailey.

The bodies of White, Stout and Kaylie Bailey were found at Stout’s rural home May 6.

The baby’s body was found five days later in a suitcase floating in a creek in Osage County, but Hunting argued Wednesday that evidence established she was killed in the bedroom where her mother’s body was found.

Bethany Stone, a DNA analyst for the Johnson County crime lab, testified that the baby’s DNA was found on several items in the bedroom, including a spent shotgun shell.

Flack is charged with capital murder in the deaths of Bailey and Lana because prosecutors say their deaths were part of the same “common scheme or course of conduct.”

Lana died from a shotgun blast to her back, Mitchell testified. Her mother died from a shot to the back of her neck.

Bailey’s body was found nude from the waist down with her hands bound behind her back. A red bandanna found around her neck had been used to gag her but was displaced by the lethal shot, Hunting argued.

“She was bound, gagged and executed there in the bedroom,” Hunting told the judge in outlining the evidence.

Based on the way Bailey was found, prosecutors charged Flack with attempted rape, but the judge ruled Wednesday that there was not enough evidence to show that, and he dismissed the charge.

Flack is charged with separate counts of first-degree murder in the deaths of Stout and White.

In a statement he gave to police after his arrest May 8, Flack said Stout shot White after they argued about rent money White owed. Stout then handed the shotgun to Flack, who also shot White, Flack allegedly told detectives.

Defense attorneys had objected to allowing Flack’s statement to be introduced as evidence. According to testimony, Flack described the killing of White after he asked a detective if he should get a lawyer.

The detective testified that after he told Flack he didn’t give legal advice, Flack continued talking. Later, when Flack stated he wanted a lawyer, the interview was stopped, according to the detective.

Although Flack talked to police for about 10 hours, prosecutors only presented the portion of his statement pertaining to White’s killing. They did not say if he admitted to involvement in the other deaths.

White was found in a garage with shotgun wounds to his chest and head. Mitchell said Stout, who was found dead in the bedroom where Bailey was found, suffered at least five shotgun wounds. He also appeared to have been struck in the head by a blunt object consistent with a shotgun barrel, Mitchell testified.

Several days after the adults’ bodies were found, workers at an Emporia, Kan., trash collection facility discovered part of a shotgun. Firearms investigators for the Johnson County crime lab testified Wednesday that they were able to link the shotgun with expended shells found at the crime scene.

And Stone testified that Flack’s DNA could not be excluded as the source of DNA found on the shotgun.

Flack was arrested at a friend’s apartment in Emporia on May 8. Bailey’s car was found abandoned in that city.

Among belongings found at the apartment in a duffel bag linked to Flack were plastic zip ties similar to the one used to bind Bailey’s wrists, according to testimony.

After the preliminary hearing, Flack’s attorneys declined to comment.

Speaking briefly to reporters, prosecutors said they had only presented enough evidence to establish probable cause. They said a trial would involve much more testimony.

They also said Wednesday’s hearing was just one step in a long process.

“Criminal litigation is a marathon, not a sprint,” said Deputy Kansas Attorney General Vic Braden.

Death penalty is sought for Kyle Flack in Kansas quadruple murder case.

Prosecutors filed notice Tuesday that they will seek the death penalty for a man charged in the shotgun killings of four people in Franklin County, Kan., last year.

The death penalty notice was filed after 28-year-old Kyle Flack was arraigned in Franklin County District Court. A judge entered not-guilty pleas on his behalf, and a September 2015 trial date was set after Flack waived his right to a speedy trial.

Flack is charged with capital murder in the killings of Kaylie Bailey, 21, of Olathe, and her 18-month-old daughter, Lana Bailey. He is charged with premeditated first-degree murder in the deaths of Andrew Stout, 30, and Steven White, 31.

Besides the intent to seek a death sentence for the capital murder charge, prosecutors filed notice that they will seek “hard 50” sentences for Flack on the two first-degree murder counts. That means if he is convicted, he will have to serve 50 years in prison before being eligible for parole.

Flack is also charged with illegal possession of a firearm. Prosecutors on Tuesday filed an amended complaint charging Flack with a misdemeanor count of sexual battery against Kaylie Bailey, who was found naked from the waist down with her hands bound behind her back.

A judge in March ordered Flack to stand trial on the charges after a day and a half of preliminary hearing testimony.

The bodies of the three adults were found in a house and a garage owned by Stout outside Ottawa. Lana’s body was found several days later stuffed into a suitcase and floating in a creek in Osage County. Physical evidence showed that she had also been killed in the house, according to preliminary hearing testimony.
