A Colorado mother who shot her 9-year-old son five times did it to get back at her husband, according to police documents.

Lisa Marie Lesyshen, 45, was taken into custody Friday and charged with
first-degree murder, child abuse leading to death and domestic violence.
She is still being treated for a self-inflicted gunshot wound at a
hospital in Denver, where she reportedly confessed to shooting Asher
Lesyshen-Kirlan.

Asher, a third-grader at Soda Creek Elementary School, died early Wednesday morning. According to the arrest warrant obtained by CBS Denver, the 9-year-old was shot three times in the chest, once in the head and once in the leg, likely at close range.

While searching the house, police discovered a note on Asher's nightstand
that read, "Remember you are responsible for what has happened here and
you are the person that caused it." The letter was addressed to Michael
Kirlan, Lesyshen's husband, and signed "Lisa & Asher."

Lesyshen and husband Kirlan, 46, were separated but living in the same house in
Steamboat Springs, Colo., according to the warrant.

Kirlan told police he woke up to the sound of gunshots around 3 a.m. Wednesday. He
raced upstairs to find his estranged wife leaving their son's room. He
saw that Asher had been shot multiple times and was covered in blood.
Kirlan said he carried the boy to the front entryway and then heard more
gunshots.

He asked Lesyshen why she would do something like this, and she reportedly answered, "To hurt you."

The woman also told Kirlan to kill her.

Lisa Marie Lesyshen is technically in police custody, although she remains at the hospital.


Officials found Lesyshen unconscious in the master bedroom and transported to a
Denver hospital. On Thursday, she told an officer she shot her son
before turning the gun on herself.

The arrest warrant also
described the events leading up to her son's death. Lesyshen purchased
to gun on Monday after passing a background check. She said she wanted
it to protect herself because her husband was out of town, the pawn shop
employee told investigators. The woman had no prior knowledge of how to
use firearms, so the employee showed her some basics, including how to
load the revolver.

On Tuesday, Lesyshen asked a coworker at Bud
Werner Memorial Library where she could purchase .22-caliber ammunition,
the document said. Lesyshen bought the bullets that afternoon

Officials report that Waterloo native who killed her son is paralyzed

STEAMBOAT SPRINGS --- The Routt County woman accused of killing her 9-year-old son is paralyzed at a Denver hospital, and it is unclear whether the damage is permanent.

Because of her medical condition, the Routt County Sheriff’s Office is making special arrangements, officials said Tuesday.

Lisa Marie Lesyshen, who grew up in Waterloo, was flown to Denver Health Medical Center two weeks ago with a self-inflicted gunshot wound to her neck area, and she has been guarded by Sheriff’s Office deputies ever since.

She is the daughter of John and Donna Lesyshen of Waterloo.

It is creating a strain on the Sheriff’s Office, and Sheriff Garrett Wiggins said the bills are adding up. The deputies are being paid overtime, and the county also has to pay for their food, transportation and lodging. Undersheriff Ray Birch estimated it is costing the county between $800 and $1,000 a day to guard Lesyshen.

Wiggins was hoping that by Wednesday a private security company hired by the county would begin guarding Lesyshen at a cost of about $580 a day. Birch said the services offered by the company are often used by other agencies in the states.

It is still unclear when Lesyshen might be healthy enough to be released from the hospital, where Wiggins said she is no longer in the intensive care unit.

Once Lesyshen is well enough, the Sheriff’s Office is arranging to have her held at the infirmary at the Denver Downtown Detention Center. That would cost $586 a day plus the cost of medications and supplies.

By comparison, it costs $52.50 a day to house a healthy inmate at the Routt County Jail.

Lesyshen has been charged with first-degree murder, child abuse causing death and domestic violence. She is accused of shooting her only son, Asher Lesyshen-Kirlan, five times in the early hours of May 29 before turning the gun on herself. According to court documents, Lesyshen told her husband Michael Kirlan that she shot their only child because she wanted to hurt Kirlan. The couple lived together at their Stagecoach home but were in the process of separating. Kirlan awoke to the sound of gunshots that night but was not injured himself.

According to court documents, Lesyshen admitted to investigators that she shot her son.

Investigators are in the process of seizing Lesyshen’s cell phone records, according to a warrant filed with the court.

The warrant reveals some new details about what investigators have learned.

According to the warrant, Kirlan told his wife on May 27 that he was in a relationship with another woman. That same day, Lesyshen bought a Smith & Wesson .22-caliber revolver from a Steamboat pawn shop after passing a background check. Also that day at about 6:30 p.m., a neighbor told investigators she had a conversation with Lesyshen via text messages. The neighbor reported that Lesyshen asked her if she had any .22-caliber bullets because kids were coming over to shoot guns off the deck. The neighbor told her she did not have any bullets.

The next day, May 28, investigators say Lesyshen went to a Steamboat gun store and bought bullets. Kirlan received a text message from his wife later that day asking if he was coming home, according to a warrant. The shootings occurred in the early morning hours of May 29.

Routt County woman charged with killing son makes court appearance by video

August 28, 2013

Steamboat Springs — The Routt County woman accused of killing her 9-year-old son before attempting suicide has made significant progress in recovering from her injuries, prosecutors say.

Lisa Lesyshen appeared at a Routt County Justice Center hearing Wednesday via a video feed from a jail-like facility at Denver Health Medical Center. A guard was in the back of what appeared to be a small, cinder-block office. Lesyshen was joined by her attorney, public defender Scott Troxell.

Lesyshen only spoke once to acknowledge something told to her by 14th Judicial District Chief Judge Michael O’Hara.

Lesyshen was wearing white hospital pants and a blue T-shirt. She was sitting in a wheelchair but used her arms freely to adjust her hair.

Attorney Charles Feldmann — who is representing Lesyshen's husband, Michael Kirlan, as a victim’s advocate — said Lesyshen was paralyzed from the waist down.

Investigators said that after shooting and killing her son, Asher Lesyshen-Kirlan, several times during the early hours of May 29, Lesyshen shot herself in the neck area. According to court documents, Lesyshen and Kirlan were in the process of breaking up, and Lesyshen had learned Kirlan was seeing another woman.

Lesyshen has been charged with first-degree murder related to domestic violence and child abuse resulting in death. She does not have the option to post bail.

The purpose of the hearing Wednesday was to better gauge how Lesyshen’s criminal process would proceed. Because of Lesyshen's medical condition, it was unclear when or if she could be brought to court in Routt County.

Routt County Chief Deputy District Attorney Rusty Prindle said Lesyshen has been undergoing physical therapy. Those involved with the proceeding estimated Lesyshen could be well enough to travel for court hearings in four to eight weeks.

“My understanding is she is making pretty significant progress,” Prindle said.

Lesyshen’s next hearing is scheduled for 1 p.m. Oct. 11.

“The court is hopeful Ms. Lesyshen will be in the courtroom that day,” O’Hara said.

Outside of the criminal courts, Kirlan filed July 15 to divorce Lesyshen. Feldmann helped Kirlan file the divorce paperwork.

Feldmann said the couple has been communicating, which the court has allowed with Kirlan's consent.

“She is able to call him, and they do not have in-person visitation privileges,” Feldmann said.

Feldmann said the Routt County Sheriff’s Office can monitor the communications. For this reason, Feldmann said, Lesyshen has been guarded when speaking, but she has expressed remorse.

Feldmann said Kirlan is living in the Denver area and trying to put his life back together.

“He’s not looking forward to playing a bigger role in the criminal process, such as if he were called as a witness,” Feldmann said.

A mother should certainly not kill her child and a married man should not be seeing another woman; another woman should not be seeing a married man and this adorable child would still be alive.

Steamboat Springs — A preliminary hearing has been scheduled in Denver for the Routt County woman who is accused of killing her 9-year-old son before attempting suicide May 29.

Lisa Lesyshen appeared in Routt County Court on Friday via telephone from the Denver County Jail infirmary. She was moved there from Denver Health Medical Center, but she still requires medical care that is keeping her from being transferred to the Routt County Jail.

Despite objections from public defender Scott Troxell, 14th Judicial District Chief Judge Michael O’Hara decided to hold the preliminary hearing at 8:30 a.m. Nov. 13 in Denver.

“At this point, we are not consenting to hold any hearing in Denver court,” Troxell said. “Ms. Lesyshen, to be clear, would like to be in Routt County. She has no desire to be in Denver.”

The one-day hearing either will be held in a courtroom at the Denver County Jail or across the street at the Denver County Courthouse.

“I do want to be absolutely certain that the public can attend that hearing,” O’Hara said.

The purpose of the preliminary hearing is to decide whether sufficient evidence exists to have the case go to trial.

District Attorney Brett Barkey also attended Friday’s hearing via phone. Earlier in the day, Barkey toured the facility where Lesyshen is being held. He said Lesyshen is paraplegic, a condition that was caused by shooting herself in the neck during a suicide attempt. She has no use of her legs, some use of her arms and is able to get in and out of bed on her own.

“Ms. Lesyshen is the way she is going to be,” Barkey said.

Barkey said it is costing Routt County taxpayers $586 per day to house Lesyshen at the Denver County Jail but said it is the best option at this point.

The Routt County Jail is not equipped to house Lesyshen, Barkey said. Staff would have to be hired and equipment would need to be rented if the jail were to take her in. Barkey said estimates are it would cost $20,000 to $40,000 to house Lesyshen at the Routt County Jail for three or four weeks during a trial.

A trial likely would need to be held in Routt County with a Routt County jury pool unless there is a formal decision to change the venue.
