Police triggered an Amber Alert after a 2-month-old child in a stroller was
abducted in west Houston this afternoon, authorities said.

An unknown man grabbed Misoh Gulabbaksh about 5:30 p.m. in the 8000 block of Woodway.
Houston police described him as a 5-feet-4 or slightly taller black man
with a tattoo on his upper left arm.

He was a passenger in a small, two-door brown or beige Chevrolet. A description of the
driver wasn't available.

Houston police said they do not have a photograph of the missing child.

A baby reported abducted from his stroller in Houston has been found dead and police
questioned his mother over the disappearance.
An Amber Alert was canceled early Thursday for the 2-month-old
boy, identified by authorities as Misoh Gulabbaksh.
The Amber Alert advisory says the mother reported the boy had
been snatched from his stroller, late Wednesday afternoon, by an unknown
male. An updated Amber Alert statement says the child's body was
located by police around 2 a.m. Thursday.

An Amber Alert has been canceled after the
body of a two-month-old boy is found in a southwest Houston bayou.
Police say that the mother who reported the boy was taken from his
stroller later admitted to investigators that the story was untrue. Misoh
Gulabbaksh was originally reported as abducted at approximately 5:30
p.m. Wednesday from the 8000 block of Woodway Drive. The boy's
mother at first told police that two men abducted Gulabbaksh as she was
pushing him in a stroller, but after questioning by investigators, she
admitted to leaving the body in a nearby bayou. Police say that
Gulabbasksh's mother led officers to the bayou where investigators found
the body at approximately 2 a.m. Thursday. Autopsy results are
pending to determine how the baby died. The Amber Alert for
Gulabbasksh was initially issued after 6 p.m. Wednesday.

The search for a missing 2-month-old boy was cancelled after the infant's body was found,
police said.
A police investigation was being conducted early Thursday in a wooded area area along Buffalo Bayou in
the 8000 block of Woodway.
A west Houston woman told police Wednesday a stranger abducted her infant son during their regular
afternoon walk through the neighborhood, authorities said.
The woman, identified by family members as Narjes Golabbakhsh, 27, said she was
pushing her son, Masih, in a stroller about 4 p.m. along the 8000 block
of Woodway when a beige-colored sedan pulled up beside her.
Golabbakhsh told officers a man got out of the car, snatched her son from the stroller,
then raced away. There were no threats or demands made of her, said Sgt.
Robert Torres with the Houston police homicide division.
“She said (the abductor) just grabbed him. She never got a good look at his face,” Torres said.
The child's mother was taken to HPD headquarters for more detailed questioning.
After noticing that the woman had mud on her shoes, HPD officials sent tracking dogs to
search the wooded area along a nearby stretch of Buffalo Bayou.
S.S. Amir, a close family friend, said police have not released any details about the case. The family is
at the downtown police station talking to investigators, but Amir said
he doesn't know where the child's mother is.
He said the family is very nice andhe can't believe that the child is dead or that the mother had anything
to do with it.
"It's very devastating," Amir said. "It doesn't make any sense."
The disappearance prompted Houston police to trigger an Amber Alert that remained in
effect until the boy's body was found.
Several concerned family members gathered along the road where Masih's mother said he was taken.
“We're devastated. We're heart-broken,” said Yunes Golabbakhsh, the child's uncle. “We are
pleading for his safe return.”
He said the child's mother tried to call on her cell phone but was unable to get a signal.
“She ran down the road to where one of her friend's live,” Yunes Golabbakhsh said.
He said the family has lived in Houston for about eight years.
“We're a respectful family. We've never had any enemies and we've never had any problem with
anybody,” Yunes Golabbakhsh said.

Police: Mom's Led Officers To Misoh Golabbaksh's Body

HOUSTON -- An Amber Alert for a 2-month-old boy was canceled Thursday after his mother led investigators to his body.

Houston police issued the alert for Misoh Golabbaksh Wednesday, after his mother reported that a man had snatched him from his stroller in the 8000 block of Woodway Drive at about 5:30 p.m.

Detectives said they questioned the mother and her story was inconsistent. "We wanted to double check to be sure that she didn't maybe trip and maybe drop the baby in the water accidentally," Sgt. Robert Torres said.

At about 2 a.m. Thursday, the mother led officers to Misoh's body, which was near the location where she said he was abducted, police said.

The mother was taken to a hospital, but police have not said why.

The Harris County Institute of Forensic Science will determine the cause of Misoh's death.

An Amber Alert is canceled and a mom charged with murder after the
body of her two-month-old son is found partially buried at the bottom of
a staircase in southwest Houston. The Harris County District
Attorney's Office on Thursday accepted capital murder charges against
Narjes Golabbakhsh. According to Houston police, Golabbaksh
reported her baby boy, Masih, was snatched from his stroller by a group
of men on Wednesday afternoon. She told police the incident happened as
she pushed the stroller along a bayou in the 8000 block of Woodway
Drive. Police quickly issued an Amber Alert but continued to question
the boy's mother. Detectives said Golabbakhsh eventually broke
down and took them to where she allegedly buried the baby. Police
waited for an autopsy to be completed before charges were filed, but a
cause of death was not immediately determined. "We knew she was
depressed. She was on medication," said paternal grandfather Amil
Golabbakhsh as he came to see where the baby had been buried Thursday
morning. "We didn't know it was this bad." A family member said the mom went from the police station
to a hospital to be treated for emotional distress. After the hospital,
it was expected the mom would be taken back into police custody. The
suspect has one other child, who is three years old, according to the
family.

A mother accused of burying
her infant son alive was charged with capital murder today.
Investigators say the mother confessed to
the crime after the child's body was discovered partially buried at the
bottom of the staircase at her home.At a probable cause hearing
this morning, Harris County prosecutors formally charged 28-year-old
Narjes Golabbakhsh with the capital murder of her two-month-old son,
Masih.According to an autopsy report from the medical examiner’s
office, the boy was buried alive, face down, in a muddy pool of water."The
autopsy noted water and mud in the complainants lungs, stomach, and ear
way, concluding the complainant was alive prior to being placed face
down in the muddy water and buried," read a court official yesterday.
An Amber Alert was issued Wednesday afternoon for Masih. Ms
Golabbakhsh told police she was pushing the boy in a stroller when
several men snatched the child and ran away.Prosecutors waited to
verify the cause of death before filing charges against the mother.In
court, they said Ms Golabbakhsh had mud on her clothing, consistent
with the mud at the crime scene.The mum was not in court today as
the details of the investigation were read aloud. Officials have placed
her in a psychiatric ward for mental evaluation.Family members
said prior to her arrest, the mum was undergoing treatment for mental
illness, and she was taking medication for it.The suspect has one
other three-year-old child, according to the family.

What a beautiful baby. What a tragic ending. What is wrong with people? I can't bear to think of his last minutes, struggling to breath. It is sickening.

A 2-month-old boy whose mother originally told police he had been abducted by a stranger
died after being buried alive near Buffalo Bayou in west Houston, prosecutors said Friday.

Narjes Modarresi, 28, was charged with capital murder after
leading police to the baby's body, which was found facedown in a
shallow grave Thursday. She underwent a psychiatric evaluation Friday at
the Mental Health and Mental Retardation Authority of Harris County.
During a probable cause hearing Friday, prosecutors said initial reports from the Harris
County Institute of Forensic Sciences showed the baby had mud and water
in his lungs, indicating he was alive when buried. The preliminary cause
of death was asphyxiation.

Modarresi's family has hired defense lawyer George Parnham,
well-known for his defense of Andrea Yates, a Clear Lake mother who was
found innocent by reason of insanity in July 2006 in the drowning death
of her five children in the family bathtub in 2001. She was sent to a
state mental hospital.

Parnham said his team still is in the process of gathering
Modarresi's medical history, but acknowledged that she has a history of
mental illness.
“It's a tragedy that could have been averted,” said Parnham, who has spoken
with Modarresi family members, but will not meet with her until today.
“The family's taking it tough.”
Parnham said Modarresi was on the anti-psychotic medication Zyprexa,

a mood stabilizer used to treat schizophrenia and bipolar disorder.

Bipolar disorder is considered a risk factor for postpartum psychosis,

a condition that involves losing touch with reality after childbirth,

often experiencing hallucinations or delusions.
Buta Baylor College of Medicine psychiatrist said it was too early to
conclude that Modarresi suffered from postpartum psychosis. She said
there still is too little information about Modarresi's condition.
Modarresi was under treatment by MHMRA
before the incident, Parnham said. He said he went to see her Friday,
but backed off when he saw she was undergoing the MHMRA evaluation.

Defense complication

If Modarresi's lawyers attempt a defense similar to the one used in the Yates case, in
which Parnam argued his client suffered from postpartum psychosis, her
original report to police may work against an insanity defense, said Joe
Owmby, who faced off against Parnham as the prosecutor in the Yates case.
Modarresi initially said she was pushing her son, Mosih Golabbakhsh, in a stroller
along the 8000 block of Woodway when a man got out of a car and took the child.
Police noticed mud on Modarresi's shoes and sent dogs to search a nearby
wooded area. The mother later showed police where the body was buried.
“If she originally said the child was kidnapped, that is an indication that she knew that
this was wrong and she wasn't operating as a result of a delusion or
psychosis,” said Owmby, who now is a defense lawyer. “If a person is so
mentally ill that they don't know killing a child is wrong, the logic
goes, then they would not attempt to cover it up.”
Parnham said Modarresi was on another medication, but did not
know what it was.
Modarresi suffered from postpartum depression, a family friend said Thursday.
Postpartum depression rarely results in mothers harming an infant, said Rhoda Seplowitz, a
Baylor professor of psychiatry and behavioral sciences. But such
depression can coexist with postpartum psychosis, which often occurs in
women with a history of bipolar disorder, she said.
Zyprexa often is used to prevent the
onset of psychosis in patients at high risk of schizophrenia.
Owmby said the baby's age, two months, falls within the medically acceptable limits for
postpartum depression, generally within six months of the birth.
Procedurally, Owmby said, Parnham will first have to decide whether Modarresi is competent
enough to aid in her defense.
Modarresi remains in the County Jail without bail.
The child's father, Amir Golabbakhsh, 28, and Modarresi, are both from Iran.

They have been married for four years and have another child who is 3ยฝ
years old, Golabbakhsh's father has said. Golabbakhsh and other family
members declined to comment Friday.

While legal experts say there are similarities between a mother
recently charged with murdering her baby and Andrea Yates, there is one
big difference.
The body of two-month-old Masih Golabbakhsh was pulled from a shallow
creek in the 8000 block of Woodway Thursday morning. According to a
probable cause affidavit, he was still alive when his mother, Narjes
Modarresi, buried face down in the mud.

Now, the attorney who defended Yates for the murder of her five
children has signed on to defend Modarresi for the murder of her baby
son.
“You go well beyond the circumstances of what happened to the mindset
of the mom to answer that question, How could a mother do this?” said
George Parnham, in an interview Thursday about the post-partum defense
for which he’s come to be known.
“It’s a very difficult defense,” said attorney Joe Owmby, who
prosecuted Yates.
Owmby sees one big potential difference, between the two cases.
He said while Andrea Yates called 911, investigators say Modarresi
first claimed strangers had snatched her baby from his stroller.
“That fact, alone, is a very significant fact that a mental health
professional would have to explain,” said Owmby.
In a justice system where insanity means not knowing the difference
between right and wrong, an attempted cover up can be the difference
between guilt and innocence.

A two-month-old police say was killed by his mother has received a
proper burial.
Family members said goodbye to Masih Golabbakhsh's Sunday afternoon in
west Houston. The baby was found dead last week. Police say his
mother Narjes Modarresi confessed to burying the boy alive. Her family
says she has a history of mental illness. She's expected to be in
court Monday morning.

HOUSTON -- The attorney of a Houston woman who allegedly killed her 2-month-old son will use the insanity defense, according to court papers filed Friday.

Prosecutors charged Narjes Modarresi with capital murder after she led police to Masih Golabbakhsh's body in April.

Prosecutors said the baby was buried alive and his body was pulled from a shallow creek in the 8000 block of Woodway. According to a probable cause affidavit, he was found face-down in the mud.

Her attorney, George Parnham, said the 28-year-old woman has a history of postpartum depression.

Parnham is the same lawyer who successfully used the insanity defense when defending Andrea Yates, a woman who drowned her five children in a bathtub.

MEMORANDUM OPINION

PER CURIAM.

On April 13, 2012, relator Amir Francisco Golabbakhsh filed a petition for writ of mandamus in this court. See Tex. Gov't Code ยง 22.221; see also Tex. R. App. P. 52. In his petition, relator complains that respondent, the Honorable Roy Moore, presiding judge of the 245th District Court of Harris County, abused his discretion in a March 16, 2012, order by placing restrictions on the release of medical records of the real party in interest, Narjes Modarresi.

Mandamus is an extraordinary remedy that will issue only if (1) the trial court clearly abused its discretion and (2) the party requesting mandamus relief has no adequate remedy by appeal. In re Prudential Ins. Co. of Am., 148 S.W.3d 124, 135-36 (Tex. 2004). We determine the adequacy of an appellate remedy by balancing the benefits of mandamus review against its detriments. Id. at 136.

A trial court abuses its discretion if it reaches a decision so arbitrary and unreasonable as to amount to a clear and prejudicial error of law, or if it clearly fails to analyze or apply the law correctly. In re Cerberus Capital Mgmt., L.P., 164 S.W.3d 379, 382 (Tex. 2005). When reviewing the trial court's decision for an abuse of discretion, we may not substitute our judgment for that of the trial court with respect to the resolution of factual issues or matters committed to the trial court's discretion. See Walker v. Packer, 827 S.W.2d 833, 839-40 (Tex. 1992).

Relator has not established that the trial court abused its discretion. Accordingly, we deny relator's petition for writ of mandamus.

Mother on trial for burying her baby alive

Severe bipolar disorder is the reason Narjes Modarresi buried her 2-month-old son alive in 2010, her lawyers said Wednesday during opening statements in her capital murder trial.

"You will hear from a doctor who believes that 'but-for' the severe mental illness suffered by Narjes Modarresi, this tragedy would not have occurred," defense attorney George Parnham told jurors in opening statements in Harris County District Court.

Prosecutors are seeking life without parole for Modarresi, 32, and said she knew exactly what she was doing to her son.

"She woke up on April 21, 2010 and decided to kill Masih Golabbakhsh," Assistant Harris County District Attorney Sunni Mitchell said. "He was a child she never wanted and never loved. He was in her way."

The baby, her second child, died after being buried facedown in the mud near Buffalo Bayou in west Houston.

Modarresi originally told police that two men in a beige Chevrolet had kidnapped her son while she was walking him in a stroller.

However, prosecutors said a neighbor saw Modarresi walking calmly, then begin to run and crash the stroller, without a baby, into a curb. The 32-year-old then ran away as she called 911 and said her son was kidnapped, prosecutors said.

After police spoke to the neighbor, they confronted Modarresi, who eventually led them to the baby's shallow grave, prosecutors said.

For the past four years, Parnham told jurors, Modarressi has been psychologically evaluated. He said jurors will see her medical records, including evidence of two suicide attempts in her teens. She also forced an emergency landing of an international flight in Qatar after she had a psychotic episode on the plane coming from a visit to her native Iran.

If a defendant is convicted, Parnham has said, mental health issues can be factors for possible mitigation of punishment. According to the Mayo Clinic, bipolar disorder is associated with mood swings ranging from depression to the highs of mania. It's a long-term, disruptive condition but can be treated with medications and psychological counseling.

Modarresi would automatically be sentenced to life in prison without parole if convicted of capital murder. If the jury convicts her of a lesser offense, such as murder, potential punishment ranges from five years to life in prison.
