Non-custodial mother, jailed for contempt, refuses to reveal whereabouts; father files missing persons report
An earlier decision by authorities to “unlist” four-year-old Jaelyn Rice
in the National Center for Missing and Exploited Children’s database
was reversed yesterday when the girl’s father, Stephen Rice of Tampa,
Florida, filed a missing persons report. Meanwhile, the child’s mother,
Cherish Lewis of Wheelersburg, Ohio, is jailed indefinitely on
contempt-of-court charges stemming from her refusal to inform
authorities of her daughter’s whereabouts. According to reports, this
is the third time Ms. Lewis has been incarcerated on contempt charges.

She hasn’t actually made a federal case out of it yet, but after Ms. Lewis,
who is currently serving time in the Scioto County (Ohio) Jail and has
been battling Jaelyn’s custodial father in court, had appealed a local
court’s decision about Jaelyn’s disposition to the Ohio Court of
Appeals, that court contacted the Ohio Supreme Court for assistance in
adjudicating the case.

As to the earlier decision not to post Jaelyn as missing in the NCMEC database, Scioto County Sheriff Marty Donini told the Portsmouth [Ohio] Daily Times
that after a discussion with the Ohio Attorney General’s Office and
Scioto County Prosecutor Mark Kuhn, he determined it was not a missing
persons case because the biological mother knew the child’s whereabouts.

“We brought her (Lewis) out and questioned her and asked if the child is
missing. And she basically said no, she knows exactly where the child
is,” Donini said. “She’s just not going to tell the judge.”

Press reports did not clarify what Ms. Lewis’s reasons were for hiding her
daughter, nor upon what legal basis she may have been challenging
Rice’s custodial status. Lewis’s appeal still appears to be pending,
and time will tell whether it is ultimately successful or not.
Meanwhile, Jaelyn’s life and disposition are left in limbo, and her
custodial father, who lives more than 900 miles away, can only wait and
watch, day to day, week to week, month to month, as his daughter’s
preschool years tick away.

They just changed the court order.
The still haven't found this little girl.
Her Mom should have lost custody a long time ago.

---Here's something else that's VERY STRANGE Francis: NO Mainstream media outlet, No newspaper, tv or radio has picked up on this story. I have even e-mailed some to get them going on it but nobody responds. this despite the fact that she's listed very plainly on the NCMEC site! I don't get it? Is there something I am missing?

Detectives say they have a suspect in the case of a missing 5-year-old girl in Scioto County.

Scioto County Sheriff’s Office has issued an arrest warrant for
19-year-old Jessica Lewis of Wheelersburg, Ohio. The warrant charges
Lewis with “interference in custody.”
The case involves 5-year-old Jaelyn Rice.
Rice’s biological mother, 22-year-old Cherish Lewis, is currently in the
Scioto County Jail after failing to reveal the child’s whereabouts. She
has been in jail since a hearing on July 24. Jessica Lewis is Cherish
Lewis’ sister.

say Jessica Lewis and Rice were believed to have been staying at a
residence on Coriell Road in Minford until the end of July when they
fled the area.
Detectives believe Lewis and the child are still in the Tri-State area.
Sheriff
Marty Donini says the investigation has been difficult and frustrating
because additional information indicates that known acquaintances of
the biological mother are possibly aiding in delaying the child's
recovery.
Donini also says
that any person who knowingly interferes, impedes, or causes a delay in
the safe return of the child will be arrested.
Anyone with information on the pair is asked to call the Scioto County Sheriff’s Office at 740-354-7566.

The Scioto County Sheriff’s Office has filed an arrest for the sister of a woman who has refused to disclose the whereabouts of her five-year-old daughter, whose photo and narrative are listed on the Web site for the National Center for Missing and Exploited Children.

Scioto County Sheriff Marty V. Donini said his office is looking for Jessica D. Lewis, 19, whose last known address was 709 Herms Hill, Wheelersburg, Ohio. The warrant was obtained Aug. 11, and charges Lewis with interference in custody.

Jaelyn Rice, who, at the time of her disappearance, was 4 years old, is described as having blond hair and blue eyes, has been missing since July 16, when she was visiting in Ohio with her mother.

Her father, Stephen A. Rice, 4813 West Flamingo Road, Tampa, Fla., issued a missing persons report, since he is the custodial parent.

On July 24, 2009 while attending a court appearance in the Scioto County Domestic Relations Court, the biological mother, Cherish N. Lewis, 22, also of 709 Herms Hill, Wheelersburg, was remanded to the Scioto County Jail by Judge Frederick Crow III for failing to produce the whereabouts of the child.

Crow was assigned to hear the case after a conflict in the original case. Judge David Spears of Scioto County Domestic Relations Court was being challenged in an election by Attorney Marie Hoover, who was involved with the case at the time. That resulted in that court contacting the Ohio Supreme Court for someone to come in and hear the case. Cherish Lewis remains incarcerated.

As the result of an inquiry concerning the possible sighting of the missing child July 31, while at a residence on Coriell Road in the Minford area, Donini said detectives have gathered information from credible witnesses to verify that Jessica D. Lewis did, in fact, have possession of the child but fled the area with the child prior to deputies arriving to investigate the sighting.

Scioto County Sheriff’s Captain David Hall was asked if there would be changes in the charges should it be determined the child has been taken to another state.

“It takes it from a misdemeanor to a felony,” Hall said.

Donini describes the investigation as “somewhat difficult and frustrating,” because additional information is indicating that known acquaintances of the biological mother, Cherish Lewis, are possibly aiding in delaying the recovery of the child.

“We actually think there are people out there who think they are doing the right thing by helping to assist in hiding this child,” Hall said. “They actually are not. We have a court order to, by force, take the child into custody.”

Hall indicated other people may also be charged in obstructing the investigation and retrieving of the child.

“Charges right now are still pending on some other people,” Hall said. “If people are located with that child or are obstructing the investigation, they will be charged accordingly.”

Donini said anyone with additional information concerning the investigation or the whereabouts of Jaelyn Rice and/or Jessica D. Lewis, are encouraged to contact Hall or Detective Jodi Conkel at 740-354-7566.

Scioto County Sheriff's deputies continued their search Friday for a missing 5-year-old girl, hidden away by her mother in a bitter child custody dispute.

Family and friends of little Jaelyn Rice's father, who lives in Florida, said they fear for the child's physical and mental well-being. Jaelyn is listed on the National Center for Missing and Exploited Children's Web site.

The girl's mother, Cherish Lewis of Wheelersburg, Ohio, was jailed nearly a month ago for refusing to tell a judge where her daughter was hidden.

The mother's sister, Jessica Lewis, is now wanted by police for interfering in custody.

Officials with a legal aid group assisting the Lewis family said evidence shows the father is an abusive parent, allegations the rice family denies.

Scioto County Sheriff Marty Donini said this investigation is frustrating because it puts a 5-year-old child in the middle of some adult legal differences.

I have been researching this story the past few weeks and I have found some terrible things. The court dockets are available online at the Scioto County Court Website. You just search either parents name. There are many court cases, and this case is bizarre. I cant believe the mother was even given back vistiation the past two times! This guy had to fight just to see his daughter and get her name changed, she denied him visitation since she was an infant, and has tried to file some sort of abuse on him, his mother, anyone inher way! I just foundt his blog on another site Ive been reading on Jaelyn about, I can provide links if you are interested. I pray this little girl is found safe, this mother is a nut case.

People - this "mother" has had Jaelyn in court her entire life! When she had her for visitation she made accusations against father, getting temporary custody until a court date would be set, keeping her longer than she was supposed to have her.
She even went to make a report of molestation prior to this last court date (in July) saying the incident happened in November last year. She did not take Jaelyn with her to report this, thus not allowing an exam, nor provide her for interviews. What irks me is her accusations that the father is a molester. That's a joke; been proven not true.
BUT this "mother", prior to jail, was seen in town driving a registered sex offenders vehicle, has been seen with this sex offender WITH Jaelyn right there with them. Not just one time either..... Form your own opinion. Verify his name - it is Ralph Ash.
Steven may be in Florida, but YES he is working to find his daughter, and family and friends in Ohio are STILL actively searching -- with very little help from Law enforcement. Jaelyn was seen 2 times since mommy dearest went to jail. Only one was reported in paper.
The Lewis family has problems that I wouldn't want ANY child involved in - including the children still at home. In 1999 law was called to Lewis home when mom Rita made threats towards family when her husband Domar had an affair; checked into mental hospital (was listed as a domestic disturbance in the paper); mom Cherish backed car into another car in driveway of home after finding out that her mom/dad were collecting social security on Jaelyn and she wasn't aware of it; mom/dad took daughters to bars and private parties and allowed them to drink under age.
Stephen was not the only person tested for parentage. One other was too. She has two kids now living off the system, saying they live with her and her grandmother when the children lived/lives with Cherish's mother. She will not keep a job to support her kids. As for the car wreck, Cherish tried to sue and was told she had no case. As for the attorney, Marshall, this was her 3rd or 4th attorney and owes him thousands in unpaid legal fees, and owes at least another attorney money. When things don't go her way in court she gets a new attorney and is now trying to get a new judge because she doesn't like his decision.
As for money in families. Neither family is rolling in money. Go to the Portsmouth Municipal Court website and look up all the money cases owed by this family, and all the other cases filed. Look up the other family - again - form your own opinion.
What kind of family is this? Parents who encourage underage drinking and promiscuous activies; thinks it's O.K. for eldest daughter to stay in jail and next eldest daughter, Jessica, have a warrant for her arrest and allow this to ruin her life forever. After all, she is only 19 and it will be a permanent reord for her in jobs, school, etc.
