Jackson County prosecutors have accused a man of torturing his
1-year-old son over several days this week. The boy was declared brain
dead Friday morning, authorities said.Prosecutors on Thursday
charged Rey A. Cruz Sr., 19, with assault and child endangerment. The
charges could be upgraded.Kansas City police have counted the boy
as the 38th homicide of the year.Investigators said he lived
with his father and two other relatives. His mother is in prison, police
said, and Cruz moved around, living with friends and relatives.Police
were called to the boy’s home in the 1300 block of Monroe Avenue about
2:35 a.m. Thursday. They found the boy struggling to breathe. He had
bruises “all over his body,” according to court records.Doctors
found brain swelling. He also had 10 rib fractures, bruises to his
genitals and hemorrhaging to his eyes.Cruz rode to the hospital
with his son and fell asleep in a room. Detectives took him in for
questioning. He initially denied knowing how his son was hurt but later
admitted shaking the boy at least five times, court records say.According
to court records, the abuse began Monday with shaking. Cruz said he
pushed the boy down two times Tuesday when he was “trying to help (the
boy) walk.” He shook the boy again Tuesday night because the boy was
crying.On Wednesday, Cruz said, he slapped the back of the boy’s
head. In the afternoon, when the boy cried, Cruz hit him in the face.
When the boy cried again that night, Cruz said, he shook him for about a
minute and hit him twice in the face. When the boy awoke and cried at
10 p.m., Cruz squeezed his abdomen and threw him to the floor, knocking
him out.Cruz left the boy on the floor, then later shook him
several more times and punched him “hard” in the abdomen three or four
times. Cruz said he punched him in the groin to try to “wake him up.”
The boy remained unconscious.Early Thursday, Cruz called 911 when
he saw the boy’s eyes were not moving together and he was struggling to
breathe.

Rey A. Cruz Jr., who was 1 year old, was pronounced brain dead Friday,
and his organs were donated over the weekend. The little boy's father, age 19, is accused of
severely beating him. Right now, Cruz Sr. faces counts of assault and
child endangerment, though police are expected to seek upgraded charges.
The boy's mother is serving a prison sentence.

to upgrade the charges in light of the boy’s death.Investigators

A 1-year-old boy had bruises all over his body -- on his head, torso, legs and genitals -- when he was rushed to the hospital on May 6.

The boy's heartbeat was irregular and he also appeared "lethargic." His father, 20-year-old Rey A. Cruz Sr., admitted to detectives that he beat the child multiple times over a three-day period.

Cruz told police that he pushed the boy down while trying to teach him to walk and later shook him on May 4. He admitted slapping his son on the back of his head on May 5.

Later that afternoon, the boy was crying and Cruz hit him in the face. Frustrated again by the boy's crying, Cruz admitted shaking the child for a minute and hitting him twice in the face.

The boy calmed down after being given a bottle. Around 10 p.m., the child woke up crying. Cruz said he squeezed the child above the waist and poked him in his stomach to check him. Then he threw the child on the floor. The child was unresponsive. Cruz left him there for a little while.

Cruz also admitted to shaking the child two more times, punching him in the stomach three or four times and flicking the child's magic stick and punching him in the groin to wake him up.

Cruz finally called 911 around 2:23 a.m. and tried to give the child CPR.

At the hospital, the child was unresponsive, and a medical report showed the child had a subdural hematoma. The boy's brain was swelling so much that it was pushing down on his brain stem. He had 10 rib fractures and "multi-layered retinal hemorrhaging." Doctors classified the injuries as "non-accidental" and placed the boy in the intensive care unit.

The Kansas City Star reported earlier today that the boy was declared brain dead and charges against his father may be upgraded.

Rey Cruz Sr. is charged with first-degree assault and first-degree endangering the welfare of a child.

​Rey Cruz Sr. should never get to lay claim to being a father. The 20-year-old beat his 1-year-old son, Rey Cruz Jr., so severely over a three-day period -- just because the child cried -- that the boy ended up dying.

Cruz was sentenced to 22 years in prison Thursday, according to the Star. He'd been charged with second-degree murder, child abuse and endangering the welfare of a child after his son was found with bruises covering his body -- including his head, torso, legs and genitals -- last May.
