A 23-year-old man was charged today with first-degree child
abuse for injuries that critically injured a 7-week-old girl, according
to the Wayne County Prosecutor's Office.Deangelis Devin Nicholas, of
Brownstown Township, was arraigned in 33rd District Court on a charge of
first degree child abuse stemming from the Aug 1 assault on the infant
daughter of his girlfriend. The baby, Isabella, is in critical
condition due to severe brain trauma. On Sunday, the infant was rushed
to Henry Ford Hospital in Brownstown after a 9-1-1 to the Fire
Department about a child that was not breathing. The baby was
stabilized at the medical center and then transferred to Children's
Hospital in Detroit, where officials found signs of child abuse.
Before the incident, Isabella had been released Saturday from the
hospital after surgery to repair a heart abnormaility and was recovering at home in
the 17100 block of Higdon, according to Barbara Hedgecock, the child's
grandmother. Brownstown police were called into the case on Monday. First-degree
child abuse is punishable by up to 15 years in prison. Nicholas was
ordered held in the Wayne County Jail in lieu of $300,000 cash or surety
bond. A preliminary examination was set for Aug. 17.

The struggle for life for 7-week-old Isabella Marie Hayes is over.

The Brownstown Township infant died early Saturday morning at Children’s
Hospital of Michigan in Detroit. Her death could turn a suspected child
abuse case into a homicide case.

Devin Nicholas Deangelis, 23, of
Brownstown Township was arraigned Wednesday in 33rd District Court on a
charge of child abuse. At that time, Brownstown Township Detective Lt.
Robert Grant said Deangelis could face a homicide charge if Isabella died.

Grant could not immediately be reached for comment.

Maria Miller, a spokeswoman for Wayne County Prosecutor Kym Worthy, said her
office has not yet received a revised warrant request seeking to have
any charges enhanced.

Visitation is set for 4 to 8 p.m. Monday at
the Taylor Chapel of the Howe-Peterson Funeral Home, 9800 S. Telegraph
Road. The funeral is set for noon Tuesday. Services are open to the public.

Murder charges have been filed against the Brownstown Township man
accused of assaulting his girlfriend’s 7-week-old daughter on Aug. 1.

Deangelis Devin Nicholas, 23, was charged today with first- and
second-degree murder, according to the Wayne County Prosecutor’s Office.
Nicholas, who was previously charged with first-degree child abuse, is
expected to be arraigned on the more serious charges this afternoon in
33rd District Court in Woodhaven.
If convicted on the murder charges, Nicholas could face up to life in prison.
Isabella Hayes died early Saturday at Children's Hospital of Michigan in Detroit.

A man facing murder charges in the death of an 8-week-old baby is free on bond.
Bond for Devin Deangelis, 23, of Brownstown Township was set at $30,000 cash
bond Friday before Wayne County Circuit Judge James Calahan.
Deangelis is facing felony murder, second-degree murder and child abuse charges
in the Aug. 7, 2010, death of Isabella Marie Hayes. He was released
after Friday’s hearing, township police said Monday.
Deangelis was the live-in boyfriend of the infant’s mother, Kelly Hayes. He was not Isabella’s father.
Deangelis was charged Aug. 1 with child abuse when the infant, then 7 weeks old,
was admitted to Children’s Hospital of Michigan in Detroit with a skull injury.
Bond was set at $300,000, which was posted.
But, when Isabella died a week later, the felony and second-degree murder charges were added.
Deangelis then was remanded without bond by 33rd District Judge James Kersten and bound over to Wayne County Circuit Court.
An arraignment was held later that month in circuit court and bond again was denied.
Isabella was born with a severe heart condition and had been hospitalized since her birth. She was released July 31.
The next day, she was rushed to a hospital after Deangelis called Hayes and
said the infant wasn’t breathing right. Hayes had just gone to a nearby store.
Brownstown police Lt. Paul Lazar said Deangelis changed his story several times about what happened to Isabella.
Lazar said Deangelis first told him that the infant hit her head on a coffee
table as he leaned down to change her diaper. He also told police that
her head hit the coffee table after he tripped on a dog toy, Lazar said.
Lazar said Deangelis also changed his story as to when the head injuries might have occurred.
According to police, Deangelis did not tell anyone for about six hours that the infant had suffered a head injury.
Hayes’ family members said before he was bound over for trial that she and Deangelis had been together for less than a year.
At that time, the family said there were no indications that Deangelis mistreated Hayes or the baby.
Hayes’ sister, Amanda, was the first to hold her niece after she was born.
Amanda Hayes said her sister and Deangelis were engaged quickly, and this situation came “out of the blue.”
Although she said she did not detect any serious problems, she added that Deangelis often was caught in lies.
Barbara Hedgcock, Hayes’ mother, stressed that her daughter had a support system if she needed help.

On Friday, a judge decided to grant Deangelis a $30,000 bond. He paid the money and is free from prison without any restrictions.

The child's mother, Kelly Hayes, said she is living a nightmare knowing the man she said killed her daughter is free to run."This is hell on Earth right now," Hayes said. "They are basically giving him the chance to run."

Wayne County prosecutors said they objected to Judge James Callahan's ruling to let Deangelis out of jail before his trial.Callahan offered no explanation for his decision to set Deangelis free.

In August, Hayes' daughter, Isabella, was rushed to Children's Hospital in Detroit, where she was diagnosed with brain damage from a skull fracture and the symptoms of shaken baby syndrome, doctors said. She later died.

The medical examiner determined her death was from blunt force trauma to the head.

Deangelis was arrested and charged with child abuse and first-and second-degree murder.

"That's the worst feeling as a parent," Hayes said. "Especially when you're child's murdered."

Hayes said she is in hiding because she said the judge gave her ex-boyfriend a chance to come after her.

DETROIT: Former boyfriend found guilty of killing ex-girlfriend’s baby in Brownstown Township

DETROIT — A jury has found an ex-boyfriend guilty of involuntary manslaughter and second-degree child abuse in the death of his former girlfriend’s daughter, Isabella Marie Hayes.

The verdict for Devin Nicholas Deangelis, 26, of was announced Wednesday in Wayne County Circuit Court.

Sentencing is scheduled for Jan. 2.

According to the Wayne County Prosecutor’s Office, sentencing guidelines are determined by the judge after arguments by the prosecution and defense at the sentencing hearing. It will not be known how the judge will score them until the day of sentencing.

Brownstown Township Detective Paul Lazar investigated the case, which occurred in that community, and testified during the trial.

He said Thursday it was a long process before the case went to trial.

“It’s been a long time, but I’m satisfied with the outcome,” Lazar said.

The detective said there were several typical court delays. He said the fact that Deangelis’ attorneys were involved with the case involving former Detroit Mayor Kwame Kilpatrick also caused a delay.

Deangelis originally was charged with felony murder, second-degree murder and first-degree child abuse, but the jury found him guilty of lesser charges.

Although Deangelis did not testify in the case, Lazar said video-recorded interview showing him offer different accounts of how the baby’s head was injured was played for the jury.

“Jennifer Tink (assistant Wayne County prosecutor) did an outstanding job in the case,” Lazar said.

The detective was not present for the verdict, but said he will be there for the sentencing.

The case dates to Aug. 7, 2010, when Deangelis was the live-in boyfriend of Kelly Hayes, the mother of little Isabella. Deangelis was not the infant’s father.

The 8-week-old infant was born with a severe heart condition and had been hospitalized since her birth.

The day after her release she was rushed back after Deangelis called Hayes and said the infant wasn’t breathing right. Hayes had just gone to a nearby store.

Upon the infant being taken to a hospital, police said, Deangelis told different accounts of what happened to the baby.

At that time, Lazar said, Deangelis first told him that the infant’s head hit a coffee table as he leaned down to change her diaper.

He also told police that her head hit the coffee table after he tripped on a dog toy, Lazar said.

The detective said Deangelis also changed his story as to when the head injury might have occurred.

Hospital personnel first thought Isabella’s problems stemmed from her heart ailment, but later discovered her skull was fractured just above her ear.

According to police, Deangelis did not tell anyone for about six hours that the infant had suffered a head injury.

Deangelis and Hayes had been together for less than a year.

Members of her family said at the time that there were no indications that Deangelis had been abusive to Hayes or her daughter.

Just prior to the preliminary examination of the evidence against Deangelis at 33rd District Court in Woodhaven, a relative said Hayes and Deangelis were engaged rather quickly and said there were no indications of trouble of any kind.

Isabella was born with a heart problem requiring surgery. She had been a patient at Children’s Hospital since her birth.

After seven weeks, Isabella finally was released from the hospital, only to return less than 24 hours later with a head injury.

She never returned home again, dying a week later.

Former Grosse Ile resident Devin Deangelis was sentenced Wednesday to three to 15 years in prison for involuntary manslaughter, and three to 10 years on a charge of second-degree child abuse in the 2010 death of his ex-girlfriend’s 8-week-old daughter, The News-Herald reported.

A jury found Deangelis, 26, of Brownstown Township, guilty Dec. 11 in Wayne County Circuit Court. Judge James Callahan presided over the case.
