Two people have been charged in connection with the abuse and assault of a two-year-old boy who died Monday from his injuries, including the boy's mother.
Birmingham Police, in a statement Monday, said Demarcus Williams, 20, of Birmingham, and Erin Wills, 25, of Birmingham, have been charged in connection with the abuse and assault of Antauan Palmore, two, of Birmingham. Police said Wills was Palmore's mother.
Police said investigators were called in after the toddler was transported Thursday to Children's Hospital by Birmingham Fire and Rescue after suffering extensive head injuries. He died Monday.
Investigators said Williams was charged with assault and Wills was charged with child abuse.  Williams was being held Monday in the Jefferson County Jail on $500,000 bond. Wills was released on $15,000 bond.

The boyfriend of a mother of a 2-year-old who died at Children's Hospital has been charged with capital murder in the child's death, according to Birmingham police.

Antauan Palmore was pronounced dead Monday afternoon, four days after he was hospitalized with extensive head injuries.

Demarcus Williams, 20, of Birmingham was charged with assault before the child died. Today, capital murder charges were filed against Williams, the boyfriend of Antauan's mother, Erin Wills.

Wills, 25, has been charged with child abuse in the case and is out of jail on $15,000 bond.

Birmingham police spokesman Sgt. Johnny Williams, Jr. said police do not expect to file additional charges against Wills.

"If the charges against her were going to change, I think it would have changed today," Sgt. Williams said

BIRMINGHAM | A Jefferson County judge dismissed a child abuse charge against a mother in the beating death of her 2-year-old son, but allowed a capital murder case to proceed against her boyfriend.

District Judge Sheldon Watkins ruled that evidence concerning the Sept. 16 fatal beating of Antauan Palmore did not support a charge of felony child abuse against the mother, Erin Wills, 25.

A Birmingham police detective testified that Wills told police she left her boyfriend, Demarcus Williams, in charge of Antauan and two siblings while she attended a church revival.

Demarcus Williams, charged with capital murder, turns down plea deal in the 2010 beating death of 2-year-old Antauan Palmore.

BIRMINGHAM, Alabama - A Birmingham man charged with capital murder in the 2010 beating death of a 2-year-old boy turned down a plea deal today that could have helped him avoid a life in prison sentence without the possibility of parole if convicted. He now faces the likelihood of a trial.

DeMarcus Williams, 23, told Jefferson County Circuit Court Judge Stephen Wallace that he did not want to accept the plea offered by Deputy Jefferson County District Attorney Michael Streety. The plea deal would have called for reducing the charge to intentional murder with a 20-year sentence, Streety said.

Williams had countered with an offer of manslaughter with a 20-year split sentence, with three years to serve in prison, his attorneys William Jordan Brower and William Scott Brower said.

Streety told the judge he declined that counter offer and that his offer would not be available after today. "I will never entertain that offer again," he said.

Wallace asked Williams if he understood that if convicted the only sentence the judge could impose on him would be life without the possibility of parole. The judge earlier this year had ruled the state could not seek the death penalty in the case because of Williams' mental retardation.

Williams told the judge he understood. His mother was with him when the offer was made, but Williams said he made the decision on his own. "I'm not going to take it," Williams said.

"We support our client's decision to go to court," Scott Brower said.

Wallace denied a request by Scott Brower to allow Williams, who has been in jail about three years awaiting trial, to be released on bond. The judge has not ruled on two other motions by Williams' defense attorneys. One motion seeks the suppression of statements made by Williams to police and the other seeks to have Williams declared incompetent to stand trial.

Wallace said he would rule on the motions, and set a trial date, at a later time.

Williams is charged in the 2010 beating death of his girlfriend's 2-year-old son, Antauan Palmore.

The boy's mother told Birmingham police that she left Williams in charge of Antauan, and siblings ages 4 and 5, while she attended a church tent revival. When she returned, she saw Williams squeezing Antauan's torso and hitting him, police said.
