California officials have located a 13-year-old Clearfield girl who was listed as endangered and missing after family reported she may have run away with a 30-year-old man. Astrid Valdivia, a student at North Davis Jr. High, had left a note for her family on Sept. 24 saying she was running away from home and staying with a friend. She was last seen at school by her 15-year-old sister. New information from the family indicated that she may have developed a relationship with 30-year-old Anthony Allen Martinez.

Police reported Tuesday that Martinez has a history of violence. The Davis County Child Abduction Response Team and Clearfield police detectives identified a possible location for Martinez Tuesday night and Sacramento officers responded to the area and located both Martinez and Valdivia. Police said Martinez attempted to flee on foot but was quickly apprehended by officers and was taken into custody for investigation of resisting arrest and child endangerment. Clearfield police plan to seek an arrest warrant for Martinez for child kidnapping. The victim is safe and will be reunited with her family as soon as possible.

Martinez, who was driving a 1994 Plymouth Voyager, was rumored to be with a 13-year-old girl who was missing from a foster home, according to a story in the Deseret News published on Friday.
The girl had been listed as missing and endangered Friday, according to Gary Keller, a spokesman for the South Salt Lake police. She'd run away to California with Martinez before and her family had a protection order against him, the Deseret News said.
A woman, who law enforcement said was a teenager, was also shot, and she died at Tacoma General Hospital. But she has yet to be identified, Hedstrom said.

SOUTH SALT LAKE -- A man charged with abducting a 13-year-old Clearfield girl in September has been shot dead by police in Port Orchard, Wash., along with a teenage girl who has not been identified.

Anthony Allen Martinez, 30, exchanged gunfire with Kitsap County
sheriff's deputies Sunday afternoon in a Walmart parking lot after
someone reported him as a suspicious person.
Two deputies found Martinez and tried to talk to him, but he began running and they gave chase.
"As they were getting ready to handcuff him, he flung out and started
running towards the woods and, like, looking back, and pulled a gun out
of his jacket and looked back and started shooting at the cops," said
witness Emile Jones.
Two deputies fell wounded, a third returned fire. The teenage girl ran to Martinez and was hit in the crossfire.
Tacoma police said the deputies were both shot in the torso and were in satisfactory condition.
Martinez died at the scene, and the girl died later at a Tacoma hospital.
Authorities said it wouldn't known who shot the girl until a ballistics
analysis was completed. Autopsies were scheduled Monday for Martinez and
the girl.
Washington State Patrol Trooper Krista Hedstrom said investigators had
not been able to identify the girl through photographs or fingerprints,
and did not expect to confirm her identity Monday.

"We believe that she and the deceased gunman knew each other, that they
were together,"
sheriff's spokesman Scott Wilson told The Associated
Press.
Martinez was charged in October in 2nd District Court with child
kidnapping, a first-degree felony, after authorities found him in
Sacramento, Calif., with Astrid Valdivia, a student at North Davis
Junior High School. A hearing in that case was set for Wednesday.
According to court records, prosecutors were also screening possible federal charges against Martinez.
Officials have not said if Valdivia is the girl who was with Martinez in
Washington. She went missing last week from a South Salt Lake foster
home. Police said she disabled a tracking monitor.
The pair was believed to be traveling in a blue van that was the same
model as a van towed from the scene of the shooting, according to
Hedstrom.
Department of Human Services spokesman Liz Sollis confirmed that
Valdivia was in custody of the Division of Child and Family Services. In
most cases, children in DCFS custody as a result of dependency or
neglect allegations are required to wear tracking monitors. Only about
one in 20 children in foster care in Utah run away, according to DHS
statistics.

13-year-old Utah runaway may be girl fatally shot



Authorities were trying to determine Monday if
the teenager fatally shot Sunday in Port Orchard was a 13-year-old girl
believed to have run away from the Salt Lake City area with a
31-year-old man killed in the shooting.

The man, Anthony A. Martinez, who was killed by a Kitsap County
sheriff's deputy during the shootout outside a Walmart store, already
was facing felony charges of kidnapping the girl last year in Utah when
they apparently again took off together last week.
The State Patrol, which is overseeing the investigation, said the girl did not carry identification.
Trooper Krista Hedstrom, a State Patrol spokeswoman, said
investigators were talking with authorities in the Salt Lake City area
to find out more about Martinez and the girl. Hedstrom could not confirm
the dead girl was the same girl who ran away from a Clearfield, Utah,
foster home last week, but said "there is a possibility." It might take
up to a week for investigators to locate dental records and positively
identify the girl, said Hedstrom.
Martinez wounded two sheriff's deputies before he was killed by a
third deputy, according to the Sheriff's Office. The girl died from
gunfire during the shootout, but it wasn't immediately clear who fired
the fatal shots.
Kitsap County sheriff's spokesman Sgt. Scott Wilson said one of the
two wounded deputies was released from Tacoma General Hospital on
Monday. The deputy has been with the department since September 2001,
Wilson said.
The other injured deputy, who was hired by the Sheriff's Office in
July 2004, remained at Tacoma General Hospital and could be released as
early as Tuesday, Wilson said.
Neither deputy will be identified by the Sheriff's Office until Tuesday, Wilson said.
Deputies went to the Walmart around 3:45 p.m. Sunday after someone
inside the store dialed 911 to report seeing a suspicious man outside
carrying a gun. Two deputies found the armed man in the store's outdoor
designated smoking area, authorities said.
Witnesses Destany Droge, 22, and Emmili Jones, 20, said they had just
left the store when they saw two deputies talking to a heavyset man
dressed in a black beanie cap and a black-and-white puffy jacket. The
two women said the deputies were trying to escort the man toward a blue
minivan when he started to run toward a wooded area.
The man, in midsprint, pulled out a gun and fired behind his back
over his shoulder without turning to look where the shots were going,
Wilson said. The two deputies were hit.
Wilson, the sheriff's spokesman, said the third deputy, a female who
has been with the Sheriff's Office nearly 10 years, then shot and killed
the gunman. The female deputy, who was placed on administrative leave
while the shooting is investigated, wasn't hurt.
Witnesses Droge and Jones said a young woman then ran into the
chaotic scene and toward the gunman as he was collapsing, and fell near
him after she was shot.
An autopsy was conducted on the girl's body Monday, according to the
Pierce County Medical Examiner's Office, which is handling the autopsy
because she died at a Tacoma hospital.
Her name will be released once her family is notified, the Medical Examiner's Office said.
The autopsy also is expected to shed light on who shot the teen,
law-enforcement officials said. The State Patrol is investigating the
shooting because of the deputies' involvement.
The 13-year-old girl believed to be with Martinez fled her foster home last Tuesday.
South Salt Lake police Sgt. Gary Keller said she had been placed in
the foster home after she was found with Martinez in Sacramento, Calif.,
last fall. Martinez was arrested on a felony child-kidnapping warrant
filed by South Salt Lake police detectives.
He pleaded not guilty to the charge in November, posted a $25,000 bond and was released, according to court records.
Martinez was issued a no-contact order to stay away from the girl, said Clearfield, Utah, Assistant Police Chief Mike Stenquist.
The girl was fitted with a GPS ankle bracelet but managed to slip out of it when she left the home last week, he said.
A flier released by the department said she may be with Martinez, and
provided a description of a van that closely resembled the vehicle
found by police in the Walmart parking lot Sunday.
"We haven't been able to confirm she was traveling with him, although we suspect it," Keller said.
Martinez was a friend of the girl's mother and had been living with
the family. He and the girl "apparently considered themselves boyfriend
and girlfriend," Stenquist said.
Martinez's criminal history includes convictions for felony drug
charges and misdemeanor aggravated assault, according to The Salt Lake
Tribune.
Martinez's brother, Barrett Martinez, told The Salt Lake Tribune that
his brother is being wrongly characterized as a violent pedophile.
Barrett Martinez said his brother was attempting to save the girl from a troubled home life.
It was not the first time his brother helped the girl escape a bad situation, Martinez said.
He told The Tribune his brother ended up in California with girl not
to pursue a sexual relationship but rather to prevent the girl from
following through on suicidal threats.
“He was trying to help her. We told him to call [the Department of
Child and Family Services]. He felt that no one would listen to him,
that he was being characterized as a pedophile,” said Martinez, who
spoke with his brother about two weeks ago. “She said if he didn’t help
her, she’d kill herself.”
When a Salt Lake City TV crew showed up at the girl's home Monday,
they were blocked from the mobile-home park. Reporter Sarah Dallof said a
note was posted on the door, but she couldn't get close enough to read
it.
Ryan Hansen, the principal at North Davis Junior High School, which
the girl had attended until her disappearance last fall, said there "are

Martinez was charged in October in 2nd District Court
in Davis County with child kidnapping, a first-degree felony, after
authorities found him in Sacramento, Calif., with Astrid Valdivia, a
Clearfield resident who had left a note saying she was running away.
Martinez, who was free on $25,000 bail, was scheduled to appear in court
Wednesday on that case.

On Jan. 18, Valdivia ran away from her South Salt
Lake foster care home. It was clear she had planned it out, said South
Salt Lake police detective Gary Keller. She cut off her ankle monitor
and packed all of her possessions, he said. She was last seen about 10
p.m.
It was unclear Tuesday who issued the ankle tracking
device. The Division of Child and Family Services does not place ankle
monitors on children placed into foster care. However, juvenile court
judges can order them for children. Once a court order is given, the
agency with custody of the child contracts with providers to monitor
compliance, according to court officials.

Keller did not know Tuesday whether Valdivia had been
communicating with anyone prior to running away via text messages or
e-mails. He did not know if investigators had been able to check any of
those records as of Tuesday.

As of Tuesday afternoon, Valdivia's missing person case was still considered active.

The deputies shot in Washington are expected to make full recoveries.

Tuesday, the Kitsap County Sheriff's Office released more information about the three deputies involved in the incident.
Deputy Andrew Paul Ejde, 48, was shot in his left
shoulder and right arm. He was listed Tuesday in satisfactory condition
at Tacoma General Hospital and was expected to be released sometime
within the next two days to continue his recovery at home.

Deputy John Roy Stacy, 50, was shot in the right shoulder. He was released from Tacoma General Hospital Monday afternoon.

Deputy Krista Rae McDonald, 38, is on standard paid
administrative leave pending an investigation into the shooting.
McDonald fired at Martinez after her fellow deputies had been shot,

The parents of a missing Utah teenager say they are nearly certain

Barrett Martinez told reporters Monday that his
brother was not a pedophile, but was just trying to help the girl
because she was going through many difficulties, including thoughts of
suicide. But a spokesman for Astrid's family said he had no business being with her.
"If I called somebody and said I'm going to take my
life, what's the first thing you're going to do? Are you going to take
me out of the state twice when I'm 13 years old? Or are you going to
call somebody and get that taken care of?" said family friend and
spokesman Christopher Bateman.
"I don't believe that. I think it's a complete lie.
He kidnapped this little girl," he said. "She might have gone with him,
but I think there was some brainwashing involved. ... Thirteen-year-old
girls just don't run away with 31-year-old men and call them her lover."
Bateman said Anthony Martinez was a friend of
Astrid's mother when Astrid was about 4 years old. He never lived with
the family, Bateman said, and Astrid had not seen or communicated with
him until they ran into each other in April of last year at a store. The
family was unaware of any contact between them until she ran away with
him the first time."Obviously they were communicating because she ran away with him in
September, but we have no idea how," Bateman said. "They say that they
were lovers. That's been said many times. We don't know the exact relationship."

Bateman described Astrid as a typical teenager who
loved music, smiled a lot, was close to her sister and brother and "loved everything."
"She was a good person and it's really hard to even
imagine a 13-year-old girl in this situation," he said. "Even if it she
wasn't (taken) against her will, it's probably still a hard situation for her."
He said the family is anxious to receive an official confirmation and have her returned to Utah.
"This is a horrible tragedy for them," he said. "They just need some peace."

PORT ORCHARD, Wash. -- The family of a 13-year-old girl who ran away
with a man killed in a shootout with police over the weekend believes
their daughter was the other person killed by the gunfire.

Chris Bateman, a spokesman for Astrid Valdivia's family, said investigators
have told the family that Astrid was likely the other person killed
along with 31-year-old Anthony Martinez at a Walmart store in Port
Orchard on Sunday.

"We have been told that it is her, 100 percent," Bateman said. "The only reason that we do not have her, or
have any confirmation is because of technicalities that the coroner has
to go through."

He said pictures of the victim were also a match to Astrid.

"They're grieving," he said of the girl's family. "We've come to accept that
she's no longer with us, that it was her in the shooting, unfortunately."

Investigators have not released the name of the female victim, saying only that they are waiting on dental records from Utah to make a positive identification.

The Valdivia family is sending Astrid's dental records to investigators, Bateman said.

Astrid had been listed as an endangered runaway by police in Utah and she was believed to be on the run with Martinez.

Bateman said Martinez had been in a relationship years ago with Valdivia's
mother, but the family was not aware that Martinez and the girl had kept
in contact after the relationship with her mother ended.

"It's really difficult," Bateman said. "We had no idea any of this communication between Anthony and Astrid was going on."

The family first learned of the contact between the two in September, when
Astrid ran away from home. She was found with Martinez a month later and
placed in foster care.

"That was for her protection," Bateman said. "Astrid, I feel, was brainwashed. She wanted to be with Anthony."

Astrid's mother has two other children who remain in her care, according to Bateman.

Martinez attempted to run away when police found Astrid with him in October, but
officers caught him. In November, he pleaded not guilty to a
first-degree felony charge of child kidnapping. He posted bail and was
released from custody.

Astrid ran away from the foster care facility on January 18 and police believed she was back with Martinez.

Martinez remained on the run until Sunday, when Kitsap County sheriff's deputies
answered a call about a suspicious person at the Walmart store in Port
Orchard.

Two deputies located Martinez and tried to talk to him but he began running, pursued by the deputies.

"For reasons not yet known, the suspect turned and fired multiple shots," sheriff's spokesman Scott Wilson said.

Two deputies were wounded, and a third deputy fatally shot Martinez.

Investigators have not said who fired the shot that killed the girl.

Clearfield police said Wednesday that
they have no evidence to suggest a sexual relationship existed between a
man shot by police in Washington state earlier this week and a missing
13-year-old girl believed to have been with him.

Astrid Valdivia’s family has said that the
girl was in a romantic relationship with 30-year-old Anthony Allen Martinez. But Martinez’s family has said he was in a relationship with
Astrid’s mom, Jacquelin Rimola, and was a "stepfather" to Astrid and her
sister.

Police reports obtained by The Salt Lake
Tribune on Wednesday show that officers responded to a report of an
assault at the Valdivia home in Clearfield on Aug. 12, 2010.

When they arrived at 446 N. 1300 West #113,
Martinez was there. He told police he was at the home of his girlfriend,
Jacquelin Rimola.

Martinez told police that Rimola had ordered
him to hide when her husband or boyfriend, Gregorio Valdivia arrived
just after 2 p.m.

Martinez said he hid in a closet but Gregorio Valdivia found him and hit him.

Valdivia admitted to police that he hit Martinez after finding him in the closet, "but said it wasn’t very hard."

Martinez told police he didn’t want to file charges against Valdivia.

Teen girl killed in Walmart shooting identified as Utah runaway


PORT ORCHARD, Wash. -- The Pierce County Medical Examiner has identified the teenage girl killed in a Port Orchard Walmart shooting as Astrid Valdivia, a 13-year-old runaway from Utah.
Officials say Valdivia died of multiple gunshot wounds and the manner of death "homicide."
A Kitsap County Sheriff's Deputy Andrew Ejde was wounded in the shooting earlier this week with gunshot wounds to his left shoulder and right arm. He was recovering in a hospital. Another officer, Deputy John Stacy, was released Monday.

Deputy Krista McDonald is believed to have shot and killed the suspect, Anthony Martinez of Salt Lake City.
The family of Astrid Valdivia told KING5's Utah affiliate in Salt Lake they had believed the girl who died was their daughter and that she had been brainwashed.

"Thirteen-year-old girls don't just run away with 30-year-old men and call them her lover," said the spokesman for the family.

Investigators still haven't said who fired the shots that killed the teenager.

The remains of a teen shot and killed in front of a Washington State
Walmart on Jan. 23 has positively been identified as Astrid Valdivia,
the 13-year-old runaway from Clearfield.

The Pierce County Wash., Medical Examiner confirmed the girl’s identification on Friday, based on medical records.

Valdivia disappeared from a South Salt Lake foster home on Jan. 18, when she cut an ankle monitor and took all her belongings.

Police believed she had left with Anthony Allen Martinez, 30.

On
Sunday police in Port Orchard, Wash., were called to the Walmart on a
report of a suspicious person. About 45 minutes later there were reports
of shots fired and officers down.

Later reports said that when
officers tried to contact Martinez he fled across the parking lot on
foot, turned and fired multiple shots at pursuing deputies with a
semi-automatic handgun, police said.

A third officer fired at Martinez, killing him.

Police say when Martinez was shot, the girl now identified as Valdivia, ran to him, getting hit by bullets in the crossfire.

The trip to Washington state wasn’t the first time the teen and Martinez had run away together.

Police
found them in Sacramento, Calif. in October. They were brought back to
Utah, where Valdivia was placed in foster care and Martinez was charged
with kidnapping.

He was to have been in court on Jan. 24 on those charges.

Kidnap suspect killed Utah girl, self in Wash. shootout


A 13-year-old Utah girl killed outside a Washington state Walmart store earlier this year was shot twice by the man accused of kidnapping her, who then shot and killed himself, a top prosecutor says.

“The investigation shows that the bullets that killed Ms. [Astrid] Valdivia and Mr. [Anthony Allen] Martinez were fired by Martinez,” Kitsap County Prosecutor Russell D. Hauge said Thursday.

Earlier this week, Washington State Patrol investigators completed their report on the Jan. 23 shootout in Port Orchard, Wash., and handed the investigation to prosecutors to determine if police would bear any criminal liability.

While initial reports indicated police shot and killed Martinez, 31, Hauge said the fatal bullet came from the man’s own gun.

“Ballistics show he was struck by two different bullets,” Hauge said. “One that struck him in the knee or lower leg, disabling him, came from [a deputy’s] weapon. There was another bullet that struck the center chest, through his heart. That bullet was recovered, and it matches the bullets fired from his own gun.”

The prosecutor said that weapon was also used to kill Valdivia.

“She was shot twice, and both shots were fired by Mr. Martinez at relatively close range,” Hauge said.

Two deputies were wounded during the shootout before a third opened fire, hitting Martinez, officials said.
