FBI finds 3 girls in child sex trafficking sting

PORTLAND, Ore. (AP) — The FBI says it recovered three girls in a child sex trafficking sting operation that resulted in prostitution charges against 19 adults in the Portland area.
FBI agents said they worked with more than a dozen other local and federal agencies in the Portland and Vancouver, Wash., metro area to run the sting last Thursday through Saturday.
The Portland metro operation was part of Operation Cross Country 5, marking the fifth national law enforcement action against child sex trafficking.

A 48-year-old Tampa, Fla., man formerly from Buffalo was sentenced to just shy of 22 years in federal prison for receiving child pornography in an incident where he also engaged in a sexual relationship with a 14-year-old girl and lured her from her home, U. S. Attorney William J. Hochul Jr. reported Monday. Brian L. McGaughey admitted to receiving pornographic images of the girl on his cellular phone after having a sexual relationship with her for more than a year, according to Assistant U. S. Attorney Marie P. Grisanti. McGaughey, who was previously convicted of attempted rape in 1989 and was paroled after nearly two years in prison, was sentenced to 21 years, 10 months, with a lifetime sentence of supervised release by U. S. District Judge Richard J. Arcara. The victim was located at Buffalo Niagara International Airport as the result of an Amber Alert, federal authorities said. McGaughey arranged for the minor to travel to Puerto Rico, where he planned to meet her at a later date, according to the report.

NEW YORK (AP) — Amazon.com Inc. is selling a self-published guide that offers advice to pedophiles, and that has generated outrage on the Internet and threats to boycott the retailer.
The availability of "The Pedophile's Guide to Love and Pleasure: a Child-lover's Code of Conduct" calls into question whether Amazon has any procedures — or even an obligation — to vet books before they are sold in its online stores. Amazon did not respond to multiple e-mail and phone messages.
The title is an electronic book available for Amazon's Kindle e-reader and the company's software for reading Kindle books on mobile phones and computers. Amazon allows authors to submit their own works and shares revenue with them.
Amazon issues guidelines banning certain materials, including those deemed offensive. However, the company doesn't elaborate on what constitutes offensive content, saying simply that it is "probably what you would expect." Amazon also doesn't promise to remove or protect any one category of books.
The author of "The Pedophile's Guide," listed as Philip R. Greaves II, argues that pedophiles are misunderstood, as the word literally means to love a child. The author adds that it is only a crime to act on sexual impulses toward children, and offers advice that purportedly allows pedophiles to abide by the law.
Many users on Twitter called on Amazon to pull the book, and a few threatened to boycott the retailer until it does.
Child online safety advocacy group Enough is Enough says it isn't surprised that someone would publish such a book, but believes that Amazon should remove it. It says selling the book lends the impression that child abuse is normal.
This isn't the first time Amazon has sold material that promotes illegal activity. It is currently accepting pre-orders for the hardcover version of "I Am the Market: How to Smuggle Cocaine by the Ton, in Five Easy Lessons" by Luca Rastello.
Nor is it the first time Amazon has come under attack for selling objectionable content in its store. In 2002, the United States Justice Foundation, a conservative group, threatened to sue Amazon for selling "Understanding Loved Boys and Boylovers." That title is still available through Amazon.
In 2009, Amazon stopped selling "RapeLay," a first-person video game in which the protagonist stalks and then rapes a mother and her daughters, after it was widely condemned in the media and by various interest groups.

ST. ALBANS - Multiple times, St. Albans Police and the parents of a missing 11-year-old boy went Tuesday evening to the Nason Street home of 34-year-old Misty Smith, who said each time the boy was not there. The boy had been seen earlier leaving St. Albans Town Educational Center and heading to Smith's home, police said.Tuesday evening, police returned to the home and heard noises upstairs. They spoke to Smith and then found the missing boy in a bedroom, where he had been the entire evening, Chief Gary Taylor said.
Now, Smith is being held on $250,000 cash surety bond at Northwest Correctional Center, arrested on charges including aggravated sexual assault on a child, lewd and lascivious conduct with a child, simple assault, selling and dispending to minors, second-degree unlawful restraint, kidnapping/unlawful sheltering, aiding a runaway child, contributing to juvenile delinquency and furnishing alcohol to minors.
In all, the child's parents had gone to Smith's home three times and been told the boy was not there, police said.

OCALA, Fla. -- Immigration agents have arrested a Belgian man in north Florida wanted in his home country for child rape and extortion.
U.S. Immigration and Customs Enforcement reports that agents picked up 31-year-old Andy Vertoont while he was at work in Ocala.
Authorities say Vertoont is wanted in Belgium for raping a 12-year-old boy in June 2009. He is also accused of threatening a person with violence unless they paid him 12,000 euros ($17,000).
Vertoont was previously convicted in Belgium in 2001 for raping two children.
ICE reports that Vertoont entered the U.S. in October 2009 on a 90-day visa waiver but stayed longer without authorization.
Vertoont remains in ICE custody until he can be sent back to Belgium.

DENVER (AP) — Police are investigating whether the author of a guide for pedophiles did anything illegal even as they try to protect him from a threat posted on a local website.
Phillip Ray Greaves II of Pueblo has drawn national attention because his self-published book for sale on Amazon offers advice to pedophiles on how to make a sexual encounter with a child as safe as possible.
Pueblo police heard news reports about the book and went to Greaves' home Thursday morning to interview him. Pueblo Detective Dustin Taylor described Greaves as cooperative and said he gave detectives a copy of the book when they asked for one.
"He was just a normal man. He didn't seem unnerved by us being there," Taylor said.
Police told Greaves that he'd been threatened on a local website and that they would monitor his home for his safety. Taylor said the author didn't seem fearful. Police would not elaborate on the threat, and the message was removed from the website, Taylor said.
Greaves, 47, has no criminal record and is not a registered sex offender, Taylor said. Taylor said authorities kept the book but don't expect criminal charges at this point.
"At this point we're still reviewing it, though there's still no indication of any crime being committed," Taylor said.
The book, "The Pedophile's Guide to Love and Pleasure: a Child-lover's Code of Conduct," includes first-person descriptions of such encounters, purportedly written from a child's point of view.
Greaves argues that pedophiles are misunderstood, as the word literally means to love a child. He adds that it is only a crime to act on sexual impulses toward children, and offers advice that purportedly allows pedophiles to abide by the law.
Greaves also self-published other books on Amazon and was a frequent writer to the Pueblo Chieftain editorial page. His letters to the editor were mostly about local matters and the role of government. Last month, Greaves wrote a letter calling for criminal fines to go to "randomly selected charities" instead of the government.
Amazon has declined comment to The Associated Press. Greaves also declined an interview but told The Smoking Gun website on Wednesday that he suffers from depression and that he had sexual contact with children while still a child himself.
The website said that when asked if he had engaged in sexual acts with children as an adult, Greaves first said "could have" before saying that he hadn't. He also said he suffered a mental collapse about three years ago while working as a nursing home aide.
Greaves said he had only sold one book and insisted it doesn't advocate for adults to harm children.
"The best advice I can give a pedophile is, accept that masturbation is your best friend," Greaves told The Smoking Gun.

New sex-abuse suit filled against retired priest
A 39-year-old man claims Rev. Neil Doherty -- already awaiting trial for sex-abuse charges -- repeatedly drugged and raped him in the mid-1980s.
A retired Roman Catholic priest, who is in jail in Broward County awaiting trial on sexual-abuse charges and who has been named in 24 sexual-abuse lawsuits, has been named in a new lawsuit.
In a complaint filed Friday against the Archdiocese of Miami, a 39-year-old man identified only as ``John Doe No. 69'' says the Rev. Neil Doherty, 67, repeatedly drugged and raped him in the mid-1980s.
The lawsuit says the accuser, who was 14 and 15 years old at the time, was a runaway and met Doherty at Keystone Trailer Park in Miami, where Doherty would don a priest's collar and ``cruise the area of the trailer park in his car.''
At the time, Doherty was assigned to St. Mary's Cathedral in Miami. ``The victim is still struggling,'' said his attorney, Jeffrey Herman, who said he will file two more lawsuits naming Doherty ``in coming weeks.''
The lawsuit says the archdiocese knew Doherty was abusing boys in the 1970s but ``continued to place Doherty in roles with access to minors.''
The archdiocese's knowledge of past accusations against Doherty surfaced in a 2003 memorandum by the Broward state attorney's office in which a sex-crimes prosecutor disclosed a $50,000 settlement in 1994 with a student who had been enrolled at Chaminade High School in Hollywood decades earlier.
Herman has filed dozens of cases against the archdiocese, including most of the ones that name Doherty. At least half the cases involving the priest, who served in South Florida for three decades, have been settled.
Doherty was assigned to St. Vincent's church in Margate in 2002 when the archdiocese put him on administrative leave.
``Rev. Neil Doherty retired in 2002 without faculties; he is not permitted to wear clerical garb, celebrate the sacrament, have an assignment nor is he listed on the archdioce-san website,'' archdiocese spokeswoman Mary Ross Agosta said in a statement.
On Friday, Herman said Doherty is listed as a retired Miami priest in the 2010 Official Catholic Directory, an independent publication that lists data for all dioceses in the U.S. The data is self-reported by each diocese and includes active and inactive priests.
``Since Archbishop Thomas Wenski's arrival in the Archdiocese of Miami, he has notified the Official Catholic Directory that priests not in good standing with the Church will not be listed,'' Agosta said in the statement.
Agosta would not confirm if Wenski or the former archbishop, John Favalora, had requested for Doherty to be laicized, a process to defrock priests that goes through the Vatican.
``In general, the laicization process can take a few years. Any requests to the Vatican from a bishop for this process would be handled confidentially,'' Agosta said.
Doherty, who lives in Lake Worth, was arrested Nov. 4 after violating terms of a pretrial release. Those terms were from a 2006 arrest on charges of sexually abusing a boy in the 1990s. The man, now 24, settled a civil case with the archdiocese in 2007.
Doherty had been under house arrest with electric monitoring while awaiting trial, but his GPS monitor lost contact for 17 minutes last month, said Broward Sheriff's Office spokeswoman Veda Coleman-Wright. Doherty claimed he was attending a funeral at the time, she said. In a Broward court this week, a pre-trial release officer said Doherty had disconnected from his GPS device eight times since 2009.
Because he had disconnected from the monitoring system, a Broward judge jailed him until trial.
No trial date has been set.

Man exposed himself to four girls, Miami-Dade police say
A man on probation for sex crimes against minors was arrested Friday and charged with exposing himself to four girls at their school bus stop, Miami-Dade police said.
Christian Alberto Castro Chinchilla, 27, approached his victims -- ages 11, 13, 14 and 15 -- near Southwest 180th Street and 137th Avenue, police said. He was on foot or driving a white 1998 Toyota Corolla. Police said he exposed himself and masturbated in front of the girls.
The incidents took place between Oct. 22 and Nov. 10.
Chinchilla, of 17450 SW 192nd St., was charged with four counts of lewd and lascivious exhibition.
Chinchilla has been arrested in the past for similar crimes. In 2006, he was charged with misdemeanor indecent exposure. A judge sent him to a rehabilitation program, court records show.
In 2009, he was convicted of four felony counts of lewd and lascivious acts on a minor under the age of 16 and was sentenced to five years' probation. Just one month later, Chinchilla was convicted of two misdemeanor counts of indecent exposure and was sentenced to jail.
In 2002, Chinchilla was charged with petit larceny and resisting arrest without violence. Both charges were later dropped after he completed a pretrial intervention program.

Christian Alberto Castro Chinchilla, 27, approached his victims -- ages 11, 13, 14 and 15 -- near Southwest 180th Street and 137th Avenue, police said. He was on foot or driving a white 1998 Toyota Corolla. Police said he exposed himself and masturbated in front of the girls.
The incidents took place between Oct. 22 and Nov. 10.
Chinchilla, of 17450 SW 192nd St., was charged with four counts of lewd and lascivious exhibition.
Chinchilla has been arrested in the past for similar crimes. In 2006, he was charged with misdemeanor indecent exposure. A judge sent him to a rehabilitation program, court records show.
In 2009, he was convicted of four felony counts of lewd and lascivious acts on a minor under the age of 16 and was sentenced to five years' probation. Just one month later, Chinchilla was convicted of two misdemeanor counts of indecent exposure and was sentenced to jail.
In 2002, Chinchilla was charged with petit larceny and resisting arrest without violence. Both charges were later dropped after he completed a pretrial intervention program.

Police and sex abuse experts warn Oklahoma City parents that while recent reports of attempted abductions have raised alarm across the metro, most sexually assaulted children are victimized by people they know.

Police said recent media attention of a man whom police accuse of abducting and molesting girls in Oklahoma City has resulted in an increased number of callers describing suspicious activity.

But parents would be wise to remember, experts said, that the vast majority of sexually assaulted children are victimized by people they know.
“While you should never, ever discount the danger that a true predator poses, at the same time, in our communities, unfortunately, we see family members and friends of family members sexually abusing young children,” police Capt. Rhett Brotherton said. “It doesn’t get as much attention as the stranger abductions do, but it’s a terrible problem in our society.”
Brotherton is in charge of the city police department’s units investigating sex crimes, crimes against children and sex offender registration.
Officers have been investigating three reports since April of a man who forced girls into his car and molested them before letting them go. Police arrested David Brian Morgan, 52, on Thursday on complaints of kidnapping, lewd acts with a child and forcible sodomy, thanks in part to tips provided by the public following media reports on the attacks.
Brotherton said officers welcomed the higher volume of tips that came in, but parents should be just as wary of danger to their children posed by people familiar to them.
Between 75 percent and 93 percent of children who suffer sexual abuse know their attackers, according to the University of New Hampshire’s Crimes Against Children Research Center. About half of the attackers are acquaintances, and most of the rest are family members.
Similarly, less than 1 percent of missing children cases tracked by the National Center for Missing and Exploited Children involve kidnappings by strangers, said Kristen Anderson, director of the center’s case analysis division.
California psychologist Barbara Bogorad, who has studied sexual abuse since the 1980s and authored the 1998 paper, “Sexual Abuse: Surviving the Pain,” said uncovering hidden abuse by someone the child knows can be as simple as asking questions.
“If your child doesn’t want to go to that dentist, or that class, or that Cub Scout meeting, find out why,” Bogorad said. “Talk to the other children, talk to the parents about what is going on. Don’t just assume your kid is being difficult.”
Brotherton echoed her sentiment that communication is key.“Be a suspicious parent,” Brotherton said. “Just because somebody may be in a position of authority, for example a schoolteacher or a volunteer at a local church, that in and of itself doesn’t make them safe to spend time alone with your child.”
Bogorad recalled an incident that happened years ago, before she moved to California from New York. The school her children attended often circulated newsletters containing information about reported threats by predators to students, and Bogorad was immersed in studying the issue. But it wasn’t enough to uncover the threat just a few doors from her home.
“One day when I came home, the FBI was arresting my neighbor a few doors down,” Bogorad said. “It turned out he had been contacting little girls over the Internet.”

Any remorse yet? Irate judge nixes deal to let unrepentant counselor avoid jail for raping 3 teens
Tony Simmons, in court Monday morning, did not seem to show any remorse for his crimes.

Justice got a do-over on Monday.
A judge used a rapist's remorseless rationalizations to throw out a plea deal that would have let the unrepentant sicko escape jail for sexually assaulting three teens.
That deal was all the more disgraceful because hulking Tony Simmons was a counselor at Manhattan Family Court, and the victims were girls under his supervision.
Even as the public was outraged, Simmons tried to minimize his crimes in a routine interview conducted before what was to have been Monday's formal sentencing.
That was all the legal reason a furious Manhattan Supreme Court Judge Cassandra Mullen needed to void a six-week-old deal that never should have been made in the first place.
"This defendant does not admit his guilt and, more alarming, has no understanding that his conduct was wrong and perhaps, most outrageously, blames the victims, demonstrating a depravity that shocks the conscience of this court," Mullen said.
Mullen tossed out an agreement that let Simmons off with probation. She offered him three years in prison, and when he did not immediately accept, she ordered the case set for trial.
One of the victims, Ashley, sounded more than prepared to take the stand against the conscienceless counselor who raped her in an elevator in the basement of the Family Court building when she was a 15-year-old on remand for a minor charge.
"I was ready from day one to testify against this guy," Ashley, now 20, said from home on Monday. "It's not hard to speak the truth."
Back when the plea deal was made, Manhattan District Attorney Cyrus Vance Jr. blasted Mullen for being "outrageously lenient," only to learn his own assistant prosecutor had failed to object to the agreement on the record.
The assistant, Amir Vonsover, was fired. Mullen reviewed the presentence report prepared after the plea, no doubt looking for legal reasons to nix the deal.
She found them in Simmons' own words to the Department of Probation.
Whatever happened six weeks ago, Mullen was everything a judge should be on Monday. She recounted with outrage of her own what the rapist had said about his attacks on the three teens in the Family Court building just across the street from her courtroom.
Simmons told Probation that the crimes "just happened." He proved himself a classic pedophile as he sought to blame the victims, saying they had enticed him by flirting and smiling and giving him looks. He was at his sickest when describing the attack on Ashley.
"Responding to why he committed the offense, he said in addition to mutual attraction, 'The situation looked good,'" the judge reported, adding, "Of course, it did for him, now that the victim had been isolated in the basement."
The judge went on, "Perhaps the single most disturbing thing the defendant said about the indictment was when he indicated that the victim said to him, 'Thanks, I needed that,' like she enjoyed it. It's just incredible that the defendant tries to make it sound like he did the victim a favor."
Ashley was no less incredulous when she heard what Simmons had said of the attack.
"Disgusting," she said. "Crazy."
If the judge had just been grandstanding for the media, she would have remanded Simmons as a predator and a public menace, but she continued his $100,000 bail. A man whose words to Probation had cost him a deal beyond lenient left court without uttering a syllable, his face expressionless throughout, save for a deepening furrow of his brow.
He exited to the street on the side facing the Family Court building where he had preyed on Ashley and the others. Ashley now dares to hope for justice.
"I can't wait to see the outcome," she said.

Houston Man Sentenced to More Than 30 Years in Federal Prison for Sex Trafficking
Barry Lernard Davis, aka Sir Lewis, of Houston, has been sentenced to 405 months in prison for sex trafficking of a minor, transportation of a minor with intent to engage in criminal sexual activity, as well as coercion and enticement of an adult to engage in criminal sexual activity, United States Attorney José Angel Moreno and Texas Attorney General Greg Abbott announced today.
Davis, 34, was convicted by a jury in March 2010 following a three-day trial and one and one-half hours of deliberation. Today, U.S. District Judge Melinda Harmon, who presided over the trial, sentenced Davis to 405 months on each of the first two counts of conviction and 240 months on count three, which will all be served concurrently. The 405-month sentence will be followed by a lifetime on supervised release.
During trial testimony, the jury heard how Davis lured the victims with promises of shelter, food, and material possessions. Once under his influence, the victims were controlled with both physical and sexual violence and the threat of deadly repercussions if they left him.
Davis had convinced a then 16-year-old high school student, who had been reported missing, to turn to a life of prostitution. She testified she was photographed nude in seductive settings for the purpose of advertisements for prostitution posted online.
Testimony established that Davis drove her across state lines and solicited men to have sex with her for money in a hotel in New Orleans. She said that at the time of the incidents, Davis not only knew she was 16, but also that she was pregnant. Moreover, the minor testified she feared Davis.
The adult victim also testified at trial, recounting for the jury the numerous brutal beatings she suffered at the hands of Davis, including an incident where he broke her nose and forced her to “turn a trick” minutes later. She told the jury Davis put a gun to her head and told her that if she ever left him he would hunt her down and kill her.
Additionally, this victim described in detail the underworld of pimps and prostitutes known as “the game,” including the “rules” adhered to by both pimps and prostitutes. All monies she and the minor victim earned were taken by Davis.
This investigation as well as the experiences of law enforcement led to testimony by FBI special agents confirming not only the existence of this underworld and its “rules,” but that there exists a special vocabulary commonly used among those in this illicit underworld. The behavior of Davis, as testified to by the witnesses, showed he was fully engaged in the world of pimps and prostitutes. Davis forced both victims to be tattooed with either his name or initials, a common underworld practice known as “branding.”
Additionally, forensic analysis of Davis’s computer conducted by the Greater Houston Regional Computer Forensic Laboratory revealed pictures of both victims on his computer. Hotel records verified that Davis traveled out of state with the victims, which was corroborated by photos of them in several different states.
At the sentencing hearing today, the underage victim’s mother testified about the hold Davis has on her daughter and how traumatic this has been for the family.
The federal charges are the result of an investigation conducted by the FBI with the assistance of the Pasadena Independent School District Police Department. The case was prosecuted by Special Assistant United States Attorney Angela S. Goodwin and Assistant United States Attorney Sherri Zack and was brought as part of Project Safe Childhood and Innocence Lost, nationwide initiatives designed to protect children from online exploitation and domestic sex trafficking.
Project Safe Childhood is a nationwide initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation. Led by United States Attorneys’ Offices, Project Safe Childhood marshals federal, state, and local resources to better locate, apprehend, and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims.
In June 2003, the FBI in conjunction with the Department of Justice Child Exploitation and Obscenity Section and the National Center for Missing and Exploited Children launched the Innocence Lost National Initiative. Their combined efforts were aimed at addressing the growing problem of domestic sex trafficking of children in the United States. To date, these groups have worked successfully to rescue more than 1,200 children.
Investigations have successfully led to the conviction of over 600 pimps, madams, and their associates who exploit children through prostitution.
Davis has been in federal custody since his arrest in July 2009, where he will remain to serve his sentence.

Eby pleads guilty to murdering Riley Fox
SUMNER — The FBI agents walked in and told the prisoner exactly why he’d been let out of his cell that morning.
“We’re here to talk about Riley Fox,” they said.
Scott Eby “almost immediately” said he wanted to see a lawyer and repeated that statement as they tried to further the conversation.
Disappointed, but legally bound by the exercise of his constitutional rights, the agents walked out of the interview room and into a corridor of the Lawrence Correctional Center.
A minute passed. Eby looked down at the microphone on the table in front of him.
“OK. I’ll talk,” he said.
Other investigators made a mad scramble to get the FBI agents back in the room.
Eby’s run-ins with the law
Scott Wayne Eby was born July 21, 1971. His criminal career began three days before Christmas 1988 when he walked into an Old Second Bank branch in North Aurora.
Eby, who was living in an apartment on Old Indian Trail in Aurora, attempted to cash a check made out to him that day for $125. The teller noticed the signature on the check did not match the bank’s signature card and Eby was detained until police arrived.
“This (will be) the defendant’s first trip to the Department of Corrections and his first problems with the law,” an assistant Kane County state’s attorney wrote.
In exchange for pleading guilty on March 2, 1989, an unrelated attempted residential burglary charge was dismissed.
Eby was sentenced to two years in prison.
Upon release, Eby continued his burglary career. He was caught breaking into a residence in September 1993 in Cook County while awaiting trial from another burglary arrest the previous year.
Sentenced to respective four- and three-year terms, he was still released early.
On March 28, 1997, a woman drove her 1986 Saab 9000 to a Citgo on Main Street in Lisle and went inside to pay for gas.
Eby opened the driver’s door and stole a backpack that was on the front seat. He ran behind some buildings, but was recognized by a witness.
Court records show Eby had been staying on Tallman Avenue in Romeoville and in Ronks, Pa., a small farming community with a prominent Amish population, around this time.
Wherever he was living, Eby skipped a court date that August and ducked an arrest warrant for nearly three years.

“Eby has an extensive criminal history. This defendant does not deserve any consideration for early release,” an assistant DuPage County state’s attorney told the court.
But Eby was paroled in 2003 and living with relatives on East Street in Wilmington on June 6, 2004.
Drug-fueled crime spree
Eby had been drinking a lot of alcohol and using cocaine when he drove to Outer Drive in the early morning hours. He cut the screen door of an elderly woman’s house and took $40 from her purse on the kitchen table.
A few houses away, he saw the back door was open and walked into the laundry room.
During his interview with FBI, Eby said he looked in to see Kevin Fox passed out in a bedroom and was about to walk out the front door when he saw 3-year-old Riley and her 7-year-old brother, Tyler, sleeping on couches in the living room.
Eby told agents he had never had sexual contact with children before, but he felt “compelled to take her.”
The petty burglar walked back to his car, backed into the driveway, opened the trunk and put a bandana over his face so the girl wouldn’t be able to describe him.
Covering her mouth with his hand, Eby put the 3-year-old in his trunk and drove 2 miles to Forsythe Woods. “He carried her down the hill and into the wooded area over the wooden bridge where he duct taped her wrists and mouth,” court reports said. His DNA would later be found on that duct tape.
Eby took Riley to the men’s room where he laid her on the floor. The weather was “stifling hot” and he began to sweat from stress and exertion.
Eby reportedly told the FBI he was attempting to arouse himself in order to rape the girl when his bandana fell off his face and he “freaked out.”
“He looked down and stated that Riley Fox was staring at his face. Eby said he panicked because he believed he would probably be going to prison for the rest of his life,” his plea agreement said.
Eby picked up his victim and climbed down a muddy hill to Forked Creek where he held her under the water by her shoulders until she stopped struggling.
“She floated to the surface, face down, and the current carried her down the creek,” the plea agreement said.
The killer worried his muddy shoes would leave footprints, so he threw them in the creek. He took off his clothes as well, but put them back in his car. Eby took a bottle of motor oil and poured it in the men’s room to ruin any physical evidence.
As Eby left the forest preserve he thought he was seen by a woman looking out from a nearby house, but he figured the only thing he could do about it was drive home and hope he’d gotten away with murder. He wasn’t optimistic. He remembered his name was written in the shoes he’d thrown in the creek — “a mistake,” he reportedly told the FBI.
Eby returned home and started drinking again. He was passed out as Tyler Fox woke up to see his sister was gone and went to tell his father.
Police question Eby only once
Wilmington police went door to door searching for the missing girl. Eby threw up when they asked if he knew anything, but the heavy odor of alcohol coming from him bolstered his claim that he wasn’t feeling well. He stayed in his room for the rest of the day while Riley’s body was found and Will County Sheriff’s police began a murder investigation that pointed to her father as the culprit.
Eby was not questioned again.
An evidence technician recovered Eby’s shoes and stored them away with other junk collected from the creek.
Eby was discharged from parole for his third burglary conviction three months after Riley’s murder.

Prosecutors announced they would seek the death penalty against Fox, who immediately filed a civil suit against sheriff’s detectives for coercing a confession from him.
Will County State’s Attorney James Glasgow allowed his attorneys to arrange for DNA testing of the duct tape that had been used to bind his daughter.
When those results excluded Kevin Fox in June 2005, he was released after spending eight months in the county jail.
Glasgow had an investigator assigned to his office review the case, but the civil lawsuit essentially froze the investigation.
“With (Fox’s) confession, the small window of opportunity and lack of similar crimes in the area, there was a lot of speculation how the DNA could’ve somehow been incorrect,” a source said.
The lawsuit was heard during a two-month trial at the end of 2007. After appeals and settlements were processed, Kevin Fox and his wife, Melissa, were awarded approximately $11 million.

“He covered my mouth and started having intercourse with me,” the victim told a nurse at Provena Saint Joseph Medical Center. He told her “this is the last piece of (expletive) I’ll get before I go to the penitentiary.”
The victim said she was getting sick and had to go to the bathroom, but fled out the front door and ran toward the police station, stopping at a nearby funeral home to call 911.
Wilmington police arrested Eby later that day.
During a bench trial in December 2005, Eby was found guilty on two counts of sexual assault. Unrelated DUI and traffic charges were dropped when he was convicted.
Eby’s victim asked for the judge to give him probation.
“I believe the six months that he has been in jail is enough time,” she wrote. “He was suppose (sic) to be seeking mental help but was not … also taking medication.”
“I believe he deserves a second chance in life. Also he will lead a more productive life on the outside,” she wrote.
Eby was sentenced to 14 years in prison. Initially sent to the Dixon Correctional Center then back to Danville, Eby ended up at Lawrence Correctional Center in Sumner, 218 miles south of Wilmington.
FBI tracks down Eby
After the Fox’s civil lawsuit was heard, Glasgow “spearheaded discussions with the FBI regarding its assistance in the investigation … in early 2008,” the state’s attorney’s office said in a statement.
In June 2009, five years after Riley Fox was murdered, FBI agents canvassed Wilmington again and were tipped to look at Eby as a suspect.
“He believed his mother and a former girlfriend had suspicions he’d been involved,” an investigator said.
The agents went to interview Eby in prison in May. Besides confessing, the convicted felon provided more DNA samples to match with the duct tape from the girl’s body.
With good behavior, Eby will finish his serving time for the rape of his relative in June 2017.
That’s when he’ll immediately start serving six life sentences for raping and murdering Riley Fox.

SUMNER — The FBI agents walked in and told the prisoner exactly why he’d been let out of his cell that morning.
“We’re here to talk about Riley Fox,” they said.
Scott Eby “almost immediately” said he wanted to see a lawyer and repeated that statement as they tried to further the conversation.
Disappointed, but legally bound by the exercise of his constitutional rights, the agents walked out of the interview room and into a corridor of the Lawrence Correctional Center.
A minute passed. Eby looked down at the microphone on the table in front of him.
“OK. I’ll talk,” he said.
Other investigators made a mad scramble to get the FBI agents back in the room.
Eby’s run-ins with the law
Scott Wayne Eby was born July 21, 1971. His criminal career began three days before Christmas 1988 when he walked into an Old Second Bank branch in North Aurora.
Eby, who was living in an apartment on Old Indian Trail in Aurora, attempted to cash a check made out to him that day for $125. The teller noticed the signature on the check did not match the bank’s signature card and Eby was detained until police arrived.
“This (will be) the defendant’s first trip to the Department of Corrections and his first problems with the law,” an assistant Kane County state’s attorney wrote.
In exchange for pleading guilty on March 2, 1989, an unrelated attempted residential burglary charge was dismissed.
Eby was sentenced to two years in prison.
Upon release, Eby continued his burglary career. He was caught breaking into a residence in September 1993 in Cook County while awaiting trial from another burglary arrest the previous year.
Sentenced to respective four- and three-year terms, he was still released early.
On March 28, 1997, a woman drove her 1986 Saab 9000 to a Citgo on Main Street in Lisle and went inside to pay for gas.
Eby opened the driver’s door and stole a backpack that was on the front seat. He ran behind some buildings, but was recognized by a witness.
Court records show Eby had been staying on Tallman Avenue in Romeoville and in Ronks, Pa., a small farming community with a prominent Amish population, around this time.

Goldsboro, N.C. — A Goldsboro man was being held Saturday in the Wayne County jail on $6 million bond on sex charges.
Joseph Anthony Raczkowski, 50, of 140 Garrick Lane, is charged with six counts of statutory sexual offense and with sexual exploitation of a minor. Investigators with the sheriff's office said the charges stem from alleged offenses against a 13-year-old acquaintance that happened between 2002 and 2005.

VOLUSIA COUNTY, Fla. -- The Volusia County Sheriff's Office arrested 57-year-old David Barberi after they say he abused a 3-year-old boy and 6-year-old girl.
The complaint against Barberi came in just before 9 p.m. Friday night.
The two children went to spend the night at Barberi's home on Ayesbury Circle, deputies said.
Deputies said a relative returned to the house to drop off some medicine for one of the children and when she got there, she found Barberi in his underwear.
Deputies said she also saw the 3-year-old naked and the 6-year old getting dressed with a sex toy in plain view.
The woman took the children and left to talk to them about what happened and call police, deputies said.
Deputies said that according to interviews, Barberi showered with the children, performed sex acts on them, showed them porn on his computer and even had the children perform sex acts on each other.
Deputies said the children told them this was not the first time this happened and Barberi scared them when he told the children he would go to jail if anyone ever found out.
The children said Barberi also took cellphone pictures of them with their clothes off, deputies said.
Deputies collected Barberi's cellphone and computer to be analyzed after a search of his home.

A registered sex offender jailed for being on school grounds in Alamance County saw his bond increased after investigators found he had paid visits to other schools within the past month.
Stacy Lamont Davis, 34, of 521 10th St. in Gibsonville, was arrested Monday by Burlington police. They said he went to Hillcrest Elementary School Nov. 2 with an acquaintance to have lunch with the friend's child. He was charged with being a sex offender on school grounds, and his bond was set at $125,000.
Further investigation showed Davis spent time at Williams High School and Sellars Gunn School on that same day. As a result, his bond was increased to $325,000.

Deputies arrested 33-year-old Daniel Robida and charged him with sexual battery.
Robida is accused of having a sexual relationship with the 17-year-old girl. Deputies said the relationship was consensual.

Retired Cop Accused Of Luring Kids Online For Sex

VOLUSIA COUNTY, Fla. -- Only WFTV was there when a retired police officer was arrested in Volusia County Monday for allegedly trying to lure children over the internet for sex.
Agents told WFTV he was trying to lure children over the Internet for sex. However, agents said retired police officer Tom Winters wasn't really talking to kids from his DeBary home; he was talking to undercover officers.
Agents said they chatted with Winters online for a month undercover and will now try to determine if he has ever actually victimize a child in person.
At 8:00am Monday, the FBI Attorney General and the Broward and Volusia County sheriff's offices had Winters cuffed in his front yard. They questioned him as agents took apart his house looking for evidence.

The 64-year-old retired police officer hid his face in silence as he was hauled off to jail. Agents seized boxes of evidence from his home along with several guns.
WFTV found his MySpace page with pictures before he retired next to his Cooper City, Florida police car. Several friends listed on the social networking site were teenaged girls.
"While agents say Winters went online to lure two kids 230 miles away, he had access to nearly 100 in his backyard and that has parents in the neighborhood on edge.
Winters' home is less than a half-mile from the neighborhood bus stop and community pool.
Farah Wilkins has a 10-year-old daughter. Wilkins says she has seen Winters in the neighborhood.
"Oh my God, you know he sits by the pool all the time looking at young girls," Wilkins said. "It puts goose bumps on my arm."
Along with his status as a former cop, WFTV noticed Winters Coast Guard license plate and membership to the Fraternal Order of Police. There's also a Vietnam War vet hat in the back of his car and he was wearing dog tags when he was arrested.
"My kids will know for sure where the house is and I'm not going to let them go out and walk around now it's kind of scary," parent Debbie Ferrazzi said.
Winter's was booked into the Volusia County jail with no bond. He is scheduled to face a judge Tuesday.

VOLUSIA COUNTY, Fla. -- Only WFTV was there when a retired police officer was arrested in Volusia County Monday for allegedly trying to lure children over the internet for sex.
Agents told WFTV he was trying to lure children over the Internet for sex. However, agents said retired police officer Tom Winters wasn't really talking to kids from his DeBary home; he was talking to undercover officers.
Agents said they chatted with Winters online for a month undercover and will now try to determine if he has ever actually victimize a child in person.
At 8:00am Monday, the FBI Attorney General and the Broward and Volusia County sheriff's offices had Winters cuffed in his front yard. They questioned him as agents took apart his house looking for evidence.

Authorities said heightened online activity of images cataloged by the National Center for Missing and Exploited Children in Washington, D.C., led investigators to Martin's account, then to his residence.
Martin's laptop was seized as evidence.
Martin is being held in the Camden County Jail.

A Bethany, Oklahoma couple is accused of having sex with a canine and soliciting sex with a minor.On November 29, Bethany police were notified by a girl's guardian in Dallas, Texas of alleged sexual abuse of the 13-year-old. The teen had been living with her aunt, her aunt's husband and three male cousins all under the age of 15 in Bethany.The teen told a family member in Texas she saw video recordings of her aunt having sexual intercourse with a dog. The 13-year-old also said she found emails between her aunt and aunt's husband discussing sexual dreams involving the children in the house. The teen also had another email, that police said was drafted by the two adults, encouraging the 13-year-old to have sex with her aunt's husband.Investigators obtained a search warrant and seized video recording equipment, DVDs and computer equipment from the house. Police reviewed the evidence and said they found several recordings of the couple having sexual relations with a canine. Investigators also found six grams of marijuana and paraphernalia in the home.
Brandy T. Double and Edward James Double were arrested and charged with crimes against nature, conspiracy to commit a felony, facilitating/encouraging/offering and/or soliciting sexual conduct or engaging in sexual communication with a minor, indecent exposure-indecent exhibitions of obscene material or child pornography-solicitation of minors, possession of marijuana in the presence of a child under 12, possession of paraphernalia and maintaining a disorderly house.All four children were taken into protective custody. Investigators plan to interview the children to determine if they were sexually assaulted by the couple.

A 19-year-old Missouri man was arrested after driving 560 miles to Winthrop Harbor twice in three days in an attempt to have sex with a 13-year-old girl, police said. Patrick R. Tullis of Independence, Mo., is charged with indecent solicitation of a minor and unlawful possession of child pornography, but additional charges are expected after a forensic investigation of his computer is complete, authorities said.
The girls mother became alarmed after reading Facebook messages between her daughter and the man, who tried to lure her by posing as a guitarist in a rock band, Winthrop Harbor Detective Chris Willets said. Tullis drove roughly 550 miles from his home to Winthrop Harbor on Sunday where he hung out with the girl and took her to a hotel room, Willets said. The girl got scared and left the room before anything happened. Her mother found out about the meeting on Monday and contacted police, Willets said. Officers posing as the 13-year-old texted Tullis, who was back at his home in Missouri, on Monday and convinced him to meet at a hotel room on Tuesday to have sex, Willets said. The man made the 550 mile trip a second time Tuesday to find officers waiting at the hotel, where he was placed under arrest, Willet said. Police seized the man's phone as well as his computer, where they found images of naked underage females on both, Willets said. Police said Tullis and the girl began talking in early November on Facebook, then through text messages and finally on the phone before meeting up. This is the second time in the past two months that Tullis has been involved with an underage girl. Authorities in Missouri filed a missing juvenile report that stated a 15-year-old girl went missing in late October after meeting with Tullis at a skatepark. Authorities in Missouri could not be reached Wednesday night, but Winthrop Harbor police said the girl had returned home safely. Winthrop Harbor Police Chief Joel Brumlik encouraged parents to monitor their teen's online activities to help prevent instances like this from happening. “Online predatory activities normally increases while our children are not at school and parents are at work during the holidays,” he said. “Parents must never take anything for granted in this age of technological wonders, and be diligent in supervising their children.”

Investigators: Sex Offender Confessed To Raping Boys

ORLANDO, Fla. -- A convicted sex offender was in jail Thursday morning, accused of raping two boys over the past few months. WFTV was there as 31-year-old Adam Roy Tuttle was hauled away in his bathrobe by deputies Wednesday night.
Tuttle faced a judge Thursday morning and was ordered to be held on no bond.
Investigators said Tuttle confessed to sexually battering the children at least 16 times over the past two months.
The victims' parents said they knew about the suspect's past, but left their children alone with him anyway. They said everyone in their neighborhood had heard Tuttle was a registered sex offender, and investigators are asking for any other possible victims to come forward.
Tuttle didn't say anything to WFTV's cameras as he was hauled off to jail in his bathrobe Wednesday night, but his alleged victim's father had harsh words for the man the accused of raping their 10- and 11-year-old sons.
"I want to personally go to the jail and I want to have an opportunity to end his life. I'm being honest with you, it's worth going to jail, worth dying for your child," he told WFTV.
The parents told WFTV that they knew Tuttle was a sex offender, but had become friends after spending some time with him as neighbors. But then their boys told them what allegedly happened next door in Tuttle's home.
"A sick individual has infiltrated this family and has destroyed it to a degree," the alleged victim's father said.
Tuttle was arrested in 2004 for trying to lure boys into a bathroom at a Wade View Park. He was sentenced to six months in the Orange County Jail in March 2005, followed by five years of sex-offender probation. He was sentenced to another 51 weeks in jail later that year for violating his probation.
The alleged victim's father WFTV talked to said he can't trust anyone now.
"I'm just sitting here now with two kids who are scarred. As a father, I have no answer. There is nothing I can do," he said.
Investigators fear there are more possible victims and say anyone who suspects Tuttle may have abused other children can call the sheriff's office at 407-254-7350.
