The attorneys for Casey Anthony want stain evidence from her car trunk tossed from the trial. The prosecution today argued why the stain evidence is crucial to its case against Anthony, who is charged with first-degree murder in the death of her daughter, Caylee.
“Prosecutor Jeff Ashton argues the stain is the approximate size of a small child,” WESH-Channel 2’s Bob Kealing reported tonight.
Attorney Richard Hornsby, who offers analysis for the station, predicted that Chief Judge Belvin Perry will let the stain be part of the murder trial. ”It goes to show you that the state isn’t relying on speculative evidence here,” Hornsby said. “It seems to be very straightforward in simple, scientific principles that a jury will understand.”
The defense has argued that FBI tests show the stain has no biological evidence, but Ashton countered that other tests found fatty acids in the stain, Kealing reported.
Kealing tried to get comment from defense attorneys Jose Baez and Cheney Mason about the state’s claims about the stain. Kealing had to follow the two men down the street outside the courthouse. Mason finally said, “Not going to respond.”
Kealing added, “Jose Baez, who has been rather silent … the last few hearings joked with us repeatedly asking what television station we’re from, but he would not address the stain issue specifically.”
