Thomas A. McNamara, 59, of 378 Center St., No. 7, Middleboro was charged Monday with rape of a child with
force, indecent assault and battery on a person over 14, indecent assault and battery on a child under 14, distributing obscene material and indecent exposure.

Middleboro police: State agency impeded child-rape investigation

MIDDLEBORO - Middleboro police say the state Department of Children and Families impeded an investigation that led to the arrest this week of a man accused of sexually abusing three children repeatedly over a nine-year period.
In a report on file at Wareham District Court, Middleboro police Detective Simmone M. Ryder says the state agency would not provide her with a 2005 report in which one of the victims told an investigator she was abused by Thomas A. McNamara, 59.
Ryder said she asked for the report on Feb. 8. Two weeks later, she said, the agency responded and directed her to request the information through the district attorney’s office.
By March 3, Ryder was able to review the records through copies on file at the district attorney’s office. McNamara was arrested Monday.
“We are reviewing the police report and looking into DCF’s role in this case,” said Department of Children and Families spokeswoman Jennifer Kritz.
McNamara, of 378 Center St., Apt. 7, Middleboro, is charged with abusing three children repeatedly over a nine-year period, beginning in 1996 when the children were ages 5, 7 and 9.
The Enterprise is not disclosing the relationship between McNamara and the victims to protect their identity.
McNamara was arraigned in Wareham District Court on Tuesday and held on $100,000 bail. The charges against him include indecent assault and battery on a child, rape of a child with force, distributing obscene material and indecent exposure.
The victims’ statements to authorities describe a pattern of abuse that began with inappropriate touching during bath time and became more depraved over the years, including an allegation that the suspect forced the children to have sex with one another while he watched.
One of the victims reported the abuse to Middleboro police in 2005. The case was referred to the Department of Children and Families, formerly the Department of Social Services, but the victim recanted her statement and the agency dropped the investigation.
The victim told Ryder last month that she took back her statement because no one believed her, and because she feared for her mother.
Ryder began investigating the case anew last month, when one of the victims reported the abuse in person at the Middleboro police station.
According to Ryder’s report, one of the victims told a therapist he was angry about the abuse, and that it caused one of the other victims to use drugs.
McNamara is scheduled to return to court on March 30 for a pretrial hearing. He is being held at the Plymouth County House of Correction.
