ANTHONY MARTINEZ - 10 yo (1997) - Beaumont CA
Striking a deal to spare his life, convicted killer Joseph Edward
Duncan III entered a guilty plea Tuesday in a Riverside County Superior
Court for the murder of a 10-year-old Beaumont boy.
Duncan, already convicted of killing an Idaho boy and members of his
family, had faced the death penalty for the 1997 killing of Anthony
Martinez, a 10-year-old abducted near his backyard.
In February, Duncan’s defense team went to Riverside County
prosecutors, offering to have their client plead guilty in exchange for a
sentence of life in prison, said John Hall, a spokesman for the
Riverside County district attorney’s office.
“The district attorney agreed to a sentence of life without the
possibility of parole,” Hall said, adding that Duncan is scheduled to be
formally sentenced next month. “The agreement is in place, it’s just
the formality of the sentencing that is going to happen in April.”
In 2008, a federal jury convicted Duncan of murdering 9-year-old
Dylan Groene, his mother, Brenda Groene, her fiancé, and another of her
sons in Idaho. Duncan was sentenced to death and also given nine life
terms for those crimes.

Child serial killer Joseph Duncan, who
committed several crimes in the state of Washington, was sentenced this
morning to two more life sentences for the murder of a 10-year old boy
in California.Parents of Anthony Martinez addressed their son's
killer, 14 years after he was abducted and murdered in Riverside County,
California. Duncan did not look at them while they spoke.Joseph
Duncan was on parole at the time of Anthony's murder in 1997 for a sex
offense in Washington. He lured the boy into his car by saying he needed
help looking for a lost cat. Duncan beat Martinez over the head with a
rock and left his body in the desert. Duncan left behind fingerprints at
the scene, but those prints weren't complete enough to match to anyone
in the database. That changed in 2005 when Duncan was arrested in Coeur
d'Alene, Idaho with a young girl he kidnapped six weeks before. He told
federal investigators that he was Anthony's killer; they confirmed it by
collecting a new set of fingerprints that matched those found at the
Martinez crime scene.Tuesday's sentencing is part of a plea deal
that spares Duncan the death penalty for Martinez's murder. But, it
doesn't matter; Duncan has already been sentenced to death by a federal
jury for kidnapping Dylan and Shasta Groene from Coeur d'Alene and
murdering Dylan in the woods of Montana. He killed three members of the
childrens' family in order to abduct them from their home in May 2005.
He received life sentences for the murders before representing himself
in his death penalty case in federal court. In addition to the
Idaho and California murders, Duncan is also a suspect in the murder of
two young girls in Seattle in the mid-90's. While he was holding the
Groene children captive in Montana, he confessed to Shasta that he
killed Sammiejo White and Carmen Cubias. King County has not said
whether or not they plan to charge Duncan for those murders.Duncan's
death sentence is currently working its way through the 9th Circuit
Court of Appeals. While awaiting the outcome of the appeal, he'll be
transported from California back to the Federal Correctional Institute
in Terre Haute, Indiana. If his appeal fails, that's where Duncan will
eventually be executed.

Duncan Ordered To Pay $10.5M For Kidnappings, Murder
Posted: 5:12 pm PDT July 20, 2011
COEUR D'ALENE, Idaho -- A federal court has ordered convicted killer and kidnapper Joseph Duncan to pay $10.5 Million in damages.
The court awarded the money earlier this year to Steve Groene as the guardian of the estates of Dylan and Shasta Groene.
$500,000 was awarded as special damages to pay for the funeral expenses of Dylan and past and future medical expenses of Shasta Groene.
$10 Million was awarded as general damages and pain and suffering for Shasta along with mental distress and anguish for both Shasta and Steve.
Duncan was sentenced to death for the kidnapping of Dylan and Shasta Groene and the murder of Dylan in 2005.
Last week the Ninth Circuit Court of Appeals ordered a competency hearing for Duncan. If he's found incompetent, the judge must throw out the death penalty. http://www.kxly.com/news/28615178/detail.html
