A Hopatcong woman has been charged with child abuse in Maryland for
failing to protect her infant daughter from beatings by the father, a
former Morris County resident, authorities said.
Jessica Peavy, 22, is being held on $25,000 bail in the Nov. 28 death of her 2-month-old daughter, Lexi Zirinsky.
Jason Zirinsky, the baby’s 25-year-old father, is awaiting trial on
murder and child abuse charges in connection with the girl’s death in
the family’s home in Brunswick, Md. This is the second time Zirinsky has
been charged with abusing an infant daughter of his.
Prosecutors in Maryland say Peavy failed to protect the child from Zirinsky, who used to live in Roxbury.
Peavy moved to Hopatcong after the infant’s death, according to a
report in the Frederick News Post, a Maryland newspaper. She was
indicted on abuse charges last month and returned to Maryland to face
the allegations.
Appearing without a lawyer, Peavy told the judge she was happy to have a bond set. Her next court date is July 11.
The allegations in Lexi’s death mark the second time Zirinsky has
faced child abuse charges. In 2004, he was charged in Morris County with
aggravated assault and child endangerment after his 28-day-old daughter
was hospitalized with broken bones in her legs and wrists and four
fractured ribs.
Then 19, he claimed the injuries were the result of an accident, but
he served nearly 18 months in prison on abuse charges, according to New
Jersey Department of Corrections records.

A former Roxbury resident who served nearly two years in prison for abusing his infant daughter in 2004 has been accused of murdering another infant daughter in Maryland.
Jason Zirinsky, 25, of Brunswick, Md., was charged on Monday after the Maryland Medical Examiner’s Office ruled that two-month-old Lexi Regina Zirinsky’s death was caused by multiple traumatic injuries, according to a press release from the Frederick County Sheriff’s Office.
Zirinsky was found guilty of child endangerment and child abuse in 2004 after his then 28-day-old daughter was brought to the hospital with four broken ribs, two broken legs and a broken wrist.
In 2006, he was convicted of theft and conspiracy to commit theft in a Mount Arlington incident.
He was sentenced for both crimes in February 2007 in Morristown and was released from prison in October 2008. Zirinsky was taken into custody in Maryland at about 2:30 p.m. on Monday. He complained of chest pains and was examined at Frederick Memorial Hospital, the release stated. He then was transported to the booking unit of the Frederick County Adult Detention Center.
Zirinsky was charged with first-degree murder and child abuse, according to the release.

A Brunswick man charged with killing his infant daughter in November
was sentenced to 30 years in prison after entering into a plea agreement
in the case Friday.
Jason August Zirinsky, 26, entered an Alford plea to the charge of
first-degree child abuse resulting in death in connection with the death
of 2-month-old Lexi Regina Zirinsky, Frederick County State's Attorney
Charlie Smith said.
An Alford plea is not an admission of guilt but an acknowledgment
that the state has enough evidence to secure a conviction if the case
were to go to trial.
Zirinsky had also been facing charges of first-degree murder and
first-degree child abuse resulting in severe physical injury before
entering into the plea agreement.
Smith said the 30-year sentence, which does not include the
possibility of parole, was the maximum that Judge G. Edward Dwyer Jr.
could have imposed under the agreement. He said Zirinsky and his
attorney, Robert Bokman, had initially offered a plea deal that could
have resulted in less than the maximum sentence, but Smith's office
rejected that proposal.
"Unless we were free to ask the Judge for the maximum, we were
unwilling to do anything but try the case," Smith wrote in an email to
The Frederick News-Post.
An officer from the Brunswick Police Department responded to
Zirinsky's house in the 400 block of West Potomac Street at about 7 a.m.
Nov. 28 for a report of an infant in cardiac arrest.
The child's aunt directed the officer to an upstairs bedroom, where
he found the child's mother, Jessica Denise Peavy, crying and cradling
the baby, who was already dead. The child had visible bruising on her
face, arms and legs, according to a statement of fact read during
Friday's proceedings.
An autopsy determined that, among other injuries, the child suffered
three blunt force traumas to the head, each of which would have been
enough to kill her, the statement read.
Peavy told investigators she began noticing bruises after the child
was in Zirinsky's care. Zirinsky said at the time that he may have been
too rough when handling the child, including during burping.
Smith said the charges for which Zirinsky entered the plea best
reflect the reality of the case. He said there was little evidence of
the premeditation prosecutors would have to prove in order to secure a
conviction for first-degree murder.
"After looking at the facts, we concluded that he beat his child to
death, and that these were the most appropriate charges," Smith said. "I
really wish there was something more we could do to this guy, but this
is what the law allows for. I have mixed feelings about this case."
Smith said the maximum sentence does not allow for probation, but
that Zirinsky could petition a judge to have his sentence reduced or a
parole board at some point could order his early release. But both of
those scenarios are unlikely, he said.
"All we can do is ask for the maximum sentence and hope that they serve it," Smith said.
A grand jury indicted Peavy on charges of second-degree child abuse
in May. She has been free since June 9 when she posted $25,000 bail. The
conditions of the bail stipulate that Peavy, who is from New Jersey,
cannot leave Maryland without permission. Her trial is scheduled to
begin Oct. 6.

My gosh...there should be a law that child abusers have to be sterilized after they are convicted the first time. This guy was clearly a previous abuser and it was inevitable that he would harm another baby. And unfortunately he killed his second child. I hope he rots in prison. And I wish they would castrate him so he cannot procreate.
