The father of a 2-year-old girl in critical condition at a Salt Lake
City hospital was on his way to see here Saturday night from his
deployed location with the Army in Afghanistan, according to the man’s
lawyer.According to Great Falls Police, the child had not been declared dead as of 10 p.m. Saturday night.The 2-year-old girl remains hospitalized with severe head trauma, multiple bone fractures and other injuries.David
Wayne Hyslop, 28, the man prosecutors say was with the girl at the time
she was injured, was charged Friday with attempted deliberate homicide
in connection with the case.An affidavit from the Cascade
County Attorney’s Office states that emergency room medical staff at
Benefis Health System was told the child tripped and fell on a sidewalk,
but doctors determined the injuries were not consistent with that
claim. Prosecutors allege that the child also had older bruises, which
medical professionals believed were from previous abuse.According
to court documents, Hyslop initially told police he did not know how
the child was injured. He later said that he dropped her on her head
when he tried to put her down for a nap. Court documents state that he
left the child in her room until her mother came home and saw the girl
wasn’t breathing. The mother then called 9-1-1.The child’s
biological father, Michael Arndt was en route via plane from
Afghanistan to Salt Lake City on Saturday night, according to his
attorney David Dennis of Great Falls.Dennis noted that
Arndt became concerned about the child potentially being abused in
February, when Great Falls Police were called to Hyslop’s residence to
investigate an allegation of abuse after the girl suffered a broken arm.
Doctors were unable to confirm whether the injury was the result of an
accident or abuse, Great Falls Police Sgt. Bryan Slavik previously said.
The investigation was then turned over to the Division of Child and
Family Services.Dennis said that after that incident he
wrote a letter to the division asking that the child be taken out of the
home before she was “more seriously injured.” He included pictures of
the girl that showed her missing hair and teeth, and with bruises, all
of which he said was consistent with abuse.“I still don’t know how they close the case as unsubstantiated,” he said Saturday night.Calls to the division seeking comment Friday were not returned.“Not
a day goes by that I wasn’t thinking about her, hoping that she was OK
until he (Arndt) could get back and we could get custody of her,” Dennis
said.He said Arndt was scheduled to return from his deployment in August.

Hyslop’s Second Initial Appearance for Amended Charge of Deliberate Homicide

It was basically an empty courtroom for this second initial. David Wayne Hyslop appeared via closed circuit TV for the amended charge of deliberate homicide. At this time Hyslop does not have an appointed attorney. He also did not wish to discuss bail. Bail will therefore remain at $750,000.
Twenty-eight year-old David Hyslop was initially charged with attempted deliberate homicide after two-year-old October Perez, in Hyslop's care Thursday, was rushed to the hospital with massive head trauma. The little girl was flown to a Salt Lake City hospital that night and had been on life support until her father could return from serving in Afghanistan. She was pronounced brain-dead in the early hours of Saturday.
Hyslop appeared before the judge Friday. He told police he dropped the child while putting her down for a nap.
Medical staff at Benefis noted the girl's injuries didn't match up with his claims, suspecting abuse. An autopsy yesterday revealed the cause of death to be blunt force trauma causing major brain injury.
The autopsy also revealed a number of other injuries including a major spinal fracture that medical staff says would have kept Perez from walking.
Deliberate homicide is a felony. If convicted Hyslop could face up to life in prison.

Family and friends of October Perez gathered to honor her memory Sunday.
October Perez died at the age of two on June 23rd, due to alleged child abuse.
Sunday her short life was celebrated and remembered.
October's Aunt Mary Leibrand described her saying, "October Anne, now one of heaven's most precious little angels."
Memorial attendants wore blue ribbons and a picture of October to support child abuse awareness.
The chaplain shared stories of tragedy, and reminded listeners the importance of forgiving, but not forgetting.
During the service, Family addressed the tragedy that let to October's death.
October's Father, Mike Arndt, said, "Child abuse and neglect and
homicide happens all too often and goes unnoticed in the community's
eye. This is a problem that I didn't realize happens as often as it did
until the horrible events that led up to my daughter's death."
The service concluded with attendants releasing balloons to meet October in Heaven.
Funeral services were held Saturday for the two year old.

Montana man gets life sentence in toddler's death

GREAT FALLS, Mont. - A Great Falls man convicted of killing his girlfriend's 2-year-old daughter a year ago has been sentenced to life in prison without the possibility of parole.
David Wayne Hyslop was sentenced Wednesday by District Judge Julie Macek, who called the injuries suffered by October Perez "nothing short of horrific."
Hyslop was found guilty in May of deliberate homicide in the girl's death in a Utah hospital on June 25, 2011 - two days after her mother called 911 to report she came home and found her daughter lying on her bed, unresponsive.
"While she literally gasped and struggled for breath, you ... took a nap and didn't lift one finger to help her," the judge told Hyslop.
She also ordered Hyslop to pay nearly $14,000 in restitution to October's father, Michael Arndt, who was deployed in Afghanistan, for the loss of income and other expenses related to the girl's injury and death.
October died of head injuries that caused her brain to swell, prosecutors said. An autopsy also revealed she had a broken spine and healing fractures on both arms, although evidence presented at trial did not determine who was responsible for the previous injuries.
Cascade County Attorney John Parker sought the life sentence without parole, asking Macek to spare October's family the ordeal of having to beg future parole boards to keep Hyslop in prison.
Hyslop's attorney, Larry LaFountain, sought a 10-year sentence, saying he did not believe his client was guilty.
