Chief Judge Belvin Perry won’t rule today on whether to release a 2008 jailhouse tape of Casey Anthony’s reaction to the discovery of a child’s remains. The body was later identified as her child, Caylee.

At a hearing this afternoon, Perry gave no sense of which way he might rule, WKMG-Channel 6’s Tony Pipitone said.

Anthony doesn’t want the tape released for privacy and medical privacy concerns, defense attorney Jose Baez said. Baez described what is shown in the tape as “some form of torture” against Anthony.

“He says employees of the sheriff’s office and jail conspired to inflict that on Casey Anthony, which is one reason WKMG is seeking to review the tape and determine if its contents are newsworthy,” Pipitone said.

The tape “reportedly shows Anthony hunched over and in distress,” WFTV-Channel 9 anchor Vanessa Welch said. “Baez claimed the tape is private because it was shot in the jail’s medical facility.”

Central Florida News 13’s Jacqueline Fell said: “A jail official said that Casey appeared to have something similar to a panic attack.”

WESH-Channel 2’s Bob Kealing highlighted the defense’s “surprise new argument” that the video “should fall under a medical privacy exception because she did receive some medical treatment during this videotape episode.”

Perry said that Anthony wasn’t in a medical room, per se, but Baez countered that she received medical treatment, Kealing reported.

Jack Kirschenbaum, an attorney for WKMG, argued that the tape is a public record. It had been sealed to protect Anthony’s right to a fair trial. She was acquitted this summer of murder in Caylee’s 2008 death.

“Kirschenbaum relied on the Florida public records law, and Baez could not cite a specific exemption to that law in arguing that the tape should remain under seal,” Pipitone added.

Kealing reported that the state attorney’s office plans to make the tape public in 24 to 48 hours if Perry orders it should be released.
