NATHAN CORTEZ - 2 yo - San Jose CA
The 24-year-old
San Jose mother who dropped her toddler from a two-story window on
Christmas morning has been booked on attempted murder, child abuse and
assault with a deadly weapon charges, San Jose police said Monday.
Sgt. Jason Dwyer said Lupita Cotez was arrested about 8:30 p.m. Sunday.
Cortez
remains at Valley Medical Center, where she was healing from broken
bones in her ankles and feet. She also had an involuntary psychiatric
hold put on her, said Santa Clara County Sheriff's Sgt. Jose Cardoza,
whose office supervises the jails.
"She's going to be here for a while," he said. "We have a couple of deputies outside her room."
There
also has been no bail set for the young woman. Police say she dropped
her 22-month-old son, Nathan Alvarez Cortez, out of her apartment
window, 20 feet down, on Christmas morning.
Nathan miraculously
only suffered minor bruises, police and witnesses said. The boy hit a
small patch of hard dirt at the complex in the 3500 block of Alden Way,
narrowly missing a concrete patch.
Dwyer said he expect relatives to care for Nathan.
Lupita
Cortez's sister on Monday said the family didn't want to speak
publicly. "We're being harassed," she said, "and we want to keep things
private."
After she allegedly dropped her son, Lupita Cortez then
threw herself out the window after him, but landed on a concrete passage
at the next apartment house, police and witnesses said.
Dwyer said that investigators believe mental illness
played a role, but police did not immediately find any history of mental
illness-related arrests for Cortez. She never suffered mental problems,
her family said, although on Thursday, they had taken Cortez to Valley
Medical Center because she seemed so down. The family said Cortez
received some Zoloft and was sent home.By Christmas morning,
though, Cortez's family said her behavior was so off that they realized
they had to take her back to the hospital, but Cortez insisted on going
to church first.
But as the family was getting ready, she snatched
her son and locked her herself in, prompting a cousin to call 911.
Police had already arrived and were inside the house trying to make
contact with Cortez when the baby was dropped.
