LOUISVILLE, Ky. -- A Jeffersontown man has been indicted for abusing a 2-year-old girl.

It's not the first time the suspect has been accused of a serious crime involving a child.



That suspect, 22-year-old Tyler Berrios, was indicted for first-degree criminal abuse last week, and it's not the first time he has been in the news.

Berrios is accused of abusing a 2-year-old girl, the daughter of the woman he was dating at the time.

Jeffersontown police said it happened in September, and the girl's injuries were discovered at his girlfriend's Jeffersontown apartment.

An arrest warrant states that Berrios "unlawfully struck the child numerous times in the buttocks/back area and that she also "suffered a bruise under the right eye."

Police said handprint marks were found on the girl's body.

They also said Berrios admitted to disciplining the child by spanking her because the girl had thrown something at him.

Berrios was scheduled to be arraigned on a charge of first-degree criminal abuse on Tuesday.

In April 2007, Berrios was charged with rape, sodomy and unlawful use of electronic means to induce a minor to engage in sexual activities.

At the time, police said Berrios, then 18, and another 14-year-old boy, took turns repeatedly raping and sodomizing an 11-year-old girl they met on Myspace at an abandoned warehouse near Seventh Street and Algonquin Parkway.

But court documents show that months later, prosecutors amended the charges down, citing a "reluctant prosecuting witness" and a "forensic report that provided exculpatory evidence."

Berrios pleaded guilty to the lesser charges of disorderly conduct and custodial interference, and was sentenced to five years in jail diverted, which meant no jail time.

But he was back in jail in October, after he was arrested on the new child abuse charges.

It was Berrios' girlfriend who called police to report her child's injuries.

The girl was taken to the hospital, but police said she has since recovered and is doing just fine.

Berrios was also indicted on one count of being a persistent felony offender
