Re: JESSICA SMITH - 11 YO - Fort Worth TX
FORT WORTH -- Relatives of an 11-year-old girl missing for a second
day told police that her mother is mentally ill and has threatened
suicide and harm to her children, a police spokesman said Wednesday.
An Amber Alert was renewed for Jessica Smith, who was taken from her home
in far north Fort Worth sometime overnight Monday by her mother,
Kimberly Smith, 42, police said.
The mother has custody of the daughter, and they both lived at the house in the 7300 block of Indiana Avenue.
Police initially did not explain why an Amber Alert was issued when they knew
that the missing child was with the custodial parent.
School officials called police on Tuesday when Jessica did not arrive for
class, and they "expressed concern for Jessica's well-being," Sgt. Pedro
Criado, a police spokesman, wrote in a news release.
Investigators went to the Smith house and learned that, the previous evening,
Kimberly and Jessica Smith were "involved in a domestic violence incident."
"Smith placed Jessica in imminent danger of serious
bodily injury," Criado said, but the girl did not appear to be seriously injured.
The next morning, family members told police, when they
realized that Smith and Jessica were not in the house, they assumed that
Jessica had gone to school.
Jessica's father, Phillip Monroe Smith, 36, is facing a charge of sexual abuse of a child under 14,
police and court records show. He was arrested in October and released
from jail after posting $100,000 bail.
Phillip and Kimberly Smith are in the process of divorce. The family was ordered to undergo
psychological evaluations, and the divorce case was referred to mediation, records show.
"This is a complex criminal investigation
involving mental illness and allegations of sexual abuse that may or
may not be true," Criado said. "Therefore, information is very limited
in order to preserve evidence (and) protect potential victims and the
integrity of the investigation."
According to Department of Public
Safety policy, Amber Alerts expire every 24 hours, Criado wrote. Police
asked that it be re-issued Wednesday.
James Monroe Smith, 76, the
child's grandfather, said in an interview that he had not seen Jessica
since his son moved out more than a year ago.
"I cannot believe her mother would hurt her, but you never know," the elder Smith said. "We're praying. That's all we can do."

FORT WORTH — It's been more than a day since Jessica Smith went
missing, but on Wednesday, the search for the 11-year old took an
unusual turn.
Despite the fact that the Amber Alert for the girl was reissued, News
8 observed no concerned relatives at the home where she was last seen.
That's quite unusual for what has been presented as a serious child
abduction case.
But around 6 o'clock Wednesday evening, police were seen walking
around the back of the house in the 7300 block of Indiana Avenue. Their
purpose was not immediately clear.
Fort Worth police confirmed they have received no new tips to lead
them to Jessica. But Caitlin Fields told News 8 that her mother and
sister had had a loud and terrible fight on Monday night.
"My mom and my older sister and my little sister, they were all
arguing and fighting and stuff," Fields said. "Then it was like they all
kept saying they were done with each other, and I had to help my sister
get my mom away from Jessica so Jessica could go sit down and cool
off."
Kimberly Smith, 42, is believed to have taken off with Jessica in a
silver Mazda CX-9 sport utility vehicle with Texas license BMZ-390.
Jessica is a fifth-grader at Parkwood Hill Intermediate School in the
Keller ISD. She had reportedly spoken with school counselors on Monday
about personal issues. The district declined to comment.
Fort Worth police will only say that given the circumstances, they are concerned that Jessica may be in grave danger.
Jessica's father has a serious criminal investigation pending, but police declined to discuss that aspect.
Investigators do want the public to remember Jessica's face, and ask anyone who sees her to call 911 immediately.

Amber Alert canceled in New Mexico for missing Fort Worth girl

The Amber Alert for 11-year-old Jessica Smith has been canceled in
New Mexico. State police said there is no updated information that she
may be in the state.
Police said Jessica is still missing and considered in danger. The
efforts to find her will continue until she is located by other law
enforcement agencies.
Jessica was reportedly taken by her mother, Kimberly Smith who family
described as mentally ill and suicidal. Authorities said she has
threatened to injure her children in the past.
Jessica was taken by her mother from their Indiana Avenue home
overnight Monday, police said. While the mother does have custody of
Jessica, authorities said they do have evidence that has led them to
believe the child is in danger while in her care.
The Amber Alert in Texas is still active. Police said the girl's
mother drives a 2007 silver Mazda CX-9 with Texas plates BMZ 390 with a
Harley Davidson pink and green decal on the rear window.

Search for Jessica Smith Goes Nationwide
Amber Alert canceled in New Mexico
The Amber Alert for 11-year-old Jessica Smith has been extended to all states bordering Texas, Fort Worth police said Thursday.
Smith disappeared overnight Monday and police say that, while the girl is believed to be with her mother, she is also believed to be in grave danger.
Police said 42-year-old Kimberly Smith took Jessica from their home Monday night or Tuesday morning after a family fight.
Investigators said Smith apparently has a deteriorating mental illness and has threatened to commit suicide and injure her children. Police also said Smith has exhibited a pattern of irrational behavior.
On Wednesday, the Amber Alert was extended to New Mexico and Oklahoma. On Thursday, the Amber Alert was also extended to include Arkansas and Louisiana while being canceled in New Mexico.
By taking the search nationwide, even though it's not a nationwide Amber Alert, investigators could get information about the mother and daughter on roadside billboards.
Jessica is 5 feet 1 inches tall and weighs approximately 120 pounds. She has brown eyes and straight, brown hair just past her shoulders in length. Smith's mother has a cross tattoo on her neck and a decorative tattoo on her back. She is 42 years old and stands 5 feet 2 inches tall. She weighs approximately 150 pounds and has brown hair and brown eyes.
Officers are searching for a 2007 silver Mazda CX-9 sedan with Texas license plate BMZ-390. The car has tinted windows and a pink and green Harley-Davidson sticker on the rear window.
Anyone with information on the location of Jessica or Kimberly Smith are asked to call 911 or the Fort Worth Police Department at 817-335-4222.

Re: JESSICA SMITH - 11 YO - Fort Worth TX
FORT WORTH -- Two arrest warrants have been issued for a Fort Worth woman who has been missing with her 11-year-old daughter since Tuesday.
Fort Worth police have asked agencies nationwide to help search for Kimberly Smith, 42. She faces charges of aggravated assault and child endangerment in the disappearance of Jessica Smith.
Smith's estranged husband, Phillip Smith, obtained a temporary protective order against her Thursday.
Family members have described Kimberly Smith as suicidal with a deteriorating mental condition that might cause her to harm her daughter, police have said.
An Amber Alert in Texas was reissued about 5 p.m. Thursday. New Mexico state police issued an alert Wednesday, but it was not renewed Thursday. Amber Alerts expire every 24 hours unless renewed.
The FBI is assisting police.
“When there is probable cause that there is an abducting parent who has fled interstate to avoid prosecution or confinement, there is a federal process, known as unlawful flight to avoid prosecution, which may be used to allow the FBI to more fully utilize its resources,” Special Agent Lydia Maese, the FBI's media coordinator, said in a statement.
Kimberly Smith has custody of her daughter, and both lived in the 7300 block of Indiana Avenue in the Summerfields neighborhood of far north Fort Worth.
School officials called police Tuesday when Jessica did not arrive for class and “expressed concern for Jessica's well-being,” police have said.
Investigators who went to the Smith house learned that Kimberly and Jessica Smith were “involved in a domestic violence incident” the previous evening.
The next morning, Kimberly Smith and Jessica were gone.
In addition to the temporary protective order, Phillip Smith received a temporary restraining order and an order calling for his estranged wife to appear in court at 8:30 a.m. Feb. 21 for hearing to determine whether:
The temporary order should be made permanent.
A temporary injunction should be granted.
Whether he should be granted possession of the house on Indiana Avenue and exclusive use of their vehicle.
And whether he should be granted sole custody of Jessica.
Phillip Smith is asking a judge to deny Kimberly Smith access to the child or require that visits be supervised.
The temporary protective order, which is effective immediately and lasts 20 days, says there is a danger of violence unless Kimberly Smith is ordered to do or refrain from doing certain things. The order sets out requirements including that Kimberly Smith not possess a weapon or ammunition and not communicate with Phillip Smith or Jessica except through an attorney.
Violation of the order is punishable by a fine of up to $4,000 or one year in jail.
Rumors abounding
Phillip Smith, 36, faces a charge of sexual abuse of a child under 14, according to police and court records. He was arrested in October and was released from jail after posting $100,000 bail.
Phillip and Kimberly Smith are divorcing. The family was ordered to undergo psychological evaluations, and the divorce case was referred to mediation, records say.
Rumors and rumors masquerading as “tips” were flying Thursday.
A Corpus Christi TV station reported that Kimberly Smith's car was spotted Wednesday afternoon on a road near Corpus Christi Bay. Police found nothing.
Someone on an online Amber Alert message board said he or she had heard that Kimberly Smith's credit cards were used in New Mexico and Oklahoma. There is no evidence of that.

FORT WORTH, TEXAS—
Police believe 11-year-old Jessica Smith's mother, Kimberly Smith, took her from their Fort Worth home overnight Monday.

Police believe 11-year-old Jessica Smith's mother, Kimberly Smith, took her from their Fort Worth home overnight Monday.
- Family court documents reveal Kimberly was in the middle of a contentious divorce from Jessica's father Phillip Smith.
"At times we are called to testify at divorce proceedings,” said Alliance for Children Associate Director Julie Evans.
The court documents show a rep from the Alliance for Children in Fort Worth was called to testify in the Smith's divorce.
"We're going to investigate cases, or be involved in the investigation of cases, where there is child sexual abuse, severe injuries to children, any child death investigation in Tarrant County,” said Evans.
Documents also show both parents wanted sole custody of Jessica. Her father filed first in August of last year, then, her mother responded. A motion filed reads: "Kimberly Smith would respectfully request that Phillip Monroe Smith have no access to the child in subject of this suit due to the pending criminal charges against Mr. Smith."
The Tarrant County District Attorney’s office confirms Phillip Smith was charged with continual sexual abuse of a child and released on $100,000 bond in October.
"We have cooperated with police concerning previous sex abuse allegation… absolutely untrue.
Smith has been interviewed by police. Passed polygraphs and he was willing to take those polygraphs. What Smith is accused of did not happen,” said Phillip Smith’s attorney Tom Pappas in a statement.
The Alliance for Children says having a family they’re involved with go through something like this is rare.
"It's a devastating situation when faced with that, but it's very, very rare,” said Evans.

Jessica Smith found safe in New Mexico
Updated today at 7:11 PM
FORT WORTH — Eleven-year-old Jessica Smith and her mother, Kimberly were located in their vehicle, nine miles south of Tres Piedras, New Mexico, an area on the edge of Carson National Forest, according to a release from Fort Worth police — 550 miles from home.
"It is with great joy and satisfaction to announce that the nationwide search that began on Tuesday, February 7,2012, has been canceled," the police statement said.
"The deputies spotted that car about nine miles south of U.S. 64 and U.S. 285 near the Carson National Forest," said KOAT reporter Liz McKernan in Taos, New Mexico. "We are told that they were a little bit lethargic, but that Jessica herself was in very good spirits, and obviously very happy to be found."
Authorities said both Jessica and her mother appeared to be very exhausted and hungry. Both were transported to a Taos hospital to be checked out.;
According to police, Jessica did not appear to physically injured.
"The ambulance pulled up and we were able to get video of mom getting admitted into the emergency room," McKernan said.

Mrs. Smith will be extradited to Fort Worth on two felony warrants, aggravated assault and endangering a child. The warrants were issued after the investigation showed "acts of violence" took place, police said.
Neighbors of the Smith family were overjoyed to learn that Jessica and her mom were both safe.
"I would tell her that I was praying for her, and I was hoping she'd come back, and she did," said Jessica's friend Katy Chitwood.
Tammy Vu and Caitlyn Stanley tied yellow ribbons on and around the Smith home, which also has a sign that reads: "God bless Jessica."
"We thank everyone involved with the successful mission with this child abduction investigation as well as the apprehension of Kimberly Smith," the police statement said. "If not for the actions of the school officials, witnesses, reporting parties, along with the coordinated efforts of our law enforcement partners combined with the public and our media partners, this unfortunate sensitive and complicated investigation would not have ended with such a positive outcome."

Re: JESSICA SMITH - 11 YO - Fort Worth TX
Jessica Smith, the 11-year-old Fort Worth girl who was the focus of an Amber Alert, admitted that her mother concocted a story about her father molesting her, which enraged her mother and led to the nationwide search, the father’s attorney said Monday.
The Smiths are in the middle of a nasty divorce and child custody fight.
NBC 5 has learned the girl made the admission to a school counselor on the same day police say her mother, Kimberly Smith, assaulted her and then disappeared with her that night.
The two were found Sunday, hungry and exhausted, in a remote area of northern New Mexico, police said.
Jessica’s father, Phillip Smith, was charged with assault after the girl made the graphic allegations that he had assaulted her.
Phillip Smith’s attorney, Tom Pappas, of Dallas, said he expected prosecutors to drop the case as early as Tuesday.
"Clearly, the mom ran because she forced Jessica to fabricate these allegations and was about to be uncovered -- or had been uncovered,” Pappas said.
Melody McDonald, a spokeswoman for the Tarrant County district attorney’s office, said the charges still stand but the new information is being reviewed.
NBC 5 doesn't usually name alleged victims of sexual assault. But in this case, Jessica Smith recanted the allegations, and the revelation sheds new light on what led to the Amber Alert.
"It's unfortunate her mom put her through this and put her center in all this stuff and then did the crazy stuff she did,” Pappas said. “We're glad she's all right."
Jessica Smith will stay with grandparents for now, but her father hopes to regain custody within days, the attorney said.
"He loves his daughter,” Pappas said. “The only thing he wanted is she's safe. As long as she's safe, everything else can be resolved."

Jessica Smith's Father No-Billed on Abuse Charges
Grand jury finds no probable cause to take case to trial
Friday, Mar 2, 2012
A Tarrant County Grand Jury no-billed the father of 11-year-old Jessica Smith Friday morning.
Phillip Monroe Smith, the
girl's father, was charged with sexual abuse of a child under 14 last
October after the girl made graphic allegations that he assaulted her.
The girl later recanted those allegations, telling a school counselor that her mother, Kimberly Fields Smith, concocted the story. That night Jessica's mother assaulted her and then disappeared with her, according to police.
The Fort Worth police, believing Jessica to be in grave danger, issued an Amber Alert
for her on Feb. 7. The Amber Alert was eventually elevated to include
multiple states and, after six days, the pair were found in a remote
part of northern New Mexico.
"Clearly, the mom ran
because she forced Jessica to fabricate these allegations and was about
to be uncovered -- or had been uncovered,” said Tom Pappas, Smith's
attorney, last month.
Phillip and Kimberly Smith are getting divorced and had been involved in a custody fight for the child.
A no-bill means grand jurors did not find probable cause to warrant bringing the case to court for a trial.
Kimberly Smith was extradited back to Texas Sunday evening and met with her defense attorney on Wednesday. The investigation into Smith, who faces charges of aggravated kidnapping, is ongoing.
