NH toddler found unharmed after amber alert issued
April 2, 2012
MANCHESTER, N.H.—Police in Manchester found an 18-month child safe at a Concord hotel after issuing an Amber Alert early Monday.
The alert was issued about 7 a.m. for Waylon Soucy, who police said was taken by his biological father, Kelly Soucy, 29, after the father had an argument with his wife.
Police said Soucy's wife told them he left with the child following a dispute, during which he showed a handgun and threatened to commit suicide. Police had said they believed Soucy was armed with at least one gun.
Soucy, a veteran who served two tours in Iraq, and his son were found at a Days Inn in Concord not long after the alert was issued. WMUR-TV reports (http://bit.ly/HgKBih) a clerk recognized the description and called 911.
Police said it's unlikely Soucy will face any criminal charges, but he probably will be sent for an evaluation.

Claims That Triggered Amber Alert Investigated
Father At Center Of Alert Reunited With Son
POSTED: 5:37 pm EDT April 11, 2012
UPDATED: 6:17 pm EDT April 11, 2012
MANCHESTER, N.H. -- A Manchester man who was the focus of an Amber Alert last week was
reunited with his son Wednesday, and police are now investigating claims
made by the man's wife.
Shortly after an Amber Alert was
triggered April 2, Kelly Soucy was found at a Days Inn hotel in Concord
with his 18-month-old son. Soucy said he rented a room the night before
after an argument with his estranged wife.
"I got away from her
and took my son to a nice, quiet place," he said. "I checked in and told
the fellow that works there what was going on. He even gave me a
discount on the room, saying, 'I've been through that.'"
Soucy said he had no idea at the time that his wife went to police claiming he
had a gun, was in a fragile state of mind and took off with their son.
Police said those claims were enough to warrant an Amber Alert.
The couple's son, Waylon, was returned to his father two days later after a
joint police and Department of Children, Youth and Families
investigation revealed he was of sound mind and not a danger to his son.
"I got him back Tuesday morning," Soucy said. "Wednesday, I found out she was up to something."
Soucy said that on April 4, his wife, Crystal Soucy, filed a motion making an
almost identical claim to the one that triggered the Amber Alert.
"I am scared for my children," she said in the motion. "My husband put a
loaded gun to his head and pulled the trigger, then took my son."
A judge granted emergency custody and sheriff's deputies removed Waylon from his father again.
"I left my son with my brother," Kelly Soucy said. "He called me on the
phone, crying, saying, 'I can't stop them. They're taking him.' I talked
to the sheriff. He was very sympathetic."
Kelly Soucy said he got a lawyer to fight back.
"We filed our own ex parte including documentation from DCYF and a lot more
background," said lawyer Michael Anderson of The Legal Connection.
The emergency hearing never happened. The couple agreed on a parenting plan
and by noon Wednesday, Kelly Soucy had his son back. But he and his
lawyer are raising concerns about the process.
"It's terrible that
all somebody has to do is cry wolf and they can keep doing it, and
things get put out against you," Kelly Soucy said.Kelly Soucy said he owns a gun legally, but he said he never had his gun out around his son.
Manchester police said they are investigating claims made by Crystal Soucy, but
they have not determined if charges will be filed.Crystal Soucy declined to comment.
