On Dec. 10, 2012, College Magazine reported on missed computer searches that never made it to trial in the Casey Anthony case. Anthony was charged with first-degree murder, aggravated manslaughter of a child, and aggravated child abuse stemming from the June 16, 2008 death of her then two-year-old daughter Caylee. Anthony’s defense attorney Jose Baez told the jury that the little girl drowned in her family swimming pool and due to the family’s dysfunction, the accidental death was covered up. On July 5, 2011, Anthony was acquitted of the three charges and avoided the death penalty. Today, she is a free woman but new reports indicate the missed searches could have been a smoking gun that might have resulted in a different verdict. The searches were for the term “fool-proof suffocation” and were searched on the day Caylee Anthony died. The searches occurred on a computer frequently used by Anthony. Additionally, reports show that Anthony had told her ex-boyfriend that same day that she had to move from her home.
While the first-degree murder trial against Casey Anthony is long over and she cannot be retried for the same crime twice, Anthony continues to face many legal battles. She is appealing her state conviction of lying to law enforcement officers as due to her defense strategy, she claimed that her daughter had drowned, despite not reporting her missing for 31 days and telling law enforcement officers her daughter was abducted by a fictitious nanny named Zanny. As Anthony was charged four times for statements made during one police interview, her defense attorneys have argued she was overcharged. The case is currently before the Florida court of appeals. Following that conclusion, Anthony will begin a slew of civil suits involving a woman with the same name as the fictitious nanny, Roy Kronk, the meter reader who discovered Caylee Anthony’s remains on Dec. 11, 2008 and the leader of Texas Equusearch, an organization that volunteers to find missing children. Anthony could face more civil suits if they are filed.
There was plenty of testimony and evidence, such as the missed Google searches, the jury never heard during the trial. It is unknown whether hearing that evidence would have resulted in a different verdict, but due to double jeopardy, the public will never know.
In addition to the missed searches for “fool-proof suffocation,” the jury never heard about a fight that took place between Anthony and her mother due to it being hearsay. A post on a Topix thread, allegedly by Cindy Anthony’s brother Rick, revealed details about the fight that reportedly occurred the day before Caylee’s death. Other accounts came from Anthony’s former boyfriend Tony Lazzaro who testified during the trial but was prohibited from speaking about the alleged fight that occurred the day before Caylee died. Lazzaro allegedly participated in the Scared Monkeys forum and shared his opinion, first-hand account and views of what transpired.
While at this point, there is no way to confirm whether Cindy Anthony and Casey had a huge blowout the day before Caylee died, it would have been interesting to have heard these claims battled in the courtroom during Anthony’s murder trial. The prosecution did not need to prove motive and beyond saying that Casey Anthony murdered Caylee for the sake of wanting freedom, they never approached the subject.
Did the jury need to hear motive in order to rule in favor of the prosecution and convict Anthony?
If it were true that Cindy and Casey had a huge fight and Casey had to move out of the home, there would have been the possibility the prosecution could have used that for motive.
In addition to Anthony’s ex-boyfriend Tony Lazzaro’s statements, another of Anthony’s exes gave an interview where he said Anthony had been kicked out of the family home, the same day Caylee died. Beginning on page 12, Jesse Grund tells how Casey had told him her parents were getting divorced and her mother was going to get a condo and sign the family home in Casey’s name.
According to Jesse Grund’s statements, there was a crucial piece of information that if not missed, the prosecution could have used to show motive. On page 13, line 8, Grund stated that Casey Anthony said, “Umm…they are getting a divorce and mom wants me out of the house.”
The next part of Jesse Grund’s interview was absolutely vital to the case against Casey Anthony, and absolutely missed.
Jesse Grund stated that on June 16, 2008, the day that Caylee Anthony died, and the day that prosecutors now know someone used the Anthony family computer to type in “fool-proof suffocation,” Casey Anthony called him to say that she had to move out of the home.
On page 14, lines 13 and 14, Jesse Grund’s interview states, “What was the content of that conversation?
Jesse Grund replied, “Uhm, the fact that her mom was no longer moving out anymore. Casey now had to find a place to live. Uhm, uh, she couldn’t stay at home anymore. And that her parents were not getting a divorce anymore.”
Did the prosecution entirely miss the motive in their case against Casey Anthony?
Now here is where things get extremely interesting.
According to a report by Mom Logic, that followed Tony Pipitone’s reporting on pings from Casey Anthony’s cell phone made on June 16, 2008; Casey Anthony called Jesse Grund at 2:52 p.m. This correlates to the latest report indicating that at 2:50 p.m., someone was on the family computer searching “fool-proof suffocation.”
According to Pippitone’s reporting, that would highly indicate that while someone was Googling “fool-proof suffocation” Anthony was on the phone, speaking to Jesse Grund and telling she had been kicked out of the house and had to move.
While the prosecution tried to show Casey Anthony as someone who was just tired of being a mother and therefore wanted to live the good life, free of responsibility; Grund presents a different scenario.
According to Grund’s account, Anthony was promised to own the house, but then due to her parents’ personal issues, a possible fight regarding Anthony stealing money, and a changing situation, the plan had changed. Anthony was no longer getting a house but had to leave the home and find another place to live.
Would the prosecution have fared better if they had presented a case where the motive was anger and spite rather than wanting to live a life without Caylee?
Did Casey Anthony go from believing she would own the family home to being homeless? If so, would that have been a motive for murder?
How the jury would have ruled if they had heard evidence that Casey Anthony was kicked out of her home the day someone searched “fool-proof suffocation” on the family computer and Caylee Anthony ultimately died, we’ll never know.
What we do know is the prosecution lost their case against Casey Anthony and as time goes by and more details are released, the public continues to ask how the state of Florida could have failed to present crucial evidence in the trial of the century.
