Calhoun DA: Anniston boy killed for wetting pants

ANNISTON, Ala. (WBMA) - Calhoun County District Attorney Brian McVeigh says 5-year-old Gregory Caver was murdered in Anniston last week after urinating in his pants.

"He wet his pants, and he died for it." McVeigh said.

Caver's mother, 28-year-old India Kimble, and her 26-year-old boyfriend, Vonta McClellan, have been charged with capital murder in connection with the boy's death. Kimble was arrested in Mobile Tuesday by U.S. Marshals and has since been transported back to Anniston, booked into jail.

Investigators say McClellan used a belt to beat little Gregory into unconsciousness on the morning of July 26, ultimately causing his death at Children's of Alabama later that day.

According to McVeigh, Kimble allegedly verbally accosted her son during his beating, hence her arrest for murder.

McClellan is also accused of striking his 7-year-old daughter with the same belt used to beat Caver. He was arrested on child abuse charges prior to being charged with murder.

McVeigh says Kimble had other children present at the time of the incident, but they were physically unharmed.

On the death of a child, McVeigh says, "there are no words that are adequate when a child dies, especially when they are victims of abuse."

Investigators ask anyone with any additional information about previous incidents of abuse involving McClellan or Kimble to contact the Anniston Police Department or the Calhoun County District Attorney's Office.

Court dates for the two suspects are expected to be set within the next 60 days, and according to McVeigh, it could be two years before they go to trial.

This reminds me of Dominick Calhoun, not just because of the names. So sad. Children have accidents. :-(

He may have wet himself because he was afraid.  I'm sure they beat him for other things.  Such a cute little tyke.

I always think of how these little one are feeling in the last hours and minutes before they finally die.

An Alabama mother of four and her fiance have been charged with capital murder in the beating death of the woman’s 5-year-old son.

India Kimble, 28, and Vonta McClellan, 26, both from Anniston, were arrested Tuesday and charged with killing Gregory Caver after he had wet his pants.

Local authorities say they responded to a report of a child having difficulty breathing and the toddler was later pronounced dead at a hospital in Birmingham.

Department of Human Resources officials say they did a follow-up and found that another child, McClellan’s daughter, at the same address had been abused.

Investigators say when they told the girl’s biological mother that she needed to be examined by a physician, she fled along with four other children and was later arrested by U.S. Marshals.

Police in Anniston got a 911 call last Friday about child in respiratory distress, Anniston Star reported.


First responders arrived on the scene in the 2400 block of Wilmer Avenue and transported 5-year-old Gregory Caver to Stringfellow Memorial Hospital. The toddler was later airlifted to Children's Hospital in Birmingham, where he died that afternoon.

Police had initially interviewed Kimble and McClellan in connection to the boy's death, but the couple were released pending Gregory's autopsy.

Tragedy: Prosecutors say McClellan beat the child as punishment for urinating in his pants

A preliminary coroner’s report released by the Department of Forensic Sciences stated that the little boy was beaten with a belt severely enough to cause fatal blunt force trauma, and his death was ruled a homicide.
According to Caver's biological father, Robert Fuller, who lives in Mobile, he was told by DFS officials that his son also had a seizure and suffered from internal bleeding and an injury to one of his eyes.
The Calhoun County District Attorney's Office received the report Monday and issued capital murder warrants for Kimble and her fiancé, who was already in jail on $500,000 bond.

McClellan was arrested last Sunday on a child abuse charge involving his 7-year-old daughter, who officials say was also beaten.
On July 28, case workers with the Department of human Resources visited the couple's home and found that the girl had bruises and markings from what is believed to be a belt. 

When the DHR workers told the girl's birth mother, 23-year-old Secret Huguley, that her daughter was in need of medical attention, police say Huguley grabbed the girl and took off, the TV station WBRC reported.

Anniston police searched for several hours before tracking down Huguley and her four children. All of the kids were placed in care of DHR.

Miss Huguley was arrested on charges on for tampering with physical evidence and booked into jail on $1,000 bond.

Kimble was also arrested by U.S. Marshals in Mobile and transported back to Anniston. She has been charged with capital murder because officials say she was verbally abusive toward her son and did nothing to protect him from McClellan.

Meanwhile, Gregory’s father, Robert Fuller, described his 5-year-old son as a respectful boy who always had a smile on his face.

‘The heart he had and the joy he brought to everyone … my son didn’t deserve that,’ Fuller said.
A funeral for little Gregory has been scheduled for Saturday. Meanwhile, his mother and her boyfriend are being held in the Calhoun County Jail and are due back in court August 26.
