Dallas man faces capital murder charge in toddler’s beating

A Love Field-area man was charged Wednesday with beating his girlfriend’s toddler to death.
Police said the girlfriend, 19, left her 21-month-old son last Friday with 18-year-old Alex Roberson, with whom she has an infant daughter.
Paramedics responding to a 911 call arrived about 3:30 p.m. at the couple’s house in the 4500 block of Cowan Avenue, two blocks from Love Field, and found the boy unresponsive.
Paramedics tried CPR on the way to a hospital, but Trey Jenkins was declared dead soon after arrival.
Child-abuse detectives interviewed Roberson at the hospital. According to police, he told them that Trey had been “real cranky” and collapsed during a diaper change.
But three days later, police said, an autopsy revealed Trey was beaten across his upper body — so severely that “he would not have survived more than a few minutes.”
A warrant was signed earlier this week, and Roberson was arrested on a capital murder charge.
A Child Protective Services spokeswoman said the agency had no history with the couple, but has placed their daughter in foster care while police investigate Trey’s death.

“He also learned what love was not,” Dallas County prosecutor Shequitta Kelly said Tuesday at the trial of his mother’s boyfriend, who is accused of beating Trey to death.
Alex Roberson, 19, is charged with capital murder and faces an automatic life sentence if convicted in Trey’s death at the family’s home near Love Field last July.
But Trey’s mother, Precious Williams, who was at the grocery store when Trey was beaten, told jurors that she did not believe Roberson would hurt her son. She said Roberson, Aiyana’s biological father, loved Trey even though they weren’t related.
“I don’t feel like he would ever harm Trey,” she testified while being cross-examined by Roberson’s defense attorney, Bill Cox. She said that Roberson dropped out of school to care for Trey and kept him while she worked.
Williams said she began dating Roberson when Trey was 3 months old. But she didn’t introduce the two until they had been together four months.
Throughout her testimony, Williams spoke of Trey in the present tense and was unemotional except when Kelly showed her an autopsy photo. She wiped her eyes briefly before regaining her composure.
Trey was so badly beaten from behind, Kelly and fellow prosecutor Carmen White told jurors in opening statements, that his kidneys “flew to the front of his body.” His adrenal glands were destroyed, his liver lacerated and his bones broken. The blow or blows caused feces to shoot “everywhere.”
Cox, while questioning witnesses, tried to shift the blame for the severe injuries to Williams. She left for the grocery store minutes before Roberson carried Trey’s lifeless body from a back bedroom, according to testimony.
But Kelly told jurors that Roberson told police during a second interview that the injuries were an accident. Kelly asked several witnesses whether Roberson told them that he accidentally stepped on or fell on Trey or if the toddler tripped. The witnesses — including Williams and Roberson’s relatives — said no.
Williams testified about two other occasions when Trey had injuries when Roberson cared for him. In one instance, she was in another room. The other time she was at work.
When Williams was in another room, Trey got a bruise on his cheek. She said Roberson told her he ran into the “door panel.” The other time, she said, Trey had a bruise on his abdomen shaped like the bed railing. She testified that Roberson told her the child fell on the bed railing.
Williams said she examined the injuries and did not question Roberson’s explanations.
Some of Roberson’s relatives testified that it doesn’t make sense that Roberson would hurt Trey. They also lived in the house and were home when Roberson carried Trey into the living room and said to call an ambulance.
Chris Roberson, Alex Roberson’s brother, did testify that he had seen Alex Roberson “pop” Trey’s hand. But he also testified that he had seen Williams “beat a 1-year-old baby like he’s 11 or 12.”
Williams testified that she, not her boyfriend, was supposed to discipline Trey except for timeouts. She said she never abused the boy but would occasionally hit his hand or bottom.
The day Trey died, Alex Roberson put the boy in a timeout in his crib after Trey threw all his toys out of it.
Hours later, Trey was lying naked and lifeless on a futon when firefighter-paramedics arrived, according to testimony. They were trying to revive him when Williams came home after someone in the home called to tell her what happened. She was crying and hysterical, according to testimony.
Joseph Tips, one of the firefighter-paramedics, testified that someone who looked like Alex Roberson told him: “I was changing his diaper. His nose started bleeding. He stopped breathing.”
Dr. Geetanjali Srivastava, who treated Trey at Children’s Medical Center, said Alex Roberson “matter-of-factly” told her that he and Trey were running in circles, playing and chasing when he could smell that the boy needed a diaper change.
Srivastava said Alex Roberson told her that he was trying to change the boy when he became unresponsive and started bleeding from the nose. The doctor said such an explanation “didn’t make any sense to me.”
After Trey’s death, Alex Roberson, who called himself a rap artist, got a tattoo of a microphone with brass knuckles and a gun with the words “music killer.”
Kelly told jurors that Roberson didn’t have the reputation to go with the ink.
“He does have the credentials of a baby killer,” she said.

Mistrial declared in capital murder case of man accused of beating toddler to death

A state district judge declared a mistrial Friday after two Dallas County jurors could not be swayed to convict a 19-year-old man of beating his girlfriend’s toddler to death in July.
Prosecutors said they would retry Alex Roberson, though it is unclear whether he might face a lesser charge than capital murder in the killing of 20-month-old Trey Jenkins. Had the jury convicted him, Roberson would have faced an automatic life sentence with no possibility of parole.
“Regrettably, it does appear to me that the appropriate thing to do at this time is to declare a mistrial,” state District Judge Mike Snipes said.
Most members of the jury left the Frank Crowley Courts Building without commenting. Several appeared as if they had been crying.
“I hope there’s going to be enough evidence in the retrial to find him guilty,” said one juror, who declined to give her name.
The jurors deliberated about seven hours over two days. They sent several notes requesting clarifications on testimony in the case.
The injuries that killed Trey indicated he suffered a brutal beating.
The boy was so badly beaten from behind that his kidneys moved to the front of his body and he suffered 13 broken ribs. His liver was lacerated, his adrenal glands were destroyed and his lungs collapsed, according to testimony.
Roberson “stomped him, kicked him, punched him, did whatever he did to him,” prosecutor Carmen White told jurors in closing arguments Thursday. Within seconds, “that kid was dying.”
Defense attorney Bill Cox argued that Trey’s mother, Precious Williams, could have caused her son’s fatal injuries. Williams testified that she did not believe Roberson would hurt her son, but she said she did not abuse him.
Williams was at the store when paramedics were called to their Love Field-area home. Roberson told police that the boy became lifeless and got a bloody nose during a diaper change.
Roberson changed his story about what happened during two interviews. One interview was recorded on audiotape. The second was captured on video.
Prosecutor Shequitta Kelly acknowledged to jurors that Williams was not an ideal mother and should have left Roberson after Trey was previously discovered to have bruises.
But she told them it was impossible for her to be the one who killed Trey.
“You might not like her,” Kelly said. “You might think she sucks as a mother.”
Williams was not seen in the courtroom Friday.
After the mistrial, Kelly said the case is not over.
“We are looking forward to proceeding again,” Kelly said. “Seeking justice on behalf of little baby Trey.”
Prosecutors could opt to pursue a first-degree felony charge of injury to a child.
That charge is easier to prove than capital murder and carries a punishment range of five to 99 years or life in prison.
Snipes was sitting in for state District Judge Robert Burns, who presided over the trial before Friday.
Roberson, who had a daughter with Williams, remains in the Lew Sterrett Justice Center, where his bail is set at $1 million.

Prosecutors said they would retry Alex Roberson, though it is unclear whether he might face a lesser charge than capital murder in the killing of 20-month-old Trey Jenkins. Had the jury convicted him, Roberson would have faced an automatic life sentence with no possibility of parole.
“Regrettably, it does appear to me that the appropriate thing to do at this time is to declare a mistrial,” state District Judge Mike Snipes said.
Most members of the jury left the Frank Crowley Courts Building without commenting. Several appeared as if they had been crying.
“I hope there’s going to be enough evidence in the retrial to find him guilty,” said one juror, who declined to give her name.
The jurors deliberated about seven hours over two days. They sent several notes requesting clarifications on testimony in the case.
The injuries that killed Trey indicated he suffered a brutal beating.
The boy was so badly beaten from behind that his kidneys moved to the front of his body and he suffered 13 broken ribs. His liver was lacerated, his adrenal glands were destroyed and his lungs collapsed, according to testimony.
Roberson “stomped him, kicked him, punched him, did whatever he did to him,” prosecutor Carmen White told jurors in closing arguments Thursday. Within seconds, “that kid was dying.”
Defense attorney Bill Cox argued that Trey’s mother, Precious Williams, could have caused her son’s fatal injuries. Williams testified that she did not believe Roberson would hurt her son, but she said she did not abuse him.
Williams was at the store when paramedics were called to their Love Field-area home. Roberson told police that the boy became lifeless and got a bloody nose during a diaper change.
Roberson changed his story about what happened during two interviews. One interview was recorded on audiotape. The second was captured on video.
Prosecutor Shequitta Kelly acknowledged to jurors that Williams was not an ideal mother and should have left Roberson after Trey was previously discovered to have bruises.
But she told them it was impossible for her to be the one who killed Trey.
“You might not like her,” Kelly said. “You might think she sucks as a mother.”
Williams was not seen in the courtroom Friday.
After the mistrial, Kelly said the case is not over.
“We are looking forward to proceeding again,” Kelly said. “Seeking justice on behalf of little baby Trey.”
Prosecutors could opt to pursue a first-degree felony charge of injury to a child.
That charge is easier to prove than capital murder and carries a punishment range of five to 99 years or life in prison.
Snipes was sitting in for state District Judge Robert Burns, who presided over the trial before Friday.
Roberson, who had a daughter with Williams, remains in the Lew Sterrett Justice Center, where his bail is set at $1 million.

This is just outrageous!!! He probably had relatives on the jury. No justice here! I can't imagine who would want to hurt the sweet boy...the picture of him feeding his infant sister says it all.

But Trey’s mother, Precious Williams, who was at the grocery store when Trey was beaten, told jurors that she did not believe Roberson would hurt her son. She said Roberson, Aiyana’s biological father, loved Trey even though they weren’t related.
“I don’t feel like he would ever harm Trey,” she testified while being cross-examined by Roberson’s defense attorney, Bill Cox. She said that Roberson dropped out of school to care for Trey and kept him while she worked.
This woman knew this POS was abusing her baby. She allowed it to continue until he beat the little precious boy to death. Then she stoot up for the POS.
Trey was so badly beaten from behind, Kelly and fellow prosecutor Carmen White told jurors, that his kidneys “flew to the front of his body.” His adrenal glands were destroyed, his liver lacerated, his lungs collapsed and he had broken bones. The blow or blows caused feces to shoot “everywhere,” Kelly said.
I don't understand why these women aren't arrested also with the men who murder their babies. She at the very, very least is guilty of neglect.

So, this monster POS gets to live. Poor Trey didn't have that chance.
