KYRA KING - 5 Months (2009) - Lakeland FL
A Lakeland man was arrested Thursday on murder charges in the death of
his 5-month-old daughter after his 5-year-old son demonstrated for
detectives how he slammed the girl's head into her crib, deputies said.
Timothy King, 31, was arrested on first-degree murder charges in the death of his daughter, Kyra.According
to the Polk County Sheriff's Office, King called 911 on July 9 to
report that his baby girl was not breathing and had mucus coming out of
her mouth.A Polk County deputy sheriff performed CPR on the baby
and was able to resuscitate her, and she was transferred to St.
Joseph's Children's Hospital in Tampa, deputies said.Medical
test results showed that Kyra had several hemorrhages inside her head,
bruising to her head and lower back and old fractures on her left arm
that had gone unreported and untreated, deputies said. She had no brain
activity and was being kept alive by life support, which was
disconnected on July 10, according to the Polk County Sheriff's Office. An
autopsy showed the bruises resulted from at least four and possibly
more separate strikes from a blunt force object, according to the
medical examiner, who ruled the cause of Kyra's death to be blunt
impact with subdural and subarachnoid hemorrhages and the manner of
death to be homicide.Detectives interviewed Kyra's 5-year-old
brother on Monday, and he said that he saw his father slam Kyra's head
into the crib, according to the sheriff's office. The detectives asked
the boy to demonstrate the actions with a doll, and he slammed it
head-first onto the ground two times, deputies said. When the
detectives asked the little boy when Timothy did this to Kyra, he
replied, "The other day," according to the sheriff's office."This
baby suffered significant pain for at least the last three or four
weeks of her life when the bones in her arm were broken. It is
inconceivable to me how anyone could inflict that kind of injury on a
baby, much less how anyone could beat this beautiful baby to death the
way Timothy King did," Polk County Sheriff Grady Judd said. "Now he is
behind bars where he belongs, where he cannot hurt any more children."

Kyra
This Man should be put away for the rest of his life.. He is a pig and deserves everything he gets..He ruined his wife and son's life not to mention the life of Kyra. I feel that if he couldn't handle being a father and husband why did he just not leave instead he hurt's this innocent child that can't even do anything for herself.I am disgusted with him i hope he stays in prison for the rest of his life or better yet get the death penalty. My prayers for his wife and son.. He will get what he deserves..

Murder charges against Timothy King dropped
http://www.wtsp.com/news/local/story.aspx?storyid=163000
Bartow, Florida - Timothy King, 32, of Lakeland has spent 15 months in jail accused of killing his 5-month-old daughter.
His trial was supposed to start next month until a the state made a surprising move on Thursday.
Back in July of 2009, Lakeland Police arrested King at his home after his daughter, Kyra King, died while in his care.
King has always maintained his innocence, saying he thought something was wrong with her when he picked her up from daycare that day.
Police say the baby died from blunt force trauma to her head at the hands of her father.
Then, almost one year to the day of Kyra's death, another 5-month-old child, Zachary Quijano, suffered a "strikingly similar" death at the same exact daycare, Wilson's Child Care in Lakeland.
King's lawyers say that evidence swayed the state to drop the charges.
"It was exhilirating and thrilling yesterday to have this man, who we all here believed was innocent, to have that vindicated in court, and now he can go on with his life. It is not going to be the same life because nobody could have the same life after going through this," said King's lawyer, public defender Candy Murphy of the 10th Judicial Circuit.
During his time in jail, King wasn't able to grieve with his wife, Christine, over the death of their daughter.
He was also not allowed to see his 6-year-old son, T.J, because the Department of Children and Families opened up their own case.
That investigation is separate from the criminal one and is not yet resolved, with only one week left before Christmas.
While King has been cleared, the question now is, what happens to the daycare? 10 News is going to find that out in the coming days.

'Similar Death' Could Rock Trial of Man Accused of Killing His 5-Month-Old Daughter
Judge to decide if jurors will hear about another case under same baby sitter.
BARTOW | For more than a year, Timothy King has sat in jail, accused of beating his 5-month-old daughter to death.
The 32-year-old Lakeland man repeatedly denied to detectives that he ever harmed his daughter, Kyra King. He faces charges of first-degree murder and aggravated child abuse.
Now with his trial looming, King's lawyers say jurors should hear evidence of what they describe as a "strikingly similar" death that occurred this year of another 5-month-old child, Zachary Quijano, who was in the care of the same baby sitter who watched King's daughter.
Prosecutors argued in a motion that the boy's death shouldn't be discussed at King's trial because it "would result in confusion of the issues and speculation."
The trial is set to begin Jan. 10.
After hearing testimony Wednesday, Circuit Judge Dennis Maloney said he would make a decision in about a week.
Meanwhile, the judge agreed to set bail at $50,000 for King, who has been held without bail since his arrest in July 2009. He remained at the Polk County Jail on Wednesday night, according to the jail website.
If released, King must live with his mother and cannot have any contact with children, including his 6-year-old son, T.J. King, who is a witness in the case.
T.J. King was questioned in court Wednesday. He agreed with a defense lawyer that his father "dropped" his younger sister on a mattress. He also agreed with a prosecutor that his father "slammed" the baby on the bed.
The boy said the event took place on the day that fire trucks came to his family's house on Hamlet Circle.
King's lawyer, Assistant Public Defender Amy Thornhill, said the boy testified at a deposition that the incident took place on a different day. She also argued that the boy's description of Kyra King being dropped on a mattress wouldn't create the injuries that killed her.
Thornhill insisted jurors should know how circumstances of Zachary Quijano's death almost a year later while her client was still in jail mirror those of Kyra King.
"I can't see how it could be more relevant," she said.
Both children had been under the care of the same baby sitter, Terri Wilson, Thornhill said.
Autopsy results showed each baby had distinctive parallel bruises on the backs of their heads, and each had the same cause of death, according to court records and testimony.
Dr. Vera Volnikh of the Polk County Medical Examiner's Office testified Wednesday that Zachary died from blunt force trauma to the head, and his death is classified as a homicide.
No one has been charged with his death, which took place July 1. An investigation remains open.
After the boy's death, the Florida Department of Children & Families obtained a court order to stop Wilson from operating her business, Wilson Family Home Daycare on Woodvine Circle in Lakeland.
At Wednesday's hearing, Wilson testified that she didn't have any idea what happened to either child.
She recalled taking care of Kyra King on July 9, 2009.
She said the girl was vomiting, didn't have an appetite and wasn't acting normal. Wilson said she texted the girl's mother, and Timothy King came to pick up the child.
Arrest reports state that Timothy King told detectives he brought his daughter home. He said he called 911 after finding her slumped over and not breathing, with mucus coming out of her mouth.
The girl was taken to St. Joseph's Children's Hospital in Tampa and taken off life support the next day, July 10.
An autopsy revealed the girl had multiple bruises, a skull fracture and brain hemorrhaging, reports show.
Wilson testified Wednesday that she and members of her family were present about the time of Zachary Quijano's death earlier this year.
Wilson said her daughter put the boy down for a nap, and her daughter later went to check on him and discovered the boy wasn't breathing. Wilson's husband called 911.
An autopsy later revealed bruising on the boy's head, and his brain was extremely swollen, according to medical examiner testimony.

Re: KYRA KING - 5 Months (2009) - Lakeland FL
BARTOW | The family of a 5-month-old Lakeland girl who died from brain injuries is suing the girl's babysitter.
The lawsuit is the latest
development in the unusual homicide case of Kyra King. The girl died
July 10, 2009, of head trauma after her father, Timothy King, picked her
up at Wilson's Family Day Care.
Timothy King was accused of killing the girl and spent 15 months in jail
awaiting trial. But prosecutors dropped all charges against him after
another 5-month-old baby, Zachery Quijano, died in the care of the same
Lakeland babysitter who had also watched Kyra.
Autopsy results showed each baby had parallel bruises on the backs of their
heads, and each died from blunt force trauma to the head, according to
court records and testimony.
In December, the State Attorney's Office concluded it couldn't legally
prove first-degree murder and aggravated child abuse charges against
Timothy King and he was released.
King's wife, Christine, filed a wrongful death lawsuit Wednesday on behalf of herself and her husband.
The lawsuit claims Kyra's former babysitter, Terri Wilson, "negligently and
carelessly failed to use reasonable care in providing paid child care
services."
On Friday, Terri Wilson told The Ledger that she doesn't know what happened to the
girl. "I gave her tender, loving care," Wilson said.
But the lawsuit contends Kyra King died from head trauma suffered while at
Wilson's day care center on Woodvine Circle in Lakeland.
The lawsuit also mentions Zachery's death about a year later from "similar trauma" while being care for at the day care center.
After the boy's death, the Florida Department of Children & Families obtained a court order to
stop Wilson from operating her business.
Wilson has testified before in court that she doesn't have any idea what happened to either child.

I moved this case back to Unresolved from Resolved~Other based on the latest revelations.
I feel that yet there could be some charges placed against the babysitter, especially with a similar recurrence.
