A Winston-Salem woman has been arrested and charged with multiple sex offenses involving a 9-year-old girl.

Charges against Heidi Lynn Weidemann, 32, of Goldfloss Street
include first-degree sex offense, felony child abuse involving a sexual
act and failing to register as a sex offender.

The records show that the offenses occurred Jan. 17 through April 4
and that Weidemann allowed her boyfriend, Jesse McNeely, to perform a
sexual act on the girl.

Weidemann was being held yesterday in the Forsyth County Jail with bond set at $2.5 million.

"Jane Doe" - 9 yo - Winston-Salem NC Empty Winston-Salem man sentenced to at least 48 years for sexual abuse of girl

A man who is already a registered sex offender will spend at least 48 years in prison after a Forsyth County jury convicted him Monday on charges that he sexually abused a 9-year-old girl.

The jury convicted Jessie Olin McNeely, 46, of Goldfloss Street on six counts of first-degree sex offense and two counts of taking indecent liberties with a child.

Assistant District Attorney Kia Chavious asked for the harshest sentence possible, calling McNeely a predator.

"This child was in her house, and this man took advantage of her in every way possible," she said.

Judge A. Moses Massey of Forsyth Superior Court sentenced McNeely to 48 years to 59 years and two months in prison on the first-degree sex-offense charges. McNeely was also sentenced to two consecutive terms of 21 months to 26 months on the indecent-liberties charges, which will be served at the same time as his sentences on the first-degree sex charges.

McNeely was convicted in 1992 in Catawba County of taking indecent liberties with a child and was ordered to register as a sex offender. He was released in 1998 after serving six years in prison. On Monday, Massey ordered McNeely to register as a lifetime sex offender and be enrolled in satellite-based monitoring for the rest of his life.

McNeely said nothing before his sentencing and did not testify during the trial, which started last week. The jury started deliberations late Friday afternoon and reached a verdict just after noon Monday.

A 12-year-old girl, the victim in the case, testified last week that McNeely started sexually abusing her when she was 8 and was living with her family in Statesville. McNeely was a friend of the family.

The Winston-Salem Journal does not publish the names of alleged victims of sexual assault.

The girl said McNeely continued to sexually abuse her when she was 9 and moved to Winston-Salem with her family. She said McNeely threatened to hurt her and her family if she told anyone.

Cara Smith, one of McNeely's attorneys, said in closing arguments Friday that the girl's statements were significantly inconsistent about the alleged sexual abuse. During cross examination, the girl acknowledged that she had lied in the past about things such as taking items from her classmates and stealing money from her grandmother. She also acknowledged that she had provided details about the abuse to prosecutors that she didn't give to Winston-Salem police and others.

Prosecutors introduced DNA evidence from semen found on a pair of the girl's panties in a laundry basket. But Smith argued that the semen could have come from other clothing in the basket and that the pattern of the semen was inconsistent with the girl's statements to police and prosecutors.

During the sentencing hearing, Smith argued for a consolidated sentence, saying in court that McNeely had changed since he was first incarcerated in 2009. He had met daily with a minister in the Forsyth County Jail and had devoted himself to Bible study, Smith said.

She gave notice of appeal Monday. She and Charles Mellies, another attorney for McNeely, declined to comment.

McNeely also faces pending criminal charges in Statesville related to alleged sexual abuse of the girl.

Heidi Lynn Weidemann, a co-defendant, will be sentenced today on charges she allowed McNeely to sexually abuse the girl. She pleaded guilty in April to child abuse and other charges.

"Jane Doe" - 9 yo - Winston-Salem NC Empty Woman sentenced after her convicted on child abuse charges

Post by Rainydaysend Thu Jan 12, 2012 8:18 pm

A Winston-Salem woman apologized Tuesday for her role in allowing a registered sex offender she was dating to sexually abuse a 9-year-old girl.

"I should have seen the signs, but I can't go back and change it," Heidi Lynn Weidemann said in Forsyth Superior Court.

Weidemann, 34, of Goldfloss Street pleaded guilty in April to two counts of felony child abuse involving a sex act and two other related charges in which she was accused of aiding and abetting her boyfriend at the time, Jessie Olin McNeely Jr., who was convicted Monday on charges that he sexually abused the girl.

As part of her plea arrangement, Weidemann faced the possibility of testifying against McNeely during his trial, but she was never called to the witness stand.

Judge A. Moses Massey sentenced Weidemann to 25 months to 39 months in prison and also gave her a total suspended sentence of 41 months to 59 months.

Weidemann, however, will only spend about 60 more days in jail because Massey gave her credit for the 27 months she was in the Forsyth County Jail awaiting trial. When she is released, she will be on supervised probation for three years and will have to register as a sex offender for 30 years.

On Monday, a Forsyth County jury convicted McNeely, 46, of six counts of first-degree sex offense and two counts of taking indecent liberties with a child. Massey sentenced McNeely to 48 years to 59 years and two months in prison on the first-degree sex offenses. McNeely was sentenced to two consecutive terms of 21 months to 26 months on the indecent-liberties charges, which will be served at the same time as his sentences on the first-degree sex charges.

McNeely was a friend of the girl's family and lived with the family in Statesville and later in Winston-Salem, according to testimony. The girl, now 12, testified during the trial that McNeely started sexually abusing her when she was 8 and living in Statesville. She said the abuse continued when she was 9 and had moved with her family to Winston-Salem.

Assistant District Attorney Kia Chavious said in court Tuesday that Weidemann knew McNeely was a registered sex offender after she started dating McNeely. Chavious said Weidemann knew about the sexual abuse and did nothing about it.

McNeely was convicted in 1992 in Catawba County of taking indecent liberties with a child and was ordered to register as a sex offender. He was released in 1998 after serving six years in prison.

John Combs, Weidemann's attorney, said McNeely told Weidemann that a teenager had falsely accused him of indecent liberties but that he pleaded guilty to the Catawba charge because he felt he had no choice. Weidemann believed his explanation, Combs said.

Since she has been incarcerated, Weidemann has led Bible study at the jail and completed a Christian-based rehabilitation program, Combs said. She is taking responsibility for what she has done, he said.

The girl now lives with a relative in another state.

I hope that nasty child sex abuser has to serve every bit of his 48-56 years. The court should know that he will do it again when he gets out so they need to keep him in there and should castrate him. Then he shouldn't bother any more littel girls. And the child's mother should have gotten more time as she knew the POS was a sexual deviant and was molesting her daughter and didn't do anything about it. So sick!
