A 3-year-old girl has died after a five-day stay in Riley Hospital for Children in Indianapolis. The
child, Kimberly Snow, was admitted to the hospital after an incident
last Thursday (May 2009), when police received a call to help an unresponsive
3-year-old child. Kimberly was first taken to Home Hospital but
was transferred to Riley shortly thereafter, where she remained in
critical condition for several days. She died at 5:30 p.m. on Tuesday.
She had been left in the care of her mother's boyfriend 31-year-old, Thomas Dexter. Dexter
was arrested last week on suspicion of Neglect of a Dependent Causing
Serious Bodily Injury and Aggravated Battery. On Wednesday the
Tippecanoe County Prosecutor charged Dexter with Neglect of a
Dependent, a Class A felony. The court affidavit said the child was examined
by doctors at Riley Hospital, who found serious head trauma. These
documents also show that police spoke with Dr. Hibbard, who is known to
be a leading expert in the State of Indiana in child abuse
examinations. Dr. Hibbard examined Kimberly and confirmed the head
trauma, as well as a compression spinal fracture, and retinal
hemorrhages in both eyes. The affadavit states that Dr. Hibbard
said that Kimberly's injuries were caused by inflicted trauma and could
not have been accidental. The child's mother, Amber Haper, had
left home around 9:15 a.m. to attend an appointment. The affadavit said
that Haper told police Kimberly was getting dressed as she left for her
appointment and was healthy and uninjured at the time Court
records say Dexter first told police he left the girl in the bathtub
and when he returned to check on her, she was unresponsive. When
two Lafayette Police detectives spoke with Dexter again, asking him to
explain Kimberly's extensive injuries, court documents show that his
story changed. Though Dexter initially said he found her
unresponsive in the bathtub, he then told detectives that Kimberly wet
her pants, so he took her into the bathtub to change her clothes and
clean her up, the affadavit said. According to the affadavit, Dexter
said he was playfully tossing her when he accidentally dropped her into
the bathtub, causing her to strike her back on the edge of the tub and
hit her head on the bottom of the tub. The documents further say that
Dexter said he picked her up and was carrying her when he accidentally
struck her head on the door frame or short wall as he left the bathroom
to go downstairs. The Marion County Coroner's Office is
conducting an autopsy and have told police that the child's death was
hemhorrage due to blunt force trauma to the head, but the final autopsy
report will not be available for several weeks. There was initial delay
in filing charges while the Tippecanoe County Prosecutor awaited
information from the autopsy. Dexter posted bail and is no longer in the Tippecanoe County jail.

A Lafayette man faces a
minimum of 50 years in prison for throwing his girlfriend's 3-year-old
daughter in the air, causing fatal injuries when she fell headfirst
into a bathtub.
The
Tippecanoe Superior Court 2 jury deliberated for 90 minutes Friday
afternoon before finding Thomas A. Dexter, 31, guilty of neglect in the
May 5, 2009, death of Kimberly "Kimmy" Snow.
This
came after three days of testimony from witnesses who included medical
professionals, law enforcement and the victim's family.
Dexter did not testify.If
throwing a possibly still-wet toddler in a small bathroom and over a
bathtub, "the child would likely land on her head," Dr. Roberta
Hibbard, a child abuse specialist at Riley Hospital for Children in
Indianapolis, told jurors.
"That would be a significant impact. ...
To have retinal hemorrhaging is very unusual in children."
Hibbard
was one of several medical professionals who treated Kimmy after she
was transferred from Home Hospital to Riley on April 30, 2009.
The
allegations against Dexter stem from that morning. At the time, they
were living at 3032 Phipps Court in the Country View Estates apartment
complex on Lafayette's south end.
Dexter
was watching Kimmy while her mother, Amber Haper, took a younger
sibling to a Women Infants and Children Inc. appointment in Lafayette.
A
frantic Dexter called 911 about 9:50 a.m., reporting that he found
Kimmy's face partially submerged in bathwater. The 911 recordings were
played for jurors.
"She's
breathing off and on. Her eyes are open," Dexter is heard telling a
police dispatcher. "She was in the water not even 10 minutes.
"
He then called Haper at the WIC office."Tom was crying, not understandable,"
Haper testified on Wednesday. "He was babbling hysterically."
It wasn't long,
however, before doctors realized that Kimmy's injuries were not consistent with a near-drowning.
She
had bleeding on her brain, retinal hemorrhages and a compression
fracture in her back -- meaning vertebrae in her spine were broken,
according to court documents, testimony and evidence presented during
this week's trial.
About
eight hours after the initial 911 call -- at 6:11 p.m. on April 30,
2009 -- Dexter then provided detectives at the Lafayette Police
Department with a different version of what happened to Kimmy.
Because Dexter did not testify, what jurors heard came from audio recordings of investigative interviews.He
claimed that he tried flipping Kimmy in the air, as he'd done before,
shortly after the girl finished her bath. But this time, he wasn't able
to catch her.
Though
detectives doubted the story -- pointing out that they, too, have
played with their own children similarly -- Dexter explained, "I do it.
I do it dangerously.
"Anything
I tell you guys is not going to be right. It's not going to be what you
want to hear. ... I didn't do anything to her."
He's heard sobbing on
several instances during the interviews.
Dexter's
attorney, G. Allen Lidy of Mooresville, argued that Kimmy's injuries
were accidental and did not amount to the legal definition for neglect
of a dependent.
Indiana defines it as knowingly or intentionally placing
a child in a situation that endangers his or her life.
Jurors disagreed with Lidy]Following
the neglect verdict, they then found Dexter guilty of being a habitual
offender. He has prior felony convictions in Tippecanoe County for
theft and residential entry.
That
means 30 more years will be tacked onto Dexter's possible sentence,
Prosecutor Pat Harrington said. Neglect of a dependent causing death, a
Class A felony, is punishable by 20 to 50 years in prison.
Dexter instead faces 50 to 80 years when he's sentenced March 3 by Judge Thomas Busch.

Dexter sentenced for toddler's death


LAFAYETTE, Ind. (WLFI) - A Lafayette man was sentenced today to 60 years in prison for the death of his girlfriend's daughter.
Only 55 years will be served because the judge suspended five years.
32-year-old Thomas Dexter was convicted in January of neglect of a dependent causing death.
Dexter told police he was watching three-year-old Kimberly Snow.
He said he playfully tossed her in the bathtub, but accidently dropped her causing her to hit her head and back.
He said he then picked her up and accidently struck her head on the door frame.
The child died five days later.
