DIONNA and KADEN WARREN - 17 and 5 months (2009)/ Convicted: Father; Michael Jon Ervin Jr. - Valrico FL
Being exposed to extreme heat for a long time killed the two babies
whose father brought them to Brandon Regional Hospital two weeks ago. When
he arrived at the hospital emergency room, they were suffering from
"environmental hyperthemia,'' and it killed them, according toi
Hillsborough's Medical Examiner, Vernard Adams. That conclusion
was the basis for charging Michael Jon Ervin Jr., father of
17-month-old Dionna Ervin and 5-month-old Kaden Warren, with two counts
of aggravated manslaughter of a child, Hillsborough Sheriff's officials
said Friday. The children had been in Ervin's "exclusive care, custody and control'' that afternoon, deputies said in a news release. Detectives arrested Ervin, 26, at his Valrico home at 3807 Ridgeview Place Friday without incident, officials said. A
neighbor, Tom Powers, said detectives were at Ervin's house in the
morning, left before noon, and came back again, walking him out in
handcuffs.Three cars were parked outside the home hours after
Ervin had been arrested, but a woman who answered the door said the
family did not want to comment.•••On Aug. 13, Ervin,
arrived at Brandon Regional Hospital at 2:50 p.m., pulling into the
entrance to the hospital's women's center and asking for help.Miraye
Miller of Brandon was in the hospital at the time to have her own child
treated, and described the frantic efforts to save Ervin's son and
daughter. She described doctors surrounding the two tots, as nurses riding on the stretchers with the children gave them CPR. Doctors later said the infants had core temperatures so high that it stunned the medical staff who rushed to their aid. They couldn't save them. The high in Brandon on that Thursday was 93 degrees, according to Weather.com. •••Jan
Null, a hyperthermia expert and meteorology professor at San Francisco
State University, said he has heard about the Tampa case.Children are far more susceptible to heat than adults, he said. Infants and children's bodies heat up three to five times faster than adults, he said. Children have less fully developed thermoregulatory systems, he said. The younger they are, the faster they heat up. There
is no widely recognized standard for how long a child can endure heat
before being in danger of hyperthermia, he said. Child safety advocates
say they shouldn't be left alone at all. Florida law says no
child under six can be left unattended in a vehicle for more than 15
minutes, and a child cannot be left in a vehicle for any period of time
if the motor is running or the child's health is in danger. At 104 degrees, heatstroke sets in. And at 107 degrees, the cells in the organs begin to die, Null said. Hot cars are deadly, killing an average of 37 children a year, Null said, but "they can die in any hot environment." Null
has a fact sheet on the San Francisco State Geosciences Department
website that charts average temperature rises in a closed car on a hot
day. It jumps 19 degrees in 10 minutes; 34 degrees in 30 minutes, 45 to
50 degrees in one to two hours. •••Ervin told detectives
he had been watching the children while their mother, Enidlin Warren,
worked, sheriff's officials said. He said both kids had been in a crib
or bassinet before he found them unresponsive. A spokeswoman
with the Florida Department of Children and Families said the family
has been the subject of abuse investigations, but she could not discuss
the cases. Both parents had been arrested before, but neither had been convicted. In
2003, Ervin was picked up on a marijuana possession charge. In 2004, he
was arrested on a criminal mischief charge. And in 2006 he was charged
with failure to appear in court. In each case, the charges were
dropped, court records show. Warren was charged in 2007 with
auto theft, dealing in stolen property and giving false information to
a pawn broker. The charges were dropped and, records show, she entered
a pre-trial diversion program. Deputies confiscated the family car and searched the home. An affidavit for a search warrant notes that they found marijuana on a television. It
also lists finding two white and orange capsules and a small plastic
bag with two white pills in the living room; a plastic container with
seeds and marijuana in a bedroom; a blue pill on the floor of the
bedroom and red, white and blue capsules in a linen closet. The report
did not list what the pills were. Detectives also confiscated Dora the Explorer sheets and blankets, a baby bathrobe, formula and a diaper.Neighbor
Tom Powers said Ervin moved to the quiet cul-de-sac nearly 15 years ago
with his mother, Valerie, and had become a nuisance in recent years. "Cars
would come to the house at all hours of the night, knock on the side
door and then leave," he said. "To me, this is no surprise."He said neighbors called this to the attention of sheriff's deputies, thinking the activity might involve drug dealing. "It's a sad situation for the children. They might still be alive if he had been arrested then," he said.

Two children were brought to the emergency room of Brandon Regional
hospital on August 13, 2009: 17 month old Dionna Ervin and her 5 month
old baby brother, Kaden Warren, and were pronounced dead shortly
afterwards. Tampa Bay residents wanted to know what happened.
After several weeks of speculation, an arrest has been made. Michael
Jon Ervin Jr. was arrested Friday, August 28, 2009 and has been charged
with 2 counts of aggravated manslaughter of a child.
Tampa
Bay residents had speculated that the children had been left in a hot
vehicle. Reports were sketchy and due to the ongoing information, many
details were kept from the public. However, reports did state that the
children arrived at the hospital with elevated body temperatures.
Authorities also seized the family’s vehicle and processed it for
evidence.
Medical Examiner Dr. Vernard Adams didn’t release
the cause of death immediately but has determined that the children
died from extreme environmental temperatures that they were exposed to
for an extended period of time, the cause of death is listed as
‘environmental hyperthermia.’
During the investigation, a search
warrant was served at the home of Michael Jon Ervin Jr. and the
children’s mother, Enidlin Warren, and detectives discovered drugs in
the residence. The drugs consisted of marijuana and pills. The
Hillsborough Sheriff’s spokesman did not name the type of pills that
were found in the home.
This is not Michael Jon Ervin’s first
arrest. He was arrested in 2003 for possession of Cannabis, in 2004 for
possession of Cannabis and criminal mischief, and in 2006 for criminal
mischief $1000 or more. Michael Jon Ervin Jr., is being held at the
Orient Road Jail without bond.

A Valrico man was denied bond at his 1st court appearance Saturday morning.
Detectives
from the Hillsborough County Sheriff's Office arrested Michael Jon
Ervin Jr. Friday on 2 counts of Aggravated Manslaughter of a Child.
The charges result from the deaths of his children, 18-month-old Zionna Ervin and 5-month-old Kaden Warren. Both
had an elevated temperature when Ervin brought them to the emergency
room at around at Brandon Regional Medical Center earlier this month. He
told hospital staff members at the time something was wrong with his
children and that they were not breathing. Both were unresponsive,
detectives said. While doctors were trying to revive his kids, investigators said Ervin fell asleep in the waiting room several times. After
several interviews and reviewing medical records, detectives determined
that while the children were in the exclusive care, custody and control
of Michael Ervin on the afternoon of August 13, they were exposed to
extreme environmental temperatures for an extended period of time.Medical Examiner Dr. Vernard Adams has determined the cause of death for both children to be environmental hypothermia.Investigators have still not confirmed whether the kids were left alone in a hot car, as neighbors told ABC Action News.A friend said that he and Ervin had been smoking marijuana the day the kids died, according to the Sheriff's OfficeA warrant was issued for Michael Ervin Friday, and he was picked up at his home in Valrico. He is being held at the Falkenberg Road Jail.

Re: DIONNA and KADEN WARREN - 17 and 5 months (2009)/ Convicted: Father; Michael Jon Ervin Jr. - Valrico FL
Four days after Zionna Ervin was born
prematurely, someone complained to child protective investigators that
her father was visiting her in the hospital while he was high or
intoxicated.
Eighteen months later, he was charged with aggravated manslaughter in the deaths of Zionna and her 5-month-old brother, Kaden. A document released Tuesday by the Florida Department of Children and
Families shows the children's parents, Michael Jon Ervin Jr. and
Enidlin Warren, have come under scrutiny in the past for their
parenting skills. In 2005, the case summary states, investigators
removed another child from Warren's care after she admitted to shaking
it. Warren agreed to place the child with a paternal grandmother.Warren, who was 21 at the time, said she was overwhelmed and had no support group or family to help her, the document shows. DCF
spokesman Terry Field said no further information on that case will be
disclosed because that child was not a part of the fatal incident that
happened Aug. 13.That was the day Ervin arrived at Brandon
Regional Hospital with Zionna and Kaden. Both children were
unresponsive, deputies say, and both had elevated body temperatures
caused by extreme heat that led to their deaths.Their
temperatures, according to an arrest report, were 105 and 109 degrees.
A medical examiner ruled they died as a result of "environmental
hyperthermia."Deputies said the children were in Ervin's sole care from 9 a.m. until he brought them to the hospital just before 3 p.m.Their mother was working, deputies say.Ervin told investigators he found the babies unresponsive in a crib and bassinet.A witness told deputies that earlier that around 11 a.m. that day, he and Ervin had smoked marijuana together.Ervin,
26, is being held at Falkenburg Road Jail without bail on two counts of
aggravated manslaughter of a child in connection with the babies'
deaths. In February 2008, child protective investigators were
called because of concerns that Ervin seemed to be high or drunk when
he visited Zionna at Brandon Regional Hospital. When interviewed
by a child protective investigator, Ervin said he did drink after
Zionna was born because of bad news about her health. He said doctors told him his daughter "died two times" when being born and that the odds of her staying alive were slim."He said he admits he made a bad decision and he appeared to be very remorseful," the investigative document states.Zionna was born at 33 weeks and suffered a bacterial infection that kept her under close medical monitoring, the report states. In
an April 2008 check-up on the family, an investigator wrote the family
appeared to be stable. They were attending a nurturing parents program,
though they missed the first class. The investigator wrote, "there were no indicators of substance misuse since this appears to be a one time incident." At
the time, Ervin declined services from the DACCO Center for Behavioral
Health, a center for substance abuse counseling and treatment.Field,
the DCF spokesman, said the last contact his agency had with the family
before the children were pronounced dead was in April 2008 when it
appeared they were doing well and the children were safe.Field
said parents who give birth after losing custody of an another child do
not get additional monitoring unless the court orders it.Investigators
monitor a family until they are assured the children are safe. Once the
child is placed in what investigators consider a safe environment, the
case is closed. In 2003, Ervin was picked up on a marijuana

Snipped from above article:
"Field said parents who give birth after losing custody of an another child do not get additional monitoring unless the court orders it."
This is ridiculous. ALL parents that lose custody of another child due to ABUSE should ALWAYS be monitored. No wonder there are so many repeat offenders. I also think any parent that abuses a child that ends in murder should be sterilized.

TAMPA - A Valrico man was sentenced to 10 years in state prison Monday after his two children died in August 2009 from elevated body temperatures.
Michael Jon Ervin Jr., 29, had pleaded guilty to two counts of aggravated manslaughter in the deaths of 18-month-old Zionna Ervin and 5-month-old Kaden Warren.
The medical examiner's office has said Ervin's children died of environmental hyperthermia. Authorities said Zionna's body temperature was 109 degrees and Kaden's was 105.
Authorities have said the children were apparently lifeless when Ervin took them to Brandon Regional Hospital.
Investigators got a warrant to search a car but did not confirm whether the children died from being left in a hot vehicle.
The defendant's mother, Valeria Ervin, pleaded for her son before the sentence was passed by Circuit Judge Scott Stephens.
"My grandchildren came from a home that was full of love," Valeria Ervin said.
"They were never neglected. They were always well cared for by both parents, as well as myself and their aunt, " she said.
"My son, he's a good father and this was a horrible accident."
The defendant did not speak at the brief sentencing hearing.
As part of the plea agreement, Ervin's prison sentence will be followed by five years of probation.
