Casey Anthony’s Defense Questions Death Penalty

ORLANDO -- It’s a significant day in court for Casey Anthony, as the judge listens to several key motions, including whether the death penalty is appropriate in her murder trial.
UPDATES FROM THE COURTROOM

11:49 a.m. -- The session is over
11:39 a.m. -- The Anthony family has left the courtroom
11:13 a.m. -- Defense attorney: "Seeking the dealth penalty will allow the prosecution to have a conviction seeking jury and will violate the rights of my client, Casey Anthony."
10:53 a.m. -- Defense argues the death penalty is not appropriate in this case. Prosecution has insufficient evidence in this case. There is no evidence of premeditated murder by Casey Anthony.
10:49 a.m. -- Defense begins arguments to remove death penalty option in the murder case.
10:42 a.m. -- Jose Baez argues that check fraud charges against Casey Anthony should be dropped due to double jeopardy. The judge says this check fraud case will be resolved before the capital case, either by plea or trial, and that she will be treated fairly by the judge, as she has no priors. If we get to the point of punishment, she will be treated just as all others.
10:27 a.m. -- Five-minute break.
10:25 a.m. -- The prosecution submitted a request to have a statement by Joe Jordan blocked from being released. They argue the statement was gotten illegally and therefore is not allowed to be admitted. Joe Jordan was a volunteer on the first search in Orlando for Caylee Anthony.
10:20 a.m. -- Judge Stan Strickland said he will review the privacy and public records issue later Friday. No word on when that ruling will come.
10:19 a.m. -- Attorney for the Orlando Sentinel argues that all the records should be kept public records, otherwise they are in complete violation of Florida’s open records laws.
10:15 a.m. -- Assistant Orange County Attorney: The county and the county jail cannot be forced to change media rules for one inmate. Those cameras are there for security for all members of the jail, inmates, staff, visitors, etc.
10:10 a.m. -- Casey’s attorneys ask the judge to stop video taping jail visits. If they don’t feel comfortable ordering Orange County to turn off the video of friends or family visits, they ask that they not be released to the public.
10:01 a.m. -- Attorneys for Casey Anthony are arguing that video cameras at the jail are infringing on her rights to privacy. Since the state is seeking the death penalty, the attorney's for Anthony argue that she is due to some privacy so she can have some private moments with her family and friends without the worry of having that become public record.
9:46 a.m. -- State will issue an investigate subpeona for a deposition for Dominic Casey which is scheduled for next Wednesday at the State Attorney's Office. Defense attorney Jose Baez will not be allowed to be there unless invited.
9:40 a.m. -- Motion to strike deposition. Attorneys for Dominic Casey say he doesn't want anything to do with the case anymore. State says they can subpeona whoever they want. Dominic Casey's attorneys say he doesn't want to be deposed because it will become public record and doesn't want to be exploited.
9:30 a.m. -- Hearing begins.
