Cole, 49, is being held on $250,000 bond. The judge also stipulated

chief medical examiner said an autopsy determined that the injuries
that led to the child's death were a result of child abuse.An arrest warrant was issued on Jan. 8 leading to Friday's arrest.Both
of the child's parents told police Cole took his son into a back
bedroom of their home to put the child to sleep, according to a police
report.Cole was alone with the child in the bedroom for a minimum of 30 minutes, according to the report.Cole
told police he heard a noise from his son and noticed he was not
breathing, according to the report. The baby's mother said she went to
the room and found Cole sitting next to the baby but not calling for
help or trying to help the child.
Nearly a year later, an infant’s death has been ruled a homicide and a parent has been arrested.Jacksonville police on Friday arrested Marshall Dale Cole IV, 42, on a charge of murder in the death of 3-month-old Marcus Cole.The

Drive home March 22. He was taken to a hospital and died three days

injuries were indicative of child abuse and an arrest warrant was

JACKSONVILLE, Fla. -- The jury in the trial of a man charged with murder in the death of his 3-month-old son found him guilty Thursday night.
Marshall Cole was accused of killing his son Marcus Cole.
In March 2009, the family was at home after a long day out, and while Marcus' mother was busy with one child, Marshall Cole was trying to put 3-month-old Marcus to bed, prosecutors said.
Prosecutors said Marshall was alone with Marcus in a room. Defense attorneys said Marshall claims that after several tries to put the baby to sleep, he fell asleep and woke to the baby not breathing and asked his wife for help.
His wife, however, said her husband was alone with the baby for at least 30 minutes, and she went up to the room to check on them and found her baby on the ground blue and not breathing and her husband doing nothing to help, prosecutors said.
"His skin was not even touching my son, and then the only thing he said -- the defendant said -- is that, 'I don't think he's breathing,'" Marshall's wife, Dioscora Cole said. "I picked up my son and told him to call 911."
Prosecutors said Marshall expressed no emotion during the 911 call, while his wife was heard wailing in the background. Marshall's wife testified he was laughing at the time of the baby's death.
According to the medical examiner, the baby was badly attacked and the death was the result of abuse. The medical examiner said the death was not accidental and was caused by purposeful injury, blunt force trauma to the baby's head and heavy shaking.
The defense has argued that no one really knows who hurt the baby, and Marshall is being blamed only because he was the last one with the baby.
Marshall testified that the baby's mother was to blame, claiming she shook the child too hard trying to get him to wake up and that she hurt the baby while trying to give him CPR.
