DOVER,Del. - A Smyrna couple has been charged with drowning their newborn son
and dumping his body in a trash bin at a Dover hotel.
On Monday, Dereke and Jeanne Moore were indicted by a grand jury in Kent County.

They face several charges including first-degree murder.
Court records state that on Nov. 7, Jeanne Moore gave birth in her home
and left the newborn in the toilet to drown.
Authorities say later Dereke Moore put the newborn in a trash bin at
the Dover Hampton Inn where he worked. The body of the infant was found two days later.
One of the prosecutors in the case says, the trial date has
been scheduled for Feb. 23 at the Kent County Superior Court.

Police charged a married couple that admitted to putting their newborn baby in a plastic bag and throwing him in a trash dumpster with murder by abuse or neglect.
The decision to charge Dereke Moore, 27, and Jeanne Moore, 28, both of the 900 block of Tamara Drive in Smyrna, Del., with murder came after a criminal and forensic medical investigation, Dover Police said.
Bayhealth Medical Center notified authorities that Jeanne arrived at the hospital
Nov. 9 for treatment of vaginal bleeding often associated with recent
childbirth.
Jeanne told hospital staff that she gave birth to a stillborn baby early
Saturday at her home and her husband then placed the infant in a trash
bag and threw it in a dumpster behind the Hampton Inn on Dupont Highway in Dover.
Police found the baby’s body in the dumpster and arrested the Moores. The couple told police the baby was still born.
The Moores have three other children.
The charges of abusing a corpse were elevated last week to murder and endangering the welfare of a child.

A Dover woman, arrested in November after the body of her newborn baby was found in a Dover hotel’s trash container, has agreed to a plea agreement in the death.
Jeanne A. Moore, 29, appeared in Kent County Superior Court May 25, where she pled guilty to a charge of second-degree murder by abuse or neglect. She originally was charged with first-degree murder by abuse or neglect, endangering the welfare of a child and abusing a corpse. The other charges were dropped.
Moore, who appeared in court handcuffed, shackled and dressed in a red Department of Correction outfit, said she understood the agreement, worked out between Paul Wallace of the state attorney general’s office and public defender Bill Deely.
Judge Robert B. Young set sentencing for Thursday, July 1, after a pre-sentencing investigation is completed.
Moore agreed to serve a minimum of 10 years in state prison, to be followed by probation, house arrest or other level of confinement.
She could have received the maximum term of 25 years behind bars.
In addition, Moore agreed to cooperate in the prosecution of her husband, Dereke R. Moore, 28, when he goes to trial in November. She also cannot see her husband or children except while under supervision from the state Division of Family Services, and must undergo mental health counseling.
At one point in the proceedings, Moore appeared hesitant, telling Young, “I want to take the plea, but I’m wondering if it’s the right thing to do.”
Her voice quavered slightly as she spoke.
“It’s scary,” she told Deely during a short consultation.
They both left the courtroom and returned after approximately five minutes with Deely confirming Moore understood the agreement.
Deely also confirmed the child in question was born alive, contrary to the Moore’s statements in November 2009 that it had been stillborn.

Del. woman gets 10 years in baby's death

A Smyrna woman who pleaded guilty to murder in the death of her newborn son last year has been sentenced to 10 years in prison.

Jeanne Moore was sentenced Thursday in Kent County Superior Court. Moore agreed to cooperate in the prosecution of her husband Dereke Moore, who faces charges of abusing a corpse, murder by abuse, and child endangerment resulting in death.

Moore told authorities the baby she delivered on a toilet in November was stillborn, and that her husband put the baby's body in a trash bin at a Dover hotel. It was found there days later.

According to a police warrant, the baby landed face down in the toilet and remained there.

A preliminary finding by the medical examiner's office indicated the child was stillborn. The couple was charged after a forensic investigation showed the baby was alive at birth.
