TRESHAUN LAMONT WILLIAMS - 16 months (2003) -Asheboro NC
ASHEBORO — The fate of Alex Jerome Trogdon, 29,
accused in the “shaken baby” death of Treshaun Lamont Williams, his girlfriend’s
16-month-old son, is expected to go to the jury this afternoon.
The
prosecution, led by assistant district attorney Kristian Allen, rested its case
Tuesday morning following the testimony of pathologist Dr. Ellen C. Riemer, who
performed an autopsy on Treshaun on Dec. 18, 2003.
At the close of the
state’s case, defense attorney Dick Roose made a motion, which was denied by
Superior Court Judge Stuart Albright, to dismiss the charges against his
client.
The defense will not call any witnesses and Trogdon will not
testify. Trogdon confirmed to Judge Albright that he understood the advantages
and disadvantages of testifying on his own behalf and of presenting evidence and
that it was his decision not to testify, nor to present
evidence.
Depending on the weather, closing arguments by the attorneys
are scheduled for Wednesday morning.
On Tuesday, Dr. Riemer testified that the cause of death was
blunt force injuries to the head that caused severe traumatic injury to the
brain, bleeding on the surface of the brain, brain swelling and bleeding in and
about the eyes and optic nerves. Riemer said the injuries were not
accidental.
Testimony last week was that Treshaun’s mother, Christal
Milton, left Trogdon at her residence on Farr Street, Asheboro, with Treshaun,
who was asleep on the sofa, while she went to pick up her two older children
from school.
When Milton returned, Trogdon was panicky, Treshaun was limp
and lifeless and she rushed him to Randolph Hospital where he was comatose.
Treshaun was airlifted to Wake Forest University Baptist Medical Center where he
was declared brain dead on Dec. 17.
The next morning, Milton and
Treshaun’s father, Walter Lamont Williams, made the decision to “let him go” and
to donate his organs.
Trogdon, Milton and Williams had numerous interviews with a Baptist
Hospital social worker and doctors, Asheboro Police, Randolph County social
workers and a State Bureau of Investigation agent.
Trogdon was
subsequently charged with first degree murder and turned himself in to Asheboro
police on Dec. 23. Trogdon has maintained his innocence from the beginning,
insisting to interviewers that there must be another explanation because he
would never hurt the child.
If he is convicted, Trogdon will not face the
death penalty, but could be sentenced to life in prison.
This is the
second trial for Trogdon on the charges. The first trial ended on Sept. 11,
2006. A mistrial was declared when the jury was deadlocked after three days of
deliberation.
