DAVID WAYNE BEACH III - 16 (2006) - Calhoun County/Parkersburg WV
A Calhoun County family is charged with kidnapping a Roane County
teenager who has been missing since 2006. William "Seth" Denmark, 22, was charged with kidnapping; William A.
Denmark, 58, was charged with conspiracy to inflict bodily injury; and
Jackie L. Denmark, 57, was charged with aiding and abetting kidnapping
in the disappearance of David Wayne Beach III. Beach, 17, was last seen in Spencer in May 2006. A criminal complaint
alleges that Veronica Cottrill informed deputies that Beach was likely
at the Denmark residence, near Orma. When investigators went to the
residence in May 2006, Jackie Denmark said she was unsure of Beach's
whereabouts. Investigators received additional information regarding Beach's
whereabouts in January of this year. A criminal complaint alleges that
Seth Denmark picked up Beach on Main Street in Spencer and took him to
the residence. Seth Denmark then asked Beach to help dig a large hole,
and Jackie Denmark took a photo of Seth Denmark and Beach spraying mud
off of each other after digging the whole. Seth Denmark and Beach then
got on a four-wheeler and rode up a hill, when Denmark later returned
alone, wanting Veronica Cottrill's help. According to the criminal complaint, Seth Denmark pulled out a pistol to
force Cottrill to accompany him. Cottrill was ordered to hold a shovel
while they rode a four-wheeler up the hill behind the Denmark
residence. The complaint also states that Cottrill saw Beach lying in a
hole. "William Seth Denmark then ordered Veronica Cottrill to hold the
flashlight while he covered the body of David Wayne Beach," the
complaint states. Cottrill told police, according to the complaint,
that Seth Denmark threatened her at gunpoint and "made proof of his
threats by shooting another person, David Wayne Beach, in the head with
the gun." On Feb. 23, 2010, officials conducted a search on the Denmark property,
but have not found David Wayne Beach. But according to the complaint,
investigators say that information from Cottrill was validated by
evidence found at the Denmark residence. Investigators believe that Jackie Denmark, "knows the location of David
Wayne Beach and is an active participant in concealing the whereabouts,"
the complaint states. Seth Denmark has been incarcerated at the Anthony Center since March
2009 when he was sentenced on felony charges of child endangerment. In October 2007, Denmark was arrested and charged with kidnapping three
juvenile girls. Denmark is being held in the North Central Regional
jail and his preliminary hearing is set for March 23, 2010. Jackie Denmark is also at the North Regional Jail, with a preliminary
hearing set for Thursday.

SETH DENMARK CHARGED WITH MURDER OF DAVID WAYNE BEACH III - New Forensics Build Case, Bullet Found In Grave
(05/28/2011)
"Seth" Denmark (L) accused of murdering David Wayne Beach III (R)
By Bob Weaver
Murder charges have been filed by the WV State Police against William Albert "Seth" Denmark, 23, for the death of teen David Wayne Beach, the murder allegedly occuring in 2006 at the Denmark farm on Cabin Run of the Beech Community, near Arnoldsburg.
Denmark has been incarcerated on kidnapping charges since January, 2010, after a Roane County woman told authorities she was held by Denmark, saying she witnessed the shooting.
The case has languished because a body was not found in a dug grave.
Investigators in the case re-visited the gravesite in March, 2010. The criminal complaint says the gravesite was unearthed, and according to Calhoun Prosecutor Rocky Holmes, soil and content of the grave was sent to the Smithsonian Institution in Washington DC for forensic analysis.
The complaint, filed Thursday in Grantsville, says new forensic information confirms a .38 caliber bullet was found in the grave and other samples indicated a human body was once at the site. Authorities have long contended Beach's body had been removed.
Cpl. Doug Starcher, lead investigator, said in the complaint that a ".38 caliber revolver recovered in March, 2010, was identified by the eyewitness to be the murder weapon used to kill ... Beach."
The criminal complaint also says the .38 caliber weapon was the gun Denmark used to shoot Aaron Lloyd in the leg in 2006, during another incident.
In an earlier Hur Herald story, a report said that a .38 caliber bullet lodged in Lloyd's body exited his body last year, and was recovered at a Spencer hospital, with Lloyd giving the bullet to the WV State Police.

DENMARK SEEKING BOND AND RELEASE OVER COURTS 'FAILURE TO PRESENT' - Related To Alleged Kidnapping-Murder Of Teen David Beach
(01/18/2012)
A case against William Seth Denmark, 24, for the alleged kidnapping and murder of teen David Wayne Beach, continues in Calhoun Circuit Circuit with Denmark's attorney Barbara Schamberger now requesting he be bonded and released from Central Regional Jail.
Judge David W. Nibert will hear a motion Wednesday for bond to be issued to Denmark for "failure of presentment" by Calhoun Prosecutor Rocky Holmes.
Denmark has been incarcerated on kidnapping and other charges since police went to the Denmark farm in early 2010, after a Spencer woman gave testimony that she witnessed Denmark burying teen David Beach in 2006.
During a December, 2011 hearing before Judge Nibert, the case was continued after being bound over from Magistrate Court.
Denmark has yet to be indicted on the murder charges filed in May, 2011.
This is the second time in just over one month that defense attorneys have ask Calhoun Circuit Court for reductions in high-profile cases, alleging the cases have not been prepared or presented in a timely manner.
Defense attorney John Oshoway, in December, requested a case against accused Calhoun bank robber Richard Vance be dropped because prosecutor Rocky Holmes had failed to provide discovery in a timely matter.

The Denmark case has had problems because a body was not found in a dug grave.
Investigators re-visited the grave-site in March, 2010.
The criminal complaint says the grave-site was unearthed, and according to Prosecutor Holmes, soil and content of the grave was sent to the Smithsonian Institution in Washington DC for forensic analysis.
The latest complaint says new forensic information confirms a .38 caliber bullet was found in the grave and other samples indicating a human body was once at the site. Authorities have contended Beach's body had been removed.

Also on Wednesday's docket, State vs. Matthew Ryan Nichols, for sentencing and 11 juvenile cases.

JACKIE DENMARK SUES TROOPER STARCHER OVER CIVIL RIGHTS VIOLATION - Suit Claims Abuse Of Legal System
(04/11/2012)
By Lawrence Smith, wvrecord.com
CLARKSBURG - A Calhoun County woman alleges she was falsely arrested by a West Virginia State trooper to leverage her cooperation in the investigation of a missing Roane County teenager.
Jackie L. Denmark on March 12 filed a civil rights suit against Cpl. D.B. Starcher in U.S. District Court. In her complaint, Denmark, 58, of Orma, alleges Starcher arrested her two years ago for the sole purpose of getting her son, William Albert "Seth" Denmark, to disclose the whereabouts of David Wayne Beach III.
According to the suit, Starcher with the Grantsville detachment first interviewed Denmark in May 2006 shortly after Beech, 17, from Spencer, was reported missing. Starcher and two deputies from the Roane County Sheriff's Department received information Beech might be at the Denmark residence.
In the course of the interview, Denmark denied knowing Beach's whereabouts.
Four years later, Starcher obtained a warrant to search the Denmark property. The warrant, according to the suit, was a result of Veronica Cottrill saying she, at gunpoint, was made to help Seth bury Beech's body on a nearby hillside.
In her statement, Cottrill stated Denmark was aware Seth abducted Beech, and later killed him. Though some evidence was discovered at the scene, Beech's body was never discovered.
Based mostly on Cottrill's statement, Starcher arrested Denmark on March 12, 2010, and had her charged with one count of aiding or abetting kidnapping. Following her arrest, Denmark remained in jail for an unspecified period before being released on bond that included a period of house arrest.
According to the suit, Calhoun Circuit Judge David W. Nibert dismissed the charge against Mrs. Denmark on April 2.
Her arrest, and subsequent incarceration, Denmark alleges, was done out of Starcher's "desire to accomplish a collateral advantage" of charging Seth with murder.
In the suit, Denmark states while Seth was incarcerated at the Anthony Correctional Center in Greenbrier County on unrelated charges prior to his arrest for Beech's kidnapping, Starcher interviewed him, and said he would have her arrested if Seth did not tell him the location of Beech's body.
In her suit, Denmark maintains Starcher's abuse of the legal process based largely on Cottrill's uncollaborated statement resulted in a deprivation of her constitutional rights.
As a result, Denmark says that along with losing her full-time job, she's "suffered great hardship, physical and mental emotional harm [and] enjoyment of life."
Denmark seeks unspecified damages, attorneys fees and court costs. She is represented by Henry E. Wood III of Charleston and Lee F. Benford II of Ripley.
The case is assigned to Judge Irene M. Keeley.

this is the most "sue happy" country in the world. it appears these days that criminals AND their families have more rights than their victims. i hope that this case is dismissed and she gets a tongue lashing from the judge. her son is the reason she has "suffered" so much.
