Police Chief Frank Gallegos said Friday that Jonathan Castellano
remains under care at Memorial Hospital.Otero County
Department of Human Services was granted custody of
the boy and his 4-year-old sister following a court hearing Friday.
Police are looking to see if there child abuse was involved.
Gallegos said the boy was taken to the Arkansas Valley Regional
Medical Center in La Junta by his mother, Shasta Nieto, late
Tuesday with injuries. The boy later was flown by Flight for Life to Colorado Springs.
Gallegos said Rocky Ford police responded to the hospital after
being called in by the La Junta Police Department.
"We were given the case Tuesday at about 10:15 p.m. as a
possible child abuse case. We have not determined if there was child abuse
involved," Gallegos said. "We are investigating the situation with
interviews of family members and doctors who have tended to the
boy. We are still trying to determine what exactly are the child's
injuries and how they may have been caused."
A Colorado Springs television station reported Friday that
family members indicated the boy had suffered from eight broken ribs and a
possible brain injury.
"There have been no arrests, and currently we do not have a suspect," Gallegos said.
Gallegos said police had not spoken with the boy's parents as of Friday.
Donna Rohde, Director of the Otero County Department of Human
Services, said Friday that the Department has filed restraining
orders against Nieto and the boy's father, John Castellano Sr., of
Denver, prohibiting them from making any contact with the boy.
Rohde said she could not say why that action was taken.
"It's in the early stages of the investigation. We are going to
put all our efforts into finding out what happened," Gallegos said.

COLORADO SPRINGS, Colo. -- A 14-month-old child is recovering at Memorial Hospital in Colorado Springs after suspected child abuse. According to the child’s father, Juan Castellano Sr., the baby has eight broken ribs and possible brain damage.
Hospital staff said the baby was put on life support Tuesday night, but was listed in serious condition as of Thursday morning. That means his condition has improved only slightly.
Castellano thinks the injuries happened Tuesday at his ex-wife’s home in Rocky Ford, about 55 miles southeast of Pueblo. He said that his ex drove the baby from Rocky Ford to Memorial Hospital and hospital staff alerted police.
Rocky Ford police are looking into what happened, but said they are still in the early stages of their investigation. Police Chief Frank Gallegos said the couple's children are now in the custody of the Department of Human Services.
Castellano spoke exclusively to NEWSCHANNEL 13 Wednesday night by phone from his home in Denver. He claimed he was in Denver when the suspected abuse happened and didn’t know about it until he got a call from the Department of Human Services.
“I was not involved in it,” said Castellano, but he believes his wife shook the baby. “It’s terrible, I’ve been crying the past two days,” said Castellano. He said restraining orders were filed against him and his ex-wife, “we can’t be 50 feet near him.”
Castellano is frustrated with the situation since he can’t get information about his child, he said. “We have to talk to Department of Human Services.”
Both Castellano and his ex-wife are scheduled to be in court on Friday. No charges have been filed as of Thursday morning.
