Judge denies Casey Anthony evidence request

Casey Anthony was in court Friday afternoon for an emergency hearing about the defense’s upcoming inspection of the evidence to be used against her. The defense has a right to inspect the physical evidence but they’re not allowed to be alone with the items. A representative of the State Attorney’s Office or the Sheriff’s Office is always present to maintain the integrity of the evidence to be introduced at trial.
Several experts are expected to accompany Anthony’s attorneys to view the evidence and the attorneys want to speak freely with the experts. The defense argued the presence of a law enforcement official would hamper any conversation. On Friday, defense attorney Jose Baez asked Judge Belvin Perry to appoint a special magistrate, a neutral observer, to oversee the defense’s visit.
Judge Perry considered the reasonableness of the defense’s argument but, in the end, denied the request. He ordered the State, however, to make available a room adjacent to the area where the evidence will be viewed so that the attorneys and experts can have private discussions throughout the day. The State is allowed to be present during the inspection which will occur on July 13 and 14.
The defense has until July 8 to present the State with a list of the items they want to inspect for each of the two days allotted.
Anthony was in court for the first time since she tripped in an elevator and injured herself on the way to court last month.
The next scheduled hearing is July 15 at which time the judge will entertain defense motions for copies of Texas Equusearch documents and preclusion of two of Cindy Anthony’s 911 calls placed exactly two years earlier, to the day. Cindy Anthony reported her granddaughter missing on July 15, 2008.
