DeMARIO MILLER - 8 Months (2009) - Buffalo NY

Darnell Miller, a learning disabled Buffalo man, today was ordered by
Erie County Judge Michael F. Pietruszka to spend the next 22 years in
prison for fatally beating his 8-month-old son to stop him from crying.
Miller has been jailed since shortly after the death of Demario
Miller following the assault last Oct. 26 in the family's Humason Avenue home.
Miller, 27, was silent as the judge imposed the stiff prison term.
About a dozen family members and friends of Miller were in court for
the sentencing. He was indicted on a single count of
second-degree murder last December and pleaded guilty
April 30 to a reduced charge of first-degree manslaughter after his
attorney, John R. Nuchereno, filed briefs on his medical and learning problems.
James F. Bargnesi, chief of the Erie County District Attorney's Homicide
Bureau, said Miller's estranged wife and her family were in "complete agreement" with
the plea deal, which came with a prosecution demand for a stiff prison term.
