Sterling CO ---- Authorities say the father and step-mother of a 3-year-old
girl that was killed in June were arrested on Monday for her death.
According to an indictment released by the Logan County District
Attorney, Ginger and Mark Weeks are both being charged with first-degree
murder by a person in a position of trust and child abuse resulting in
the death of 3-year-old Alexis McClain.

far back as October of 2009. Alexis' died from blunt-force trauma, authorities say.
The Logan County Sheriff's department arrested both Mark and Ginger Weeks on Monday.

Regional Medical Center. She was then taken to The Children's Hospital
in Aurora where she died on July 9.

The Logan County Sheriff's Office announced this
morning the arrest of Ginger and Mark Weeks in the death of 3-year-old Alexis McClain.
On July 8, the sheriff's office was contacted by
officials from Sterling Regional MedCenter after the toddler was
admitted to the hospital with critical injuries. She was transported to
Children's Hospital, where she died July 10.
Ginger and Mark Weeks, Alexis's parents, were arrested and booked at the Detention Center
Monday night on charges of child abuse-knowing/reckless cause of death, a
class 2 felony, and murder 1, a class 1 felony. The indictment was
signed by presiding Judge Michael Singer on Monday, July 19.
Mark Weeks is the father of Alexis McClain and Ginger
Weeks is her step-mother. The child's biological mother lives out of state,
according to LCSO Investigator Joe McBride. Both of the accused are
scheduled to be advised of their rights in Logan County District Court this afternoon.
Ginger Weeks also goes by the name of Bishop
Neguinness, and Mark Weeks has also used the name of Adam Weeks.
An autopsy has not been released yet, according to McBride. Logan County
Coroner David Tennant is in charge of the autopsy. The Colorado Bureau
of Investigation and the 13th Judicial District Attorney's office are
also involved in the investigation.
McBride said the Logan County Department of Social Services believes this to be the first child death
resulting from abuse in Logan County for 40 years.

Judge orders Mark Weeks' iPhone password released
Defense attorney appealing to Colorado Supreme Court

-- Mark and Ginger Weeks, the father and stepmother who were arrested
in July in the death of three-year-old Alexis McClain, appeared in a
joint status conference in District Court last week. Chief Judge Michael
Singer presided.
Mark Weeks was represented by Thomas Ward, public defender, and a new
attorney for Ginger Weeks, Christopher Collins attended via telephone.
Ginger Week's former attorney, Thor Bauer, withdrew due to ethical conflict the week before and the new attorney was appointed.
Representing the people was Assistant District Attorney Brittny Lewton.
According to court records obtained by the Journal-Advocate, a
motion was filed by the District Attorney in December requesting the
court to compel the defendant (Mark Weeks) to provide the password to
his iPhone. It was followed up with an objection filed by the
defendant's attorney in early January. The objection was overruled by
Singer.
During the hearing, the defendant's motion to reconsider the
objection was denied in accordance with the separate order granting the
people's request to compel the defendant to provide password
information.
According to Lewton, Ward said he would request a Rule 21 ruling
on the issue by the Colorado Supreme Court. Such a ruling is normally
made quickly, she said.
Lewton also said that Ginger Weeks had provided her iPhone password previously.
Ginger Weeks's attorney noted that he had not talked with Bauer
yet and he may have to ask to continue the proof evidence hearing.
Lewton responded that there was very little discovery
supplementation over the Bauer discovery and they would get whatever
Collins needs to him, saying they wanted him to have it as soon as
possible.
Singer told Collins that he should have a copy of exhibits and briefs a week before the proof of evidence hearing.
That hearing was set for 8:30 a.m. Feb. 25.
Singer noted that it would be a joint hearing; however, arraignments will take place on separate dates.

Mark and Ginger Weeks were in separate Logan County courtrooms for separate hearings this week in connection with the death of three year old Alexis McClain. Both are charged with first degree murder and child abuse in the child's death, but each pled differently. Ginger Weeks pled guilty to lesser charges. She'll serve a mandatory 12 years in prison for child abuse resulting in death. Mark Weeks pled not guilty to the charges. No trial date's been set for him yet. Ginger Weeks will be required to testify at Mark Weeks' trial. Both were arrested last July when Alexis was taken to Sterling Regional Medical Center with what officials said were injuries conducive to child abuse. She was then taken to Children's Hospital in Denver where she died a few days later.

A Logan County man was found guilty Tuesday night and sentenced to life in prison in the 2010 death of his 3-year-old daughter.
After less than four hours of deliberation, a Morgan County jury
found Mark Weeks guilty of first-degree murder and child abuse resulting
in death, said Robert Watson, 13th Judicial District attorney.
On July 8, 2010, Weeks' daughter Alexis arrived at Sterling Regional
Medical Center with a skull fracture. She was airlifted to Children's
Hospital Colorado, where she died the next day.
As soon as she arrived at the Sterling hospital, medical staff saw evidence of severe abuse and called police.
"We have reason to believe that she was abused in one form or another for the majority of her life," Watson said.
In addition to her skull fracture, Alexis had multiple bruises on her body and was recovering from a rib fracture.
After reading the verdict, the judge immediately sentenced Mark
Weeks, who was 27 at the time of the crime, to life in prison without
parole.
