A 27-year-old Omro woman was in custody after a baby died after being pulled from the partly submerged sport utility vehicle the woman was driving late Saturday.
The vehicle, a 2003 Ford Explorer, was mostly under water when found in the upper Fox River near a public boat landing in the unincorporated community of Eureka in southwestern Winnebago County.

Lt. Joe Kroncke of the Winnebago County Sheriff’s Department declined to say Sunday if the incident, reported about 10:45 p.m. Saturday, was the result of a traffic crash.

The release of most details of the incident, including the names of the child and driver, was “premature” Sunday afternoon, he said, because the investigation was continuing and all of the child’s close relatives were yet to be contacted.

Members of the Omro-Rushford Volunteer Fire Department pulled the baby from the vehicle and attempted to revive the child without success. The child was declared dead after being taken to Mercy Medical Center in Oshkosh.

An autopsy is scheduled today Monday at the Fond du Lac County medical examiner’s office.

The Omro woman was taken into custody in connection with the death of the child, Kroncke said, adding that the Winnebago County district attorney’s office will review the case after the investigation is completed.

The sheriff’s department’s dive team was called to search for the possibility of additional victims, Kroncke said. Investigators remained at the scene to gather evidence Sunday.

Police are recommending prosecutors file a charge of homicide by drunken driving against an Omro woman whose 8-month-old son died Saturday when her vehicle went into the Fox River at Eureka.
Capt. Steve Verwiel of the Winnebago County Sheriff's Department said investigators are asking for charges of homicide by intoxicated use of a motor vehicle and operating while intoxicated against Kayla Westenberger, 27.Police and firefighters who responded to the Eureka boat landing about 10:45 p.m. Saturday found Kayla Westenberger's son Richard in her sport utility vehicle, which was "mostly submerged," Verwiel said.Omro-Rushford firefighters pulled the baby from the vehicle and began life-saving attempts, but the child was pronounced dead soon after at Mercy Medical Center in Oshkosh.

Bond was set at $750,000 for an Omro woman accused of being drunk and high from marijuana when she drove into the Fox River at Eureka last weekend, killing her 8-month-old son.
Kayla B. Westenberger, 27, was charged Friday with first-degree reckless homicide, child neglect resulting in death and homicide by intoxicated use of a vehicle as a repeat offender.
Authorities said she left the scene of the incident while her son remained trapped inside the mostly-submerged vehicle.
Westenberger, who is five months pregnant, kept her face mostly hidden in her hands while she appeared in Winnebago County Court via teleconference with an appointed public defender by her side.
If convicted, she faces a maximum penalty of 131 years in prison and $200,000 in fines.
Dist. Atty. Christian Gossett said he requested an enhanced penalty because of Westenberger’s previous drug-related convictions and history of bail jumping. She has been convicted two other times for drunk driving as well as possession of drug paraphernalia and theft of moveable property.
“This is a woman who has been through the system not just once, but more than once,” Gossett said. “She faces some very serious penalties.”
Westenberger has remained in custody since last Saturday when police arrested her at a friend’s residence on County E in Eureka. Authorities found her son earlier that night dead inside her partially submerged sport utility vehicle at the Eureka boat landing.
An autopsy of Westenberger’s son found the cause of his death consistent with drowning.
According to the criminal complaint, Westenberger and a friend took the child for a drive and decided to watch the sunset while having a drink. Westenberger told police she drank blackberry brandy, and at some point later in the night she went to another friend’s house and had two or three hits off a marijuana pipe.
She later took her friend home before driving to the boat landing. She told police she didn’t remember taking her friend home, and she didn’t know how her vehicle ended up in the water.
Authorities said Westenberger went back to the friend’s house after the incident at about 7:40 p.m. and changed out of her wet clothes and went to sleep. The friend called Westenberger’s husband around 10 p.m. The husband later discovered the vehicle in the water and called 911.
At the time of her arrest, police recorded Westenberger’s blood-alcohol content at 0.129 percent.

I know I keep saying the same thing, but how is it that it's ok for a drunk, druggy, thief with a record to have children in her care in the first place. What the hell do we expect to happen to these children? We, the community, voters and everyone on earth needs to start connecting the dots and stop this. It astounds me how just plain wrong it is to allow these sort of people to have custody of any children they give birth to. It's crazy.

Criminal proceedings will continue for an Omro woman charged with
killing her 8-month-old son after she entered not guilty pleas during an
arraignment Wednesday.
Kayla B. Westenberger, 27, pleaded not guilty to charges of
first-degree reckless homicide, homicide by intoxicated use a motor
vehicle and child neglect resulting in death during a hearing before
Winnebago County Circuit Court Judge Thomas Gritton.Westenberger
is charged in connection with the death of her infant son, who
investigators found strapped into a car seat inside a sport utility
vehicle that was partially submerged in the Fox River near the Eureka
boat launch Oct. 30. Police were called to the scene by Westenberger's
husband, who found the vehicle in the water sometime after 10 p.m.According
to the criminal complaint, Winnebago County Sheriff's deputies found
Westenberger sleeping and smelling of alcohol at a friend's home. A
preliminary breath test determined Westenberger's blood-alcohol content
of .13 percent.The friend told deputies Westenberger arrived soaking wet at his house at 7:40 p.m., a few hours before police arrived.Westenberger
told investigators she was with her son and a friend a earlier that
evening but she did not know how she got to the friend's house and did
not remember driving the vehicle into the river.Emergency
responders at the boat launch attempted to pull the car from the river
to access the infant, but he was dead by the time they were able to
remove him.Westenberger,
who faces up to 143 years in prison if convicted on all counts, is due
back in court March 16 for a plea hearing. She remains in custody at the
Winnebago County Jail on a $750,000 cash bond.

Kayla Westenberger reaches plea deal

OSHKOSH - The Omro woman charged killing her son has reached a plea deal with prosecutors.

Kayla Westenberger, 28, has admitted to being drunk and high on marijuana when she drove her SUV into the Fox River last October.

Her eight-month-old son was in a car seat in the backseat. He later died.

In exchange for a no-contest plea, some of the more serious homicide charges were dropped.

Westenberger was convicted of neglecting a child which resulted in death.

Sentencing is set for October.
