A 22-year-old Silver Springs man was arrested on Nov. 23 on charges of child abuse and murder following the death of a two-year-old child.
Cody Wallace was arrested on those charges and is being held in the Lyon County Jail in Yerington. His bail on the child abuse charge was set at $75,000, and there is a no bail hold on the murder charge.Lyon County Sheriff's deputies were dispatched to a home in Silver Springs on a report of an incident involving a toddler who was having difficulty breathing, according to LCSO Sergeant Cherie Rye, who added that the young boy's mother and biological father were present, along with Wallace.The child was transported by ambulance to Carson-Tahoe Hospital and later transported by CareFlight to Renown Medical Center.According to Rye, the child "sustained multiple injuries and passed away on Nov. 24."Rye also indicated the case was under investigation, and she would not provide additional details concerning Wallace's arrest.

A Silver Springs man was jailed Saturday in the death of a 2-year-old boy there last week.

Cody Wallace, 22, is being held in the Lyon County Jail on suspicion of felony first-degree murder and child abuse.

According to Sheriff Allen Veil, paramedics were called to a home on Winchester Road in Silver Springs at 3:11 p.m. Nov. 23 on a report of a boy having difficulty breathing.

The child was taken by ambulance to Carson Tahoe Regional Medical Center. He was later transferred to Renown Regional Medical Center in Reno, where he died.

Wallace, who was dating the boy's mother, was home alone with the child at the time. He was arrested after an autopsy, the results of which were not released.

Wallace is being held without bail.

Preliminary hearing for Wallace set for July 12-13

A preliminary hearing for Cody Wallace, 23, of Silver Springs has been rescheduled again and is now set for July 12-13 in Walker River Justice Court.

Wallace, 23, is , charged in the death of a two-year-old toddler back in November, 2010.
Wallace faces first degree murder charges in the death of Thomas O'Connell IV, the child of Wallace's girlfriend. He was arrested on Nov. 23, 2010, after emergency medical responders were called to a home in Silver Springs on a report that a two-year-old wasn't breathing.

The child was pronounced dead at a Reno hospital the next day, and the murder charge was added.

Wallace was also charged with "abuse, neglect and endangerment of a child under age 14 causing substantial bodily or mental harm."

Wallace is being represented by Paul Quade, who was appointed by Walker River Justice of the Peace Michael Fletcher.

Quade is a death penalty-certified attorney, although the District Attorney's Office hasn't announced yet whether it will seek the death penalty in this case. Krueger previously announced a death penalty review panel would be convened again after the coroner's report is received, but a determination from the DA's Office isn't required until 30 days after an Information on the defendant is filed in District Court.

One stumbling block that has led to postponement of two prior preliminary hearing dates has been the autopsy report and evidence from the Washoe County Coroner's Office--mainly in relation to the cause of death--but that report has now been received, Chief Deputy District Attorney Mark Krueger reported last week.
