ROSWELL, Ga. - A custody dispute ended with a 5-year-old girl being taken from her preschool Friday morning. The father of Cayla Boston said he thinks his daughter was kidnapped by her mother. Police said they don't have enough evidence to consider it a crime.

Roswell police said they received a call from the Goddard School on Holcomb Bridge road that a 5-year-old was taken.

Investigators said the child's mother went to the school to pick up the little girl and realized that she was not on the list. The school called the child's father, Kevin Boston, who confirmed to school officials that the woman was the child's mother but she didn't have custody.

According to police, the woman and her boyfriend took the child and fled.

Investigators said no Amber Alert has been issued because Boston does not have legal custody of the child.

No Updates. Cayla's mother presumably has legal custody and her father didn't, so moving to found as no crime as been committed and this is not an active missing case.
